የስልጣን ክፍፍል

የስልጣን ክፍፍል በአገራችን ህገ መንግስታዊ መርህ ሲሆን ህግ አውጭው፤ ህግ ተርጓሚውና ህግ አስፈፃሚው ያላቸውን ስልጣን ከፋፍሎ ያስቀምጣል፡፡ ይሁን እንጂ ከዚህ መርህ በተቃራኒ የአስተዳደር ህግ ከተግባራዊ ምክንያቶች የተነሳ ስራ አስፈፃሚው አካል ሕግ ከማስፈፀም ስልጣኑ በተጨማሪ ህግ የማውጣትና ህግ የመተርጐም ተግባራትን እንዲያከናውን በልዩ ሁኔታ ይፈቅዳል፡፡ እነዚህ ተደራራቢ ስልጣናት የመንግስት አስተዳደርን የበለጠ ውጤታማ ለማድረግ በልዩ ሁኔታ የተሰጡ እንጂ በመርህ ደረጃ ከስልጣን ክፍፍል መሰረተ ሀሳብ ጋር ይጋጫሉ፡፡ ስለሆነም የህገ መንግስቱ የስልጣን ክፍፍል መርህ የአስተዳደር መስሪያ ቤቶች ደንብና መመሪያ የማውጣት እና ዳኝነታዊ ውሳኔ የመስጠት ስልጣን በአፈፃፀም ረገድ በጠባቡ እንዲተረጐም በማድረግ የዚህ ስልጣናቸው ገደብ ሆኖ ያገለግላል፡፡

ይኸው መርህ ፍርድ ቤቶች ሚናቸው እስከየት ድረስ እንደሚዘልቅ ይወስናል፡፡ መደበኛ ፍ/ቤት በህግ ተለይተው በታወቁ የምርመራ ምክንያቶች ስልጣን ካልተሰጠው በስተቀር በስልጣን ውስጥ የተፈፀመ ድርጊት ከማረም መቆጠብ ይኖርበታል፡፡ ፍ/ቤቶች በስልጣን ውስጥ የተፈፀመ ድርጊትን የሚያርሙ ከሆነ በስራ አስፈፃሚው ስልጣን ጣልቃ በመግባት የስልጣን ክፍፍል መርህን ይጥሳሉ፡፡

በወንጀል ቅጣት ሂደት ደረጃ እና እርከን ያልወጣላቸውን ወንጀሎች ደረጃና እርከን ሲወጣ ስህተት መኖሩ፤ ተመጣጣኝና ወጥ ቅጣት አለመኖሩ፣ እና የቅጣት አነሰ በዛ ይግባኛኝ በፍ/ቤቶቻችን መስተዋሉ፣ እና በቴክኒካል ቅጣት አሰራር ችግር ምክኒያት የቅጣት አሰጣጥ እና አተገባበር ችግር መኖሩ እና በአንዳንድ ደኞች ቅጣትን በአግባቡ ማሰላት አለመቻል ስለሚስተዋል ዳኞች ቅጣትን ለመወሰን ደረጃ እና እርከን በማዉጣት የሚወስደዉን ጊዜ ለመቆጠብ ብሎም ይህንን ደረጃ እና እርከን ለማዉጣት የሚቸገሩ ዳኞችን በመረዳት በወንጀል ዉሳኔ አሰጣጥ ጊዜ በቅጣት አወሳሰን መመሪያ ቁጥር 2/2006 መሰረት ደረጃ ያልወጣላቸዉን የወንጀል ድንጋጌዎችን በተመለከት ደረጃ እና እርከን እንዴት ይወጣል? የሚለዉን የቀመር አወጣጥ ችግር ይቀርፋል ያሉትን መፍትሄ ለፍርድ ቤታችን በማስፈለጉ ይህ ፅሁፍ ተዘጋጅቷል፡፡

ባለ አንድ አባል ኃላፊነቱ የተወሰነ የግል ማህበር (One-person private limited Company) እና ኃላፊነቱ የተወሰነ የሽርክና ማህበር (Limited Liability Partnership) በአዲሱ የንግድ ሕግ አዋጅ ቁጥር 1243/2013


ባሳለፍነው ዓመት ኢትዮጵያ ላለፉት ስድስት አስር አመታት ስትጠቀምበት የነበረውን የንግድ ሕግ በማሻሻል በአዲሱ የንግድ ሕግ አዋጅ ቁጥር 1243/2013 ተክታለች፡፡ በቀድሞ የንግድ ህግ አንድ ነጋዴ ሊመሠርት የሚችለው የንግድ ማህበር ወይም ድርጅት ስድስት ዓይነት ሲሆን እነዚህም ተራ የሽርክና ማህበር (ordinary partnership) ፣ የህብረት ሽርክና ማህበር (general partnership) ፣ ሁለት ዓይነት ኃላፊነት ያለበት የሽርክና ማኅበር (limited Partnership)፣ የእሽሙር ሽርክና ማህበር (joint venture) ፣ የአክሲዮን ማህበር (share company) እና ኃላፊነቱ የተወሰነ የግል (private limited company) ማህበር ናቸው፡፡

በአዲሱ የንግድ ሕግ ባለ አንድ አባል ኃላፊነቱ የተወሰነ የግል ማህበር (One-person private limited Company) እና ኃላፊነቱ የተወሰነ የሽርክና ማህበር (Limited Liability Partnership) አዲስ የተጨመሩ ማህበራት ሲሆኑ ተራ የሽርክና ማህበር ደግሞ ከአማራጭ ማህበርነት ተቀንሷል፡፡ የዚህ አጭር ፅሁፍ ዓላማ አዳዲስ የተጨመሩትን እንግዳ የንግድ ማህበራት በመመርመር ማስተዋወቅ ነው፡፡

#የይርጋ መነሻ ጊዜና የሰበር የህግ ትርጉም፦
