ለ) የኣቀራረቡ ፎርም ሲታይ ደግሞ በቁ.130 (1) ወይም (2) መሰረት የሚቀርበው መቃወሚያም ሆነ ዓቃቤ ሕጉ ለመቃወሚያው የሚሰጠው መልስ ሁሉ በቃል መቅረብ እንዳለበት ከቁ.131 (1) መረዳት ይቻላል፡፡ ተደጋጋሚ ስልጠናዎች እየተሰጡ ኣሁን ኣሁን እየተሻሻለ የመጣ ቢሆንም በተግባር ሲሰራበት የነበረና ኣሁንም ሙሉ በሙሉ ተቀርፏል ብሎ በኣስተማማኝ መናገር የማይቻለው፤ መቃወሚያ ለማቅረብ ጊዜ መስጠት ፣ መቃወሚያው በፅሑፍ ማቅረብ ፣ ዓ/ሕግ የመቃወሚያው ግልባጭ እንዲደርሰው ማድረግ ፣ ዓ/ሕግ በሚሰጠው ቀነ ቀጠሮ መልሱ በፅሑፍ ያቀርባል ፣ ተከሳሹ በበኩሉ የመልስ መልስ በፅሑፍ ለማቅረብ ጊዜ ይሰጠዋል ፣ በመጨረሻ ፍ/ቤቱ የተከሳሽ መቃወሚያና የዓ/ሕግ መልስ ከሕጉ ጋር ኣገናዝቦ ብይን ለመስጠት ቀጠሮ ይሰጣል፤ ምናልባት ምርመራው ያላለቀ ከሆነ ተለዋጭ ቀጠሮ መስጠት እንደተጠበቀ ሆኖ ፍ/ቤቱ ብይን ይሰጣል፡፡ ይህ የተንዛዛ ኣካሄድ ሕጉ ከሚያዘው ውጭ መሆኑን ግንዛቤ ሊወሰድበት ይገባል፡፡

ሐ) ከመቃወሚያ ጋር ተያይዞ ሌላ መታየት ያለበት ነጥብ በመቃወሚያነት መቅረብ ያለበት በወ/መ/ሕ/ስ/ስ/ቁ.130 ላይ ከተዘተዘሩት ምክንያቶች ሲገኝ ብቻ ነው ወይስ ከዚያ ውጭ የሆኑ ምክንያቶች ሲገኙም ማቅረብ ይፈቀደል የሚለው ነው፡፡ በዚህ ዙርያ ሁለት ኣስተሳሰቦች ይራመዳሉ፡፡ በአንድ በኩል በወ/መ/ሕ/ስ/ስ/ቁ.130 ላይ ባይሸፈንም የክሱ መሰማት ሂደት እንዳይቀጥል የሚያደርጉ ሌሎቸ ምክንያቶች በተገኙ ጊዜም ተከሳሽ እንዲያነሳ ሊፈቀድለት ይገባል የሚሉ ኣሉ፡፡ በሌላ በኩል ደግሞ ቁ.130 ሌላ የመቃወሚያ ነጥብ በማይጨምር ሁኔታ (exclusively) ዘርዝሮ ያስቀመጠ በመሆኑ ከዚያ ውጭ የሚቀር ተቃውሞ ተቀባይነት ሊያገኝ ኣይገባም የሚል ሓሳብ የሚያራምዱ አሉ ብቻ ሳይሆን ኣብዛኛው ጊዜ በተግባር የሚሰራበትም ይህ ኣቋም ነው ፡፡ እንደ የሞጁሉ ኣዘጋጅ እምነትም በወ/መ/ሕ/ስ/ስ/ቁ. 130 ስር የማይሸፈን የተቃውሞ ነጥብ በሚነሳበት ጊዜ ተቀባይነት ሊያገኝ ኣይገባውም፤ ምክንያቱም በዛ ስር ያልተጠቀሰ ነጥብ በማያካትት እና በተሟላ ሁኔታ (exclusively and exhaustively) የተቀረፀ ነው፡፡

2. መቃወሚያውን ስለመመርመርና ስለመወሰን

በቁ. 13. (2) መሰረት የሚቀርበውን ማንኛውንም መቃወሚያ ፍርድ ቤቱ በመዝገቡ ከፃፈ በላ ዓ/ሕጉ መልስ እንዳለው ይጠይቃል፡፡ የቀረበውን መቃወሚያ ሕግን በመጥቀስ ለመወሰን የሚቻል ከሆነ ወይም ዓ/ሕጉ መቃወሚያውን ካልተቃወመ ፍ/ቤቱ ወድያው ይወስናል (ቁ. 131 (1)) ፡፡ ፍ/ቤቱ ጉዳዩን ለማጣራት ማስረጃ መቅረቡ ኣስፈላጊ ሆኖ ካገኘውና ማስረጃ ሳይቀርብ ወድያው ውሳኔ (ብይን) መስጠት የማይቻል በሆነ ጊዜ ኣስፈላጊው ማስረጃ እንዲቀርብ ማዘዝ ይችላል (ቁ. 131 (3)) ፡፡ የተፈለገው ማስረጃ አስቀርቦ ከመረመረ በላ ፍ/ቤቱ ወዲያው ውሳኔ መስጠት እንዳለበት ቁጥር 131 (4) ይደነግጋል፡፡

ፍርድ ቤቱ በመቃወሚያው ላይ የሚሰጠው ውሳኔ /ብይን/ እንደየ መቃወሚያው ዓይነት ሊለያይ ይችላል፡፡ ይኸዉም፡-

ሀ) የቀረበው መቃወሚያ የሕግ ድጋፍ የሌለው ከሆነ ወይም በማስጃ ካልተደገፈ መቃወሚያውን ውድቅ ያደርጋል ፣
ለ) በቁ. 130/ 2/ለ/፣ /ሐ/፣ ወይም/ሰ/ መሰረት የቀረበው መቃወሚያ ተቀባይነት ካገኘ ክሱን ዘግቶ ተከሳሹን ያሰናብታል ፣
ሐ) በቁ.130/2/ሀ/ መሰረት የቀረበ መቃወሚያ ከሆነ ጉዳዩ በተጀመረበት ፍ/ቤት እንዲቀጥል በማዘዝ መዝገቡን ይዘጋል ፣
መ) በቁ. 130(2) (መ) መሰረት የቀረበው መቃወሚያ ተቀባይነት ካገኘ ክሱ ተነጥሎ እንዲታይ ያዝዛል ፣
ሠ) በቁ. 130 /2/ሠ/ የቀረበ መቃወሚያ ከሆነ ኣስፈላጊው ፈቃድ እስኪሰጥ መዝገቡን ለጊዜው ይዘጋዋል ፣
ረ) በቁ. 130/2/ረ/ የቀረበ ከሆነ ደግሞ ኣስቀድሞ መፈፀም ያለበት ስርዓት እስኪፈፀም መዝገቡን ለጊዜው ይዘጋዋል፡፡

ከዚህ በላይ በፊደል “ለ” የተጠቀሰውን እንዳለ ሆኖ ተከሳሹ ሙሉ በሙሉ ሃላፊ ባለመሆኑ ክሱ በተዘጋ ጊዜ የተከሳሹ ሁኔታ በፀጥታ ወይም በህዝብ ሰላማዊ ኑሮ ላይ ሁከት ወይም ኣደጋ የሚያደርስ መስሎ ከታየው ተከሳሹ ተገቢ በሆነ ስፍራ ወይም ሕክምና በሚያገኝበት ቦታ ተወስኖ እንዲቀመጥ ፍ/ቤቱ ያዝዛል ( የወ/መ/ሕ/ስ/ስ/ቁ. 208 እና የወ/ሕግ ዓንቀፅ 130 እስከ 132 ) ፡፡

5.#ገላጭ ማስረጃ/Demonstrative Evidence/
ገላጭ ማስረጃከስሙ እንደምንረዳው የተፈፀመውን ድርጊት የሚገልፅወይም የሚያብራራና የማስረጃ ዓይነት ነው፡፡ይህም ማስረጃ ተቀባይነት የሚኖረው የሚፈለጉትን ተገቢነት አሟልቶ በሚገኝበት ጊዜ ሲሆን በዚህ ማስረጃነት የሚታወቁት ምሳሌ እንደ ካርታ፣ የወንጀልስፍራንድፍ ፣አንሜሽን፣ ፎቶግረፍ፣ የቪዲዮ ፊልሞችና ወዘተ ናቸው፡፡
6.#የሰነድ ማስረጃ/Documentary Evidence/
የሰነድ ማስረጃከተጨባጭ ማስረጃዎች አይነቶች አንዱ ሲሆንይህም ማስረጃው በፅሁፍ መልክለፍረድ ቤቱየሚቀርብነው፡፡ይኸውም የሁለት ተዋዋይወገኖች የውል ስምምነት፣ በመንግስትመስሪያቤት ወይም በግልድርጅት ተፅፈው የሚገኙ ለጉዳዩአግባብነትያላቸው ፅሁፎች፣ ልዩ ልዩ ጋዜጣዎች፣ መፅሔቶች፣ መፅሐፍቶች፣ ላንግድ ስራ የተዘጋጁ ልዩልዩ ፅሁፎች ወዘተ የመሳሰሉት ሲሆኑ እነዚህን ማስረጃዎች ፍርድ ቤቱ እራሱ በማንበብ የሚረዳቸው የማስረጃ አይነቶች ናቸው፡፡
7.#ኤግዚቪት ትርጉም (Exhibit)
አግዚቪት ማለት ከአንድ የወንጀል ድርጊት ጋር ግንኙነት ያላቸው ልዩልዩንብረቶች ጥሬ ገንዘብ፣ወንጀል የተፈጸመባቸው መሳሪያዎች፣በህገወጥ መንገድ በተጠርጣሪው እጅ የተገኙ ልዩልዩዕቃዎች፣ወንጀል ከተፈፀመበት ቦታ የተሰበሰቡናከወንጀል ድርጊት ጋርግንኑነት ያላቸው ለፍርድ ቤት በማስረጃነት የሚቀርቡ የሚታዩ፣ የሚዳሰሱ የሚሸተቱና የሚቀመስ ለወንጀልመፈፀሚ ወይንም ማስፈፀሚ ያየዋሉ ወይም የወንጀል ውጤት የሆኑ ቁሳዊ ነገሮች ናቸው፡፡
