የሊዝ ምንነት
የመሬት ሊዝ ማለት የመሬቱ ባለቤት የሆነ አካል በተጻፈ ውል መሰረት የተወሰነ ብር በማስከፈል ለተወሰነ ጊዜ መሬቱን ሌላ ሰው እንዲጠቀምበት ማከራየት ነው በማለት በመዝገበ ቃላት ተተርጉሟል፡፡ በሀገራችንም አዋጅ ቁጥር 721/2004 በአንቀፅ 2(1) ላይ ሊዝ ማለት በጊዜ በተገደበ ውል መሰረት የከተማ ቦታ የመጠቀም መብት በውል የሚተላለፍበት ወይም የሚያዝበት የመሬት ይዞታ ስሪት ነው በማለት ደንግጓል፡፡ መሬቱን የተከራየው ሰው የመሬቱ ባለይዞታ ስለሆነ በውሉ ላይ በተቀመጠው ስምምነት መሰረት የኪራይ ጊዜው እስከሚያልቅ ድረስ ሙሉ መብት አለው፡፡ ማንኛውም የሊዝ ስምምነት መገኛ ምንጭ በቀጥታም ይሁን በተዘዋዋሪ መሬትን በነጻ ከያዘው አካል ሲሆን ይህ አካል የመሬቱ ባለቤትና ወሰን ለሌለው ጊዜ በመሬቱ ላይ መብት ያለው ነው፡፡ የከተማ መሬትን በሊዝ መያዝ አሁን አሁን በብዛት እየተተገበረ ያለ የመሬት አያያዝ መንገድ ነው፡፡

የከተማ መሬትን በሊዝ የመያዝ አላማ/አስፈላጊነት

የከተማ መሬትን በሚመለከት የሚዘረጋ የሊዝ ስርአት የሚከተሉት ጠቀሜታዎች ይኖሩታል
 መሬትን በአግባቡ ለመጠቀም፡- የመሬትን ልማት ለማቀድና ለመቆጣጠር መሬትን ሙሉ ለሙሉ በግለሰቦች ቁጥጥር ስር ከማድረግ ይልቅ በህግ አግባብ በሊዝ እንዲተዳደር ማድረግ ይመከራል፡፡ የከተማ መሬት በግለሰቦች ባለቤትነት ስር በሆነበት ሀገር መሬቱ እንዲለማ ለማድረግ የሁሉንም ስምምነት ለማግኘት ብዙ ጊዜንና ገንዘብን ይጠይቃል፡፡

 ኢንቨስትመንትንና ኢንቨስተሮችን ያበረታታል፡- ሌላው ጠቀሜታው ለኢንቨስትመንት ሲሆን ይኸውም የመሬቱ ዋጋ በሊዝ የሚከፈል በሆነ ጊዜ የመነሻ የመዋእለ ነዋይ ፍሰቱ አነስተኛ የሚሆን ሲሆን ይህም ለኢንቬስተሩ ተጨማሪ ካፒታል ለሌሎች ስራወች እንዲኖረው ያደርገዋል፡፡ በአንጻሩ ግን መሬቱን ለመግዛት የሚገደድ ከሆነ ሁሉንም ዋጋ መክፈል የሚኖርበት በመሆኑ ለዋናው ስራ የሚቀረው ገንዘብ አነስተኛ ወይም ምንም ሊሆን ይችላል፡፡ ይህም የሚገባውን ያህል ኢንቨስት እንዳያደርግ እንቅፋት ይሆንበታል፡፡

 መልሶ የመጠየቅ እድል፡- መሬት ለሌላ አላማ በሚፈለግበት ጊዜ መሬቱ በነጻ ከያዘው ሰው ይልቅ በሊዝ መሬትን ከያዘ ሰው መልሶ መጠየቅ የተሻለ እድል አለው፡፡ በሊዝ ስርአት የተያዘን መሬት እንደገና ለመውሰድ የሚጠይቀው ዋጋ አነስተኛ ነው፡፡

የከተማ መሬት የሊዝ ህግ

1. የኢፌዴሪ ህገመንግስት
ብዙ ሀገራት ዘንድ የመሬት ባለቤትነት ህገመንግስታዊ ጉዳይ አይደለም፤ ነገር ግን በኢትዮጵያ መሬት ባለው ማህበራዊና ኢኮኖሚያዊ ጠቀሜታ ምክንያት የመሬት ባለቤትነት የፖሊሲ ጉዳይ ከመሆን በላይ በህገመንግስቱ ውስጥ ተካቶ ዘላቂ ውሳኔን ያገኘ ጉዳይ ሆኗል።
በህገመንግስቱ አንቀፅ 40 መሰረት ሁሉም የከተማና የገጠር መሬት ባለቤትነት የኢትዮጵያ ህዝቦችና የመንግስት እንደሆነ ተደንግጓል። በመሆኑም ግለሰብ መሬትን መሸጥ መለወጥ አይችልም ማለት ነው። መንግስት ይህን የኢትዮጵያ ብሄር ብሄረሰቦችና ህዝቦች ንብረት የሆነን መሬት በይዞታው ስር አድርጐ በሚያስተዳድርበትና ለልማት በዋና መሳሪታነት በሚገለገልበት ጊዜ ዜጐች በከተማ ቦታ ላይ የሚያፈሯቸዉ ንብረቶች ላይ የሚኖራቸዉ ንብረቶችን በተመለከተ ህገ-መንግስታዊ ዋስትና የተሰጠዉ ሲሆን በዚሁ አንቀፅ ላይ “ማንኛውም ኢትዮጵያዊ በጉልበቱ ወይም በገንዘቡ በመሬት ላይ ለሚገነባው ቋሚ ንብረት ወይም ለሚያደርገው ቋሚ መሻሻል ሙሉ መብት አለው” በማለት ደንግጓል፡፡ ይህ መብት የመሸጥ የመለወጥ፣ የማውረስ፣ የመሬት ተጠቃሚነት ሲቋረጥ ንብረቱን የማንሳት ባለቤቱን የማዛወር ወይም የካሳ ክፍያ የመጠየቅ መብትን ያካትታል፡፡
2. የሊዝ አዋጅ
የከተማ መሬትን በሊዝ የመያዝ ስርአት በኢትዮጵያ ለመጀመሪያ ጊዜ ስራ ላይ የዋለው አዋጅ ቁጥር 80/1986 ከወጣ በኋላ ነው፡፡ ይህ አዋጅም በ1994 ዓ.ም በወጣው አዋጅ ቁጥር 272/94 የተሻረ ሲሆን እንደገና ይህ አዋጅ ደግሞ በአዋጅ ቁጥር 721/2004 ተሸሯል፡፡ ስለዚህ አሁን ሰአት ማንኛውም የከተማ ሊዝ ስርአት የሚስተናገደው በዚህ አዋጅ መሰረት ነው፡፡

በአዋጁ አንቀጽ 5 መሰረት የከተማ መሬትን በሊዝ የመያዝ ስርአት ከመዘርጋቱ በፊት ከተያዙ መሬቶች በስተቀር በኢትዮጵያ የከተማ መሬት መያዝ የሚቻለው በሊዝ ስርአት ብቻ ነው ከዚህ ውጭ በሌላ መንገድ መያዝ የተከለከለ ነው። ሆኖም ግን እንደልዩ ሁኔታ የተቀመጠው በክልሎች የሚገኙ የሊዝ ስርአትን ለመፈጸም የማይችሉ ትናንሽ ከተሞች አዋጁ ተፈጻሚ ከሆነበት ጊዜ ጀምሮ ከአምስት አመት ላልበለጠ ጊዜ የሊዝ ስርአቱ ተፈጻሚ እንዳይሆን ማድረግ ይችላሉ።

ነባር ይዞታወችን በተመለከተ ከተማው የሊዝ ስርአቱን ከመጀመሩ በፊት በህጋዊ መንገድ የተገኘ መሬት ወይም ነባሩ መሬት ተወስዶ በምትክ በካሳነት የተሰጠ መሬት በሊዝ ውል እስካልተሰጠ ድረስ ነባር ይዞታ ተብሎ ይወሰዳል። እንደመርህ ሁሉም የከተማ መሬት በዚህ አዋጅ በተደነገገው የሊዝ ስርአት መሰረት መተዳደር እንዳለባቸው አንቀጽ 5 ላይ የተደነገገ ቢሆንም ነባር ይዞታወችን በተመለከተ ወደ ሊዝ ስርአት ለመቀየር ህጉ ከሚከተሉት ሁኔታወች አንዱ እንዲሟላ ይጠይቃል፦
- በነባር ይዞታ ላይ ያለው ንብረት ከውርስ በስተቀር በሌላ ማናቸውም መንገድ ለሶስተኛ ወገን የተላለፈ እንደሆነ
- አግባብ ባልሆነ መንገድ ተይዘው የነበሩ ቦታወች አስተዳደሩ በሚያወጣው ደንብ መሰረት ወደ ሊዝ እንዲገቡ ሲደረግ
- ነባር ይዞታና በሊዝ የተያዘ ቦታ እንዲቀላቀል ተፈቅዶ ከሆነ ሁሉም ወደ ሊዝ ስርአት ይገባሉ
የተያዘ መሬት በማንኛዉም ምክንያት ወደ ሊዝ ስርአት ከተቀየረ ይዞታው የሊዝ መሬት የሚባል ሲሆን በአንቀጽ 16 መሰረት ባለይዞታው ከመንግስት ጋር የሊዝ ዘመኑንና የሊዝ ዋጋውን የሚያካትት የሊዝ ውል ይገባል። መሬትን በሊዝ እንዲይዝ የተፈቀደለት ሰው ስሙን፣ የመሬቱን ስፋት፣ አቅጣጫ፣ መሬቱ የሚውልበትን አላማ፣ የሊዝ ዋጋ፣ የሊዝ ዘመንና የመሳሰሉትን ያካተተ የሊዝ ይዞታ ምስክር ወረቀት ይሰጠዋል።
በሊዝ እንዲይዝ የተፈቀደለት ሰው በእያንዳንዱ ከተማ በሚወሰን የሊዝ መነሻ ዋጋ በቦታው ስፋት መጠን ተባዝቶ ይከፍላል። የሊዝ መነሻ ዋጋ ሲሰላ የመሰረተ ልማት መዘርጊያ ወጭን፣ ነባር ግንባታወች ያሉበት ቦታ ከሆነ ለነዚህ ንብረቶች ማስነሻ የወጣውን ወጭ እና ከቦታው ተነሽ ለሆኑ ሰወች የሚከፈል ካሳን እንዲሁም ሌሎች አግባብነት ያላቸውን ሁኔታወች ግምት ውስጥ ያስገባ መሆን አለበት። የሊዝ ይዞታ የተሰጠው ሰው የሚከፍለው ቅድሚያ ክፍያ ከ10% ማነስ የሌለበት ሲሆን ቀሪውን በውሉ መሰረት በተቀመጠ ረጅም የጊዜ ሰሌዳ መሰረት እንዲከፍል ይደረጋል።
በሊዝ አዋጁ መሰረት የከተማ ቦታ የሚገኝባቸው ስልቶች
ቀደም ሲል የነበሩት የከተማ ቦታ ማስተላለፊያ መንገዶች ያልተገቡና ለሙስና መንገድ ከፋች በመሆናቸዉ አሁን ባለው አሰራር ህጉ እውቅና የሰጣቸው ሁለት መሰረታዊ የማስተላለፊያ መንገዶች ጨረታ እና ምደባ ብቻ መሆናቸውን በአንቀጽ 7(2) ላይ ተደንግጎ ይገኛል፡፡ እንደ መርህ ማንኛውም ለመኖሪያ፣ ለንግድም ሆነ ለሌላ ማንኛውም አላማ የሚፈለግ መሬት ከመንግስት የሚተላለፈው በጨረታ ነው፡፡ ተጫራቾች የሊዝ መነሻ ዋጋን መሰረት በማድረግ የራሳቸውን መግዣ ዋጋ የሚያቀርቡ ሲሆን በዚህ ዋጋና በቅድሚያ በሚከፍለው የገንዘብ መጠንን መሰረት በማድረግ አሸናፊው ይመረጣል፡፡ ..................

..............#ለግልጸኝነት እንዲረዳና ካልተገባ አሰራር ነጻ ለማድረግ አዋጁ ዝርዝር የሆነ የጨራታ አካሄድንም አካቶታል።
ጨረታ የከተማ መሬት ማስተላለፊያ ሆኖ በመርህ ቢቀመጥም እንደልዩ ሁኔታ ለህብረተሰቡ ከፍተኛ ጠቀሜታ ላላቸው አካላት መሬት በምደባ ሊተላለፍ ይችላል፡፡ ምደባ የሚለውን ሀሳብ አዋጁ ሲተረጉመው በጨረታ ሊስተናገዱ ለማይችሉ ተቋማት በመሬት ላይ የመጠቀም መብት በሊዝ የሚተላለፍበት ስልት ነው ይለዋል፡፡ መሬት በምደባ ሲተላለፍ የሊዝ መነሻ ዋጋ ይከፈል አይከፈል አዋጁ ላይ አልተገለጸም፡፡ ሆኖም ግን ስለሊዝ መነሻ ዋጋ በግልጽ የተቀመጠው በአንቀጽ 12(3) ላይ ከአዲስ አበባ ውጭ የሆኑ የቀበሌ ቤት ነዋሪ የነበሩ ተነሽ በሚሆኑበት ጊዜ ምትክ ቤት መስጠት ካልተቻለ ቤት የሚሰሩበት ቦታ በምደባ ተሰጥቷቸው የሊዝ መነሻ ዋጋ መክፈል እንዳለባቸው ነው፡፡

በምደባ የከተማ ቦታ የሚሰጣቸው አካላት አንቀጽ 12 ስር ተዘርዝረዋል፡፡ እነሱም፡- ለባለበጀት የመንግስት መስሪያ ቤት ለቢሮ አገልግሎት፣ በመንግስት ወይም በበጎ አድራጎት ድርጅቶች ለሚካሄዱ ማህበራዊ የአገልግሎት መስጫ ተቋማት፣ በመንግስት ለሚካሄዱ የጋራ መኖሪያ ቤቶች እና ለራስ አገዝ የጋራ መኖሪያ ቤት ግንባታወች፣ ለእምነት ተቋማት አምልኮ መፈጸሚያ፣ ለማኑፋክቸሪንግ ኢንዱስትሪወች ልማት፣ ለኤምባሲወችና ለአለምአቀፍ ድርጅቶች አገልግሎት፣ በተለዩ ልዩ አገራዊ ፋይዳ ላላቸው ፕሮጀክቶች የሚውሉ ቦታወች ናቸው፡፡

የሊዝ መብትን ስለማስተላለፍ
ልክ እንደሌሎች የንብረት መብቶች የሊዝ መብትንም ማስተላለፍ የሚቻል ሲሆን በኢትዮጵያ ህግ ግን የተወሰኑ ገደቦች ተቀምጠውበታል፡፡ በአዋጁ አንቀጽ 24(1) ላይ የከተማ ቦታ ላይ የሊዝ ባለይዞታ የሆነ ሰው የይዞታ መብቱን ማስተላለፍ ወይም በከፈለው የሊዝ ክፍያ መጠን ልክ በዋስትና ለማስያዝ ወይም በካፒታል አስተዋጽኦነት መጠቀም እንደሚችል ተደንግጎ ይገኛል፡፡ እዚህ ላይ መረዳት የሚገባው በተከፈለው የሊዝ ክፍያ መጠን ልክ የሚለው የሚያገለግለው መብቱን በዋስትና ማስያዝ ወይም በካፒታልነት ለመጠቀም እንዲሁም በተወሰነ መልኩ ግንባታው ሳይጠናቀቅ ለሚሸጥ ግንባታ ነው፡፡

#የሊዝ ውል ምስረታና ይዘት
በአዋጁ መሰረት የከተማ መሬት በሊዝ እንዲይዝ የተፈቀደለት ማንኛውም ሰው አንቀጽ 16 እንደተመለከተው ከሚመለከተው አካል ጋር የሊዝ ውል ማድረግ አለበት፡፡ የሊዝ ውሉም ግንባታው የሚፈጸምበትን ጊዜ፣ የሚጠናቀቅበትን ጊዜ፣ የክፍያ አፈጻጸም ሁኔታ፣ የችሮታ ጊዜ፣ የውል ሰጭና ተቀባይ መብትና ግዴታ እንዲሁም ሌሎች አስፈላጊ ዝርዝር ሁኔታወችን ያካተተ መሆን አለበት፡፡ እንደውል ሁሉ በአዋጁ የተቀመጠ ልዩ ድንጋጌ ከሌለ በስተቀር በፍትሐ ብሔር ህጉ ላይ ያለው ጠቅላላ የውል ድንጋጌወች ለሊዝ ውልም ተፈጻሚ ይሆናሉ፡፡ የሊዝ ውል አካል ከሆኑት መካከል አንዱና ዋናው የሊዝ ዘመን ነው፡፡ የሊዝ ዘመን እንደከተማው የእድገት ደረጃና የልማት ስራው ዘርፍ ወይም የአገልግሎቱ አይነት የሚለያይ ሆኖ ከ15 እስከ 99 አመት ሊደርስ እንደሚችል በአዋጁ ተደንግጓል፡፡

#የሊዝ ውል መቋረጥ
#በአዋጁ አንቀጽ 25 ላይ የሊዝ ውል የሚቋረጥባቸው ሶስት ሁኔታወች ተቀምጥል እነርሱም፡-
ባለይዞታዉ በሊዝ የተለከበዉን ቦታ በሊዝ ዉሉ ላይ በተገለጸው አግባብ አለመጠቀም(ውልን አለማክበር) ፣ ለህዝብ ጥቅም ሲባል እና የሊዝ ዘመን ሲያበቃና ሳይታደስ ሲቀር ናቸዉ፡፡

Feteh organized a one-day general meeting to establish an association of Law Schools in Ethiopia. As founding members, representatives from 36 universities gathered together to officially establish the Ethiopian Law Schools Association (ELSA) and approve the bylaws.

During the meeting executive committees and board members have been selected. Wolaita Sodo University, Debre Brahan University, and Bule Hora University as a three executive committee and the University of Gondar, Bahir Dar University, Haramaya University, Dire-Dawa University, Arba Minch University, Jimma University, and Ambo University as seven board members were elected by voting whereas the hierarchy was arranged by the highest number of votes.

Feteh supported the development of bylaws to establish the Ethiopian Law Schools Association (ELSA). The association is expected to foster cooperation between law schools and serve as an open and independent forum for experience sharing and discussion of diverse ideas about legal education and also enhance and strengthen the role of law in the development of the country through legal education.
