ኩላሊቶቻችን በታቸኛው ጀርባችን ከጎድን አጥንታችን በታች የሚገኙ ሁለት ባቄላ መሰል አካሎች ናቸው።
ኩላሊቶቻችን ደማችንን የማጣራት ስራ ሰርተው ቆሻሻውን በሽንት መልክ እንዲወገድ ያደርጋሉ።
የኩላሊት ሌላኛው ጥቅም ሰውነታችን ውስጥ የሚገኝ የማያስፈልግ ውሃ ማስወገድ ነው። ሰውነታችን ውሃ ሲያስፈልገው በማጠራቀም ይታወቃሉ። በተጨማሪም ሰውነታችን ውስጥ ያለውን የካልሲየም እና ፎስፌት መጠን ይቆጣጠራሉ። የደም ግፊት የሚቆጣጠሩ ሆርሞኖችንም በማመንጨት ይታወቃሉ።
በጤንነት ለመቆየት የኩላሊቶቻችንን ጤንነት መጠበቅ አለብን። የኩላሊት ህመም ከሚያመላክቱ ስሜቶች መሃከል የሽንት ቀለም መቀየር፣ የሽንት ብዛት መቀየር፣ የማዞር ስሜት፣ ማስመለስ፣ የደም ማነስ፣ የመተንፈስ ችግር፣ የመቀዝቀዝ ስሜት፣ የድካም ስሜት፣ ቆዳን ማሳከክ እና የተለያዩ የህመም ስሜቶች ይገኙበታል።
እነኚህ ስሜቶች ከተሰሙዎት ዶክተር ማማከር አለብዎት። የኩላሊት ህመም ብዙ መንስኤዎች አሉት። ብዙ ልማዶች ለኩላሊት ህመም ተጠያቂ ይሆናሉ።
1) ሽንትን መቋጠር
ሽንት ስይሸኑ ረጅም ግዜ መቆየት ኩላሊት ከሚጎዳባቸው ዋነኛ ምክንያቶች ውስጥ ይጠቀሳል።
ሽንት በፊኛ ውስጥ ረጅም ሰአት ሲቆይ በውስጡ የሚያድጉት ባክቴሪያዎች ይበራከታሉ። እንዚህ ባክቴሪያዎች የሽንት ቧንቧ ወይም የኩላሊት ኢንፌክሽን ሊያመጡ ይችላሉ። ሽንትን መያዝ ኩላሊት ላይ በሚያደርሰው ጫናም ኩላሊት ተጎድቶ ሽንትን የመቆጣጠር ችሎታችንን ሊያጠፋ ይችላል።
በየግዜው ሽንትዎን የሚይዙ ከሆነ በፍጥነት ልማዱን ማቆም አለብዎት። በስራ ምንም ያህል ቢጠመዱም የተፈጥሮ ጥሪን ሰምቶ ማስተናገድ ተገቢ ነው።
2) በቂ ውሃ አለመጠጣት
በቂ ውሃ አለመጠጣት ኩላሊት ላይ ጉዳት ሊያደርስ ይችላል። የኩላሊት ዋና ስራ የሰውነታችንን ቆሻሻ ማስወጣት አና ኢሪትሮሳይት ማምረት ነው።
ሰውነታችን ውሃ ሲያንሰው ወደ ኩላሊታችን የሚሄደው የደም መጠን ይቀንሳል። ደማችን ይበልጥ ይረጋል። በዚህም ሁኔታ ኩላሊታችን ደማችን ውስጥ ያለውን ቆሻሻ ማጣራት ይቸገራል። ቆሻሻው በጨመረ ቁጥር ለጤናችን አደጋ ይሆናል።
እንደ ናሽናል ኩላሊት ፋውንዴሽን አንድ ሰው በቀን ቢያንስ ከ10 እስከ 12 ብርጭቆ ውሃ መጠጣት አለበት። ነገር ግን ውሃ ማብዛትም ለኩላሊት ህመም ሊፈጥር ይችላል። ስለዚህ ማብዛት የለብንም።
ይህ ቆንጆ ኢትዮጵያ የቁምነገሮች ፔጅ ነው ። ንባብዎን ሲጨርሱ ፔጃችንን ላይክ ቢያደርጉ በየእለቱ አዳዲስ ቁምነገሮችን እናደርሶታለን ። አሁን ንባብዎን ይቀጥሉ እናመሰግናለን ።
3) ጨው ማብዛት
ብዙ ጨው መመገብ ኩላሊታችን ላይ ከፍተኛ ጉዳት ሊያመጣ ይችላል። በምንመገበው ጨው የሚገኘውን ሶዲየም 95% ያህሉ በኩላሊታችን ነው የሚቀየረው። ጨው ስናበዛ ኩላሊታችን ጨውን ለማጣራት ይበልጥ መስራት ይኖርበታል። ኩላሊቶቻችን ከአቅማቸው በላይ ሲሰሩ ሰውነታችን ውስጥ ከፍተኛ ውሃ ጥርቅም ይፈጠራል። ይህ ጥርቅም የደም ግፊታችንን ይጨምራል ለኩላሊት ህመምም ተጋላጭነታችንን ይጨምራል።
4) ፔይን ኪለር(ህመም የሚቀንሱ) መድሃኒቶችን መጠቀም ማዘውተር
ብዙዎቻችን በየግዜው የሚሰማንን እራስ ምታት እና የህመም ስሜቶች ለማስታገስ ፔይን ኪለርን አዘውትረን እንጠቀማለን። እንደዚህ ስናደርግ ግን ሳናውቀው እኩላሊታችንን ጨምሮ የተለያዩ የሰውነት አክሎችን እየጎዳን ነው።
የህመም ማስታገሻ መድሃኒቶች ወደ ኩላሊት የሚሄደውን የደም ዝውውር መጠን ይቀንሳሉ። የኩላሊትን ስራ ይረብሻሉ። አልፎም በከፍተኛ ደረጃ መድሃኒቶቹን መጠቀም የሰገራ መቆጣጠር ብቃታችንን ያጠፋል። ክሮኒክ ኢተርስቲሻል ኔፍራይቲስ የሚባል ዘላቂ የኩላሊት ህመም ያስከትላል።
የኩላሊት ህመም ካለብዎ ዶክተርዎን ሳያማክሩ የህመም ማደንዘዣ መድሃኒቶችን አይጠቀሙ። እኩላሊታችን ያለችግር እየሰራም ቢሆን መድሃኒቶቹን በትንሹ ነው መጠቀም ያለብን።
5) ፕሮቲን ያላቸው ምግቦች ማብዛት
ፕሮቲን ለሰውነታችን እና ለጤናችን አስፈላጊ የሆነ ንጥረ ነገር ነው። ግን ስጋ ወይም ሌላ ፕሮቲን ጠገብ ምግቦችን ከልክ በላይ የምንበላ ከሆነ እራሳችንን ለኩላሊት ህመም እያጋለጥን ነው።
የኩላሊት አንዱ ጥቅም ፕሮቲንን በመፍጨት ወደ ናይትሮጅን ቀይሮ ማስወገድ ነው። ከፍተኛ የፕሮቲን ተጠቃሚ ከሆንን እኩላሊታችን ላይ ከፍተኛ ጫና እያደረግንበት ይሆናል። የኩላሊት ህመም ያለባቸው ሰዎች ቀይ ስጋ ከመብላት መቆጠብ ይኖርባቸዋል።
6) መጠጥ ማብዛት
በመጠን መጠጣን ችግር የለውም። መጠጥ ሲበዛ ግን እኩላሊታችንን አደጋ ላይ ይጥላል። መጠጥ እኩላሊታችን እና ጉበታችን ላይ ከፍተኛ ጫና ያሳድራል። በከፍተኛ ደረጃ መጠጣት ሪናል ቲዩቡልስ የሚባለው አካላችን ላይ የዩሪክ አሲድ ክምችት እንዲፈጠር ያደርጋል። ይህም የኩላሊት ስራ ማቆም ሊያስከትል ይችላል። አልኮል ሰውነታችን ላይ ውሃ ማነስ ስለሚፈጥር በዛ ረገድም ለእኩላሊታችን ጥሩ አይደለም።
መጠጥ የሚጠጡ ከሆን በመጠኑ ያድርጉት። ለወንድ በቀን ሁለት ግዜ ለሴት ደግሞ በቀን 1 ግዜ መጠጣት ተገቢ ነው ተብሎ ይታመናል።
7) ሲጋራ ማጨስ
እንደ ሴንተር ፎር ዲዚዝ ኮንትሮል(ሲዲሲ) ማጨስ ኩላሊትን ጨምሮ ለእያንዳንዱ የሰውነት አካል መጥፎ ነው። ብዙ ጥናቶች በማጨስ እና ኩላሊት በሽታ መሃከል ከፍተኛ ግንኙነት እንዳለ ይናገራሉ።
ኤንድ ስቴጅ ሪናል ዲዚዝ(ኢኤስአርዲ) ለሚባለው በሽታ ማጨስ እንደ አንደኛ መንስኤ ተጠቃሽ ነው። ማጨስ የደም ግፊትን እና የልብ ትርታን ይጨምራል። በሰውነታችን ውስጥ የደም ዝውውር ይቀንሳል። የኩላሊት በሽታ ካለብን ይበልጥ ያባብሰዋል።
8) ከመጠን በላይ ቡና መጠጣት
ቡናን ማብዛት የደም ግፊትን ይጨምራል። እሱ ደግሞ በተራው እኩላሊታችን ላይ ጫና ይፈጥራል። ከግዜ በኋላ እኩላሊታችን እየተጎዳ ይመጣል።
በ2002 በኩላሊት ኢንተርናሽናል እንደታተመው ጥናት ቡና መጠጣት ከኩላሊት ጠጠር ጋር ግንኙነት አለው።
ቡናን በመጠኑ መጠጣት ለአብዛኛው ሰው ችግር አያመጣም። በቀን ከ 1 እስክ ሁለት ስኒ ቡና እና 3 ስኒ ሻይ መጠጣት ችግር አያመጣም።
9) ቀላል ኢንፌክሽኖችን በግዜው አለመከታተል
ጉንፋን፣ ቶንሲል እና ለመሳሰሉት ቀላል ኢንፌክሽኖች ተገቢውን ክትትል አለማግኘት ኩላሊትን አደጋ ላይ ሊጥል ይችላል።
ብዙ የኩላሊት ህመም ያላቸው ሰዎች ሌላ ህመም ሲያማቸው ባለማረፍ ይታወቃሉ። በተጨማሪም የኩላሊት ህመም ያለባቸው ሰዎች በአየር ጸባይ ለውጥ በቀላሉ ይታመማሉ። ቀላል ህመም የሚፈጥሩ ባክቴሪያዎች እና ቫይርሶች ኩላሊት ላይ ጉዳት ይፈጥራሉ። እነዚህን ቀላል ህመሞች ተከታትሎ መፍትሄ መፍጠት ያስፈልጋል።
10) የእንቅልፍ እጦት
በስራ መጠመድ ምክንያት ብዙ ሰዎች የእንቅልፍን አስፈላጊነት ይረሳሉ። ከ6-8 ሰአት መተኛት ለጤናችን አስፈላጊ ነገር ነው። በእንቅልፍ ግዜ የተጎዱ የሰውነት አካላችን ይታደሳሉ። በቂ እንቅልፍ አለማግኘት ይህ እድሳት በተገቢው ሁኔት እንዳይካሄድ እንቅፋት ይሆናል። ኩላሊት እና ሌሎች የሰውነታችን አካሎች ይጎዳሉ።
ሌሎች ጥናቶች እንደሚጠቁሙት እንቅልፍ እጦት የደም ግፊትን ይጨምራል።
ይህም ለኩላሊት መጥፎ ነገር ነው።

The Junior Legal Consultant is expected to support the Legal Department at the National Electoral Board of Ethiopia (hereinafter ‘NEBE’) on a range of issues including assisting with case management of complaints and appeals and monitoring of court cases, drafting legal electoral documents, and providing technical assistance to support the success of the upcoming Ethiopia general elections.
MAJOR DUTIES & RESPONSIBILITIES:
Under the supervision of the Head of Legal Department or Senior Legal Officer/ consultant:
· Assist with management of cases filed at NEBE where NEBE is the adjudicating body and perform legal duties, such as receiving complaints, notification, collection of evidence, analysis of the issues and preparation of hearings.
· Liaise with regional and constituency offices of NEBE on the submission and defense of election complaints and appeals where NEBE is a respondent.
· Support data-entry of cases in the case tracking system of NEBE as required.
· Monitor court cases relating to elections, from woreda courts to federal courts.
· Provide legal assistance to the legal team, including drafting memoranda, conducting legal research on election legal framework and election dispute resolution.
Assist with design and conduct of trainings for NEBE officials and briefings for stakeholders.
· Conduct research and analysis on assigned topics to support internal and external presentations and reports.
· Undertake ad-hoc tasks assigned by the Legal Department, as required.
· Provide technical assistance and input in the area of legal and regulatory reform.

በዚህም መሰረት የንግድ ምዝገባ እና የንግድ ፈቃድ አሰጣጥን በዘመናዊ ቴክኖሎጂ እንዲደገፍ በማድረግ የንግድ ሥርዓቱ ለመረጃ አያያዝ አመቺ እንዲሆን፣ ሕገወጥ እንቅስቃሴ ለመግታት የሚያስችል፣ ለመንግስት፣ ለህብረተሰብ እና የሚመለከታቸው አካላት ተገቢውን መረጃ እንዲያገኙ የሚያስችልና የንግድ ሥርዓቱ ግልፅነት፣ ተጠያቂነት እና መልካም አስተዳደር የሰፈነበት በማድረግ የአገሪቱን ራዕይ ለማሳካት እንዲቻል፤ አገሪቱ ዘመናዊ የንግድ ምዝገባና ፈቃድ ሕግ እንዲኖራት ለማስቻል የንግድ ምዝገባ እና የንግድ ሥራ ፈቃድ አዋጅ ቁጥር 980/2008 (በአዋጅ ቁጥር 1150/2011 አንደተሻሻለ) እና የዚሁ አዋጅ ማስፈጸሚያ የሚንስትሮች ምክር ቤት ደንብ ቁጥር 392/2009 ወጥቶ በስራ ላይ ውሏል፡፡ በዚህ አዋጅ መሰረት ማንም ሰው የንግድ ምዝገባ ሳያደረግና የጸና የንግድ ስራ ፈቃድ ሣኖረው በንግድ ስራ ላይ መሰማራት የማይችል መሆኑን ጨምሮ ከንግድ ምዝገባ እና የንግድ ሥራ ፈቃድ ጋር በታያየዘ ያሉት መብትና ግዴታዎች እንዲሁም የሚያስከትሉት የወንጅል ሓለፊነትን በተመለከተ ያሉት ዋና ዋና ነጥቦች ለግንዛቤ ያክል በሚከተለው መልክ ቀርበዋል፡፡ከዚህ አንጻር የአዋጁ አንቀጽ 5 በንግድ መዝገብ የመመዝገብ ግዴታን ሲያስቀምጥ፡-
ማንኛውም ሰው በንግድ መዝገብ ላይ ሳይመዘገብ ማንኛውንም ዓይነት የንግድ ሥራ ፈቃድ ማግኘት የማይችል መሆኑን፡፡
ማንኛውም ሰው በንግድ መዝገብ የሚመዘገበው ዋና መስሪያ ቤቱ ባለበት ሥፍራ ላይ መሆኑንና በተለያዩ ክልሎች የተለያዩ የንግድ ሥራዎችን ቢሠራም በንግድ መዝገብ የሚመዘገበው አንድ ጊዜ ብቻ መሆኑን፡፡
በተለያዩ ሥፍራዎች ቅርንጫፍ መሥሪያ ቤት የሚከፍት ማንኛውም ሰው ሥራ ከመጀመሩ በፊት የመጀመሪያ ምዝገባ በተመዘገበበት ቦታ ቅርንጫፍ መሥሪያ ቤቱን ማስመዝገብና ቅርንጫፍ መሥሪያ ቤት በሚገኝበት ሥፍራ ላለው መዝጋቢ መሥሪያ ቤት ወዲያዉኑ ማሳወቅ ያለበት መሆኑን፡፡
በንግድ ሕግ መሠረት ማንኛውም ሰው በንግድ መዝገብ ሲመዘገብ የድርጅት ስሙ ከሌላ ነጋዴ ጥቅም ጋር የማይጋጭ መሆኑን በማረጋገጥ በንግድ መዝገብ ውስጥ መመዝገብ የሚገባው መሆኑን ያስቀምጣል፡፡
ከዘህ በተጨማሪም ንግድ ስራ ምዝገባ ማመልከቻው የንግድ ሥራው ይጀምራል ተብሎ ከሚታሰብበት ቀን አስቀድሞ መቅረብ ያለበት መሆኑን እና መዝጋቢው መሥሪያ ቤት ለምዝገባ የቀረበው የንግድ ማህበር እና የንግድ እንደራሴ በንግድ መዝገብ ከመግባቱ በፊት የግብር ከፋይ መለያ ቁጥር እንዲሰጠው ግብር አስከፋዩን አካል በመጠየቅ ከግብር አስከፋዩ አካል የሚሰጠውን የግብር ከፋይ መለያ ቁጥር የምዝገባ ማመልከቻ ላቀረበው ነጋዴ ወይም የንግድ እንደራሴ በልዩ የምዝገባ መለያ ቁጥርነት በመጠቀም ምዝገባው እንደሚከናወን በአወጁ ተመልክቷል፡፡ በአንጻሩ ማንኛዉም የንግድ ማህበር ምዝገባ ለውጥ ወይም ማሻሻያ በሚመለከተው የሰነድ አረጋጋጭ አካል በተረጋገጠ በ 60 ቀናት ውስጥ ለመዝጋቢው አካል ቀርቦ መመዝገብ ያለበት መሆኑን እና የጽሁፍ ማረጋገጫ ካልተሰጠ በስተቀር የቀረበው የምዝገባ ለውጥ ወይም ማሻሻያ በንግድ መዝገብ እንደገባ የማይቆጠር መሆኑን አዋጁ በግልጽ ያስቀምጣል፡፡ በዚህ መሰረት
ማንኛውም ሰው የፀና የንግድ ሥራ ፈቃድ ሳይኖረው የንግድ ሥራ መሥራት የማይችል መሆኑን፤ ነገር ግን የፀና የንግድ ሥራ ፍቃድ ያወጣ ሰው ለተመሳሳይ የንግድ ሥራ ለሚከፍተው ቅርንጫፍ ተጨማሪ የንግድ ሥራ ፈቃድ እንዲያወጣ የማይገድድ መሆኑን፡፡
የማምረት የንግድ ሥራ ፍቃድ ያለው ነጋዴ ያመረታቸውን ምርቶች ብቻ በሚያመርትበት አድራሻ ወይም በሌላ ባስመዘገበበት አድራሻ በጅምላ ለመሸጥ ተጨማሪ የንግድ ፈቃድ እንዲያወጣ የማይገደድ ቢሆንም፡ ያመረታቸውን ምርቶች በችርቻሮ መነገድ የማይችል መሆኑን፤ ሆኖም በልዩ ሁኔታ በችርቻሮ የሚነግድባቸውን ምርቶች ዓይነት በተመለከተ የሚኒስትሮች ምክር ቤት በሚያወጣው ደንብ ሊወሰን እንደሚችል እንዲሁም፤
ማንኛውም የአስመጪነት የንግድ ፈቃድ ያለው ነጋዴ ያስመጣቸውን ምርቶች ለአስመጪነት የንግድ ፈቃዱን ሲያወጣ ባስመዘገበበት አድራሻ በጅምላ ለመሸጥ ተጨማሪ የንግድ ሥራ ፈቃድ እንዲያወጣ የማይገደድ ቢሆንም ያስመጣቸውን ምርቶች በችርቻሮ መነገድ እንደማይችል በአዋጁ ተመልክቷል፡፡
በሌላ በኩል የንግድ ሥራ ፈቃዱ የተሰጠበት ወይም የታደሰበት የበጀት ዓመት ካበቃ በኋላ ባሉት ስድስት ወራት ጊዜ ውስጥ ያልታደሰ የንግድ ሥራ ፈቃድ የፀና እንደማይሆን ልብ ሊባል ይገባል፡፡ በዚህ መሰረትም እነዚህና ሌሎችን የአዋጁን ድንጋጌዎች መተላለፍ አስተዳደራዊ እና የወንጀል ተጠያቂነትን የሚስከተል ሲሆን የወንጀል ተጠያቂነቱን ለአብነት ብንወስድ፡-
የፀና የንግድ ሥራ ፍቃድ ሳይኖረው በንግድ ሥራ ተሰማርቶ የተገኘ ማንኛውም ሰው ወይም በንግድ ሥራ ፍቃዱ እንዲሰራ ከተፈቀደለት የንግድ ሥራ ውጭ ሲሰራ የተገኘ ማንኛውም ነጋዴ የንግድ ሥራ ሲካሄድባቸው የነበሩ የንግድ ዕቃዎች እና የአገልግሎት መስጫ እና የማምረቻ መሣሪያዎች መወረሳቸው እንደተጠበቁ ሆነው ከብር 150,000 እስከ ብር 300,000 በሚደርስ የገንዘብ መቀጮ እና ከ7 ዓመት እስከ 15 ዓመት በሚደርስ ፅኑ እስራት የሚቀጣ ስለመሆኑ
ሀሰተኛ የንግድ ምዝገባ የምስክር ወረቀት ወይም የንግድ ሥራ ፈቃድ ወይም የእንደራሴ ልዩ የምስክር ወረቀት ያዘጋጀ ወይም ሲጠቀም የተገኘ ማንኛውም ሰው የንግድ ሥራ ሲያካሂድባቸው የነበሩ የንግድ ዕቃዎች፣ የአገልግሎት መስጫ ወይም የማምረቻ መሣሪያዎች መወረሳቸው እንደ ተጠበቀ ሆኖ ከብር 150,000 አስከ 300,000 በሚደርስ የገንዘብ መቀጮ እና ከ7 ዓመት እስከ 15 ዓመት በሚደርስ ፅኑ እስራት ሊቀጣ እንደሚችል፤
የንግድ ሥራ ፍቃዱን እንዲጠቀምበት በሽያጭ፣ በኪራይ፣ በስጦታ ወይም በተመሳሳይ ሁኔታ ለሦስተኛ ወገን አሳልፎ የተከለከለ ሲሆን ይህንን የተላለፈ ማንኛውም ነጋዴ ከብር 50,000 እስከ ብር 100,000 የገንዘብ መቀጮ እና ከ5 ዓመት እስከ 10 ዓመት በሚደርስ ፅኑ እስራት የሚቀጣ ሲሆን አሳልፎ የሰጠው ለውጭ አገር ዜጋ በሆነ ጊዜ ከብር 200,000 እስከ ብር 300,000 በሚደርስ የገንዘብ መቀጮ እና ከ7 ዓመት እስከ 15 ዓመት በሚደርስ ጽኑ እስራት የሚቀጣ ስለመሆኑ በአዋጁ አንቀጽ 49 ላይ ተዘርዝሮ እናገኛለ፡፡
በአጠቃላይ የንግድ ምዝገባ እና የጸና የንግድ ሥራ ፈቃድ ሣይዙ ወደ ንግድ ስራ መሰማራት ከተለያዩ አስተዳደራዊ እርምጃዎች እስከ ከፍ ያለ የእስራት ቅጣት የሚስከትል መሆኑን ተግንዝበን እራሳችንን ከህገወጥ ተግባር በማቀብ የሃገራችንን የንግድ ስርዓት ለማዘመን የበኩላችንን የዜግነት ድረሻ መወጣት አለብን፡፡

በሃገራችን የንግድ ምዝገባ እና የንግድ ሥራ ፈቃድ አገልግሎት አሰጣጥ ሥርዓትን ፍትሀዊ፣ ዘመናዊ፣ ቀልጣፋ እና ተደራሽ በማድረግ የንግዱን ማህበረሰብ እና ህብረተሰቡ ከንግዱ ሥርዓት የሚጠብቀውን አገልግሎት እንዲያገኝ የሕግና የአሠራር ክፍተቶችን በመድፈንና እርካታን በማሳደግ በአገሪቱ ሁለንተናዊ ኢኮኖሚ ውስጥ የበኩሉን ሚና እንዲጫወት ለማድረግ ሰፊ ስራ እየተስራ ይገኛል፡፡
በዚህም መሰረት የንግድ ምዝገባ እና የንግድ ፈቃድ አሰጣጥን በዘመናዊ ቴክኖሎጂ እንዲደገፍ በማድረግ የንግድ ሥርዓቱ ለመረጃ አያያዝ አመቺ እንዲሆን፣ ሕገወጥ እንቅስቃሴ ለመግታት የሚያስችል፣ ለመንግስት፣ ለህብረተሰብ እና የሚመለከታቸው አካላት ተገቢውን መረጃ እንዲያገኙ የሚያስችልና የንግድ ሥርዓቱ ግልፅነት፣ ተጠያቂነት እና መልካም አስተዳደር የሰፈነበት በማድረግ የአገሪቱን ራዕይ ለማሳካት እንዲቻል፤ አገሪቱ ዘመናዊ የንግድ ምዝገባና ፈቃድ ሕግ እንዲኖራት ለማስቻል የንግድ ምዝገባ እና የንግድ ሥራ ፈቃድ አዋጅ ቁጥር 980/2008 (በአዋጅ ቁጥር 1150/2011 አንደተሻሻለ) እና የዚሁ አዋጅ ማስፈጸሚያ የሚንስትሮች ምክር ቤት ደንብ ቁጥር 392/2009 ወጥቶ በስራ ላይ ውሏል፡፡ በዚህ አዋጅ መሰረት ማንም ሰው የንግድ ምዝገባ ሳያደረግና የጸና የንግድ ስራ ፈቃድ ሣኖረው በንግድ ስራ ላይ መሰማራት የማይችል መሆኑን ጨምሮ ከንግድ ምዝገባ እና የንግድ ሥራ ፈቃድ ጋር በታያየዘ ያሉት መብትና ግዴታዎች እንዲሁም የሚያስከትሉት የወንጅል ሓለፊነትን በተመለከተ ያሉት ዋና ዋና ነጥቦች ለግንዛቤ ያክል በሚከተለው መልክ ቀርበዋል፡፡ከዚህ አንጻር የአዋጁ አንቀጽ 5 በንግድ መዝገብ የመመዝገብ ግዴታን ሲያስቀምጥ፡-
ማንኛውም ሰው በንግድ መዝገብ ላይ ሳይመዘገብ ማንኛውንም ዓይነት የንግድ ሥራ ፈቃድ ማግኘት የማይችል መሆኑን፡፡
ማንኛውም ሰው በንግድ መዝገብ የሚመዘገበው ዋና መስሪያ ቤቱ ባለበት ሥፍራ ላይ መሆኑንና በተለያዩ ክልሎች የተለያዩ የንግድ ሥራዎችን ቢሠራም በንግድ መዝገብ የሚመዘገበው አንድ ጊዜ ብቻ መሆኑን፡፡
በተለያዩ ሥፍራዎች ቅርንጫፍ መሥሪያ ቤት የሚከፍት ማንኛውም ሰው ሥራ ከመጀመሩ በፊት የመጀመሪያ ምዝገባ በተመዘገበበት ቦታ ቅርንጫፍ መሥሪያ ቤቱን ማስመዝገብና ቅርንጫፍ መሥሪያ ቤት በሚገኝበት ሥፍራ ላለው መዝጋቢ መሥሪያ ቤት ወዲያዉኑ ማሳወቅ ያለበት መሆኑን፡፡
በንግድ ሕግ መሠረት ማንኛውም ሰው በንግድ መዝገብ ሲመዘገብ የድርጅት ስሙ ከሌላ ነጋዴ ጥቅም ጋር የማይጋጭ መሆኑን በማረጋገጥ በንግድ መዝገብ ውስጥ መመዝገብ የሚገባው መሆኑን ያስቀምጣል፡፡
ከዘህ በተጨማሪም ንግድ ስራ ምዝገባ ማመልከቻው የንግድ ሥራው ይጀምራል ተብሎ ከሚታሰብበት ቀን አስቀድሞ መቅረብ ያለበት መሆኑን እና መዝጋቢው መሥሪያ ቤት ለምዝገባ የቀረበው የንግድ ማህበር እና የንግድ እንደራሴ በንግድ መዝገብ ከመግባቱ በፊት የግብር ከፋይ መለያ ቁጥር እንዲሰጠው ግብር አስከፋዩን አካል በመጠየቅ ከግብር አስከፋዩ አካል የሚሰጠውን የግብር ከፋይ መለያ ቁጥር የምዝገባ ማመልከቻ ላቀረበው ነጋዴ ወይም የንግድ እንደራሴ በልዩ የምዝገባ መለያ ቁጥርነት በመጠቀም ምዝገባው እንደሚከናወን በአወጁ ተመልክቷል፡፡ በአንጻሩ ማንኛዉም የንግድ ማህበር ምዝገባ ለውጥ ወይም ማሻሻያ በሚመለከተው የሰነድ አረጋጋጭ አካል በተረጋገጠ በ 60 ቀናት ውስጥ ለመዝጋቢው አካል ቀርቦ መመዝገብ ያለበት መሆኑን እና የጽሁፍ ማረጋገጫ ካልተሰጠ በስተቀር የቀረበው የምዝገባ ለውጥ ወይም ማሻሻያ በንግድ መዝገብ እንደገባ የማይቆጠር መሆኑን አዋጁ በግልጽ ያስቀምጣል፡፡ በዚህ መሰረት

ማንኛውም የአስመጪነት የንግድ ፈቃድ ያለው ነጋዴ ያስመጣቸውን ምርቶች ለአስመጪነት የንግድ ፈቃዱን ሲያወጣ ባስመዘገበበት አድራሻ በጅምላ ለመሸጥ ተጨማሪ የንግድ ሥራ ፈቃድ እንዲያወጣ የማይገደድ ቢሆንም ያስመጣቸውን ምርቶች በችርቻሮ መነገድ እንደማይችል በአዋጁ ተመልክቷል፡፡
በሌላ በኩል የንግድ ሥራ ፈቃዱ የተሰጠበት ወይም የታደሰበት የበጀት ዓመት ካበቃ በኋላ ባሉት ስድስት ወራት ጊዜ ውስጥ ያልታደሰ የንግድ ሥራ ፈቃድ የፀና እንደማይሆን ልብ ሊባል ይገባል፡፡ በዚህ መሰረትም እነዚህና ሌሎችን የአዋጁን ድንጋጌዎች መተላለፍ አስተዳደራዊ እና የወንጀል ተጠያቂነትን የሚስከተል ሲሆን የወንጀል ተጠያቂነቱን ለአብነት ብንወስድ፡-

መካከል
ጥቅምት 4 ቀን 2002 ዓ.ም የጋራ የስምምነት ውል በማድረግ በአዲስ አበባ አራዳ ክ/ከተማ ቀበሌ ግንፍሌ ውስጥ የሚገኘውን የቤት አይነት እስትዲዮ ኮንደሚኒየም የመኖሪያ ቤት በህንፃ ቁጥር 5 ፤ ሳይት ግንፍሌ 2 ፤ የቤት ቁጥር G-B5-3/01/ የወለል ቁጥር 3 የቤቱ ስፋት 23.75 ካ.ሜ የሆነ ቤት በተከሳሽ በስማቸው የተመዘገበ ቤት ሲሸጡልኝ በጊዜው መንግስት መሸጥ መለወጥ ከልክሎ ስለነበረ በውልና ማስረጃ ለማድረግ ባለመቻላችን ምክንያት በሁለቱም ወገን ሺያጭ ሆኖ ስምምነታችን ነገር ግን በውልና ማስረጃ የብድር ውል በመፈፀም በሌላ በኩል በሽማግሌ የሽያጭ ውል በሰፈር ተስማምተን ጨርሰን ሻጪም ብራቸውን ወስደው ገዢም ቤታቸውን ተረክበው መኖር ከጀመሩ ከ 11 (አስራ አንድ አመት በላይ ያለፈን ሲሆን በዚህ ሁሉ አመታት ወ/ሮ አቻምየለሽ ለአካል ጉዳተኛ ልጇ የተገዛላትን ይህ ቤት ትርጉሙ ብዙ ነበር። ስለዚህም፤ ይህንን ቤት አከራይታ ለእሷ የሚቀንስ ቤት ተከራይታ በምታገኘው ልዩነት ትርፍ ብር ልጇን እያስተማረች ኑሮዋን እየገፋች ያለች አካል ጉዳተኛ የሆነች የአካል ጉዳተኛ እናት ናት ወ/ሮ አቻምየለሽ። በመሆኑም፤ የቤቱን ጉዳይ በማከራዬት እና በማማከር የቅርብ ታማኝ ወዳጅ ሁና የደላላ እየተቀበለች ቤቱን አከራይታላት የ ኪራይ ብሯን ተቀብላ በባንክ ሂሳብ ቁጥሯ በማስገባት የፅዳትና የግንባታ ክፍያ ሁሉ በመክፈል ለብዙ አመታታ ስታግዛት የነበረችው ደላላ ወ/ሮ ገነት አ/ማሪያም ነበረች።
ደላላ ወ/ሮ ገነት አ/ማሪያም ነገር ግን ሻጪ ከ አስራ አንድ አመት በኋላ እንደገና በመምጣት በውልና ማስረጃ ያልተመዘገበ ነው፡፡ ደግሞም መንግስት የሚያውቀው ውላችን የብድር ውል እንጅ የሺያጭ ውል አይደለም በማለት ተጨማሪ 300000 (ሶስት መቶ ሺህ ብር) ስጡኝ ብለው እየጠየቁ ባለበት ሁኔታ ወ/ሮ አቻምየለሽ አበበ በኤጀንሲ ተቀጥረው ባንክ የፍተሻ ስራ እየሰሩ ከእጅ ወደ አፍ ኑሮ የሚኖሩ ሚስኪን ሰው በመሆናቸው በዚህ ጊዜ ይሄን ያህል ብር ከየት አመጣለሁ እስኪ ጊዜ ስጠኝ ሰው ልለምን ብለው ቢጠይቁትም፤ በክፉ ልቦና እና ተንኮል ቃላቸውን በማጠፍ ከደላላ ወ/ሮ ገነት ከምትባል የውስጥ አዋቂ ሰው ጋር በመመሳጠር ወ/ሮ አቻምየለሽ አበበ የሚጥል በሽታ ተጠቂ እና መዳኒት ተጠቃሚ በመሆናቸውን የሚወስዱት መድሓኒት የማገናዘብ እንዳይችሉ የአዕምሮ ችግር ስለፈጠረባቸው እንዲሁም አካል ጉዳተኛ መሆናቸውን በመረዳት ከዚያም አልፎ የቅርብ ዘመድ እና የሚያማክሩት ሰው እንደሌለ በማሰብ በተለያየዩ ምክንያቶችንን በመደርደር አቶ ዳዊት መገርሳ ተባሉት ግለሰብ ከደላላ ወ/ሮ ገነት አ/ማሪያም በጋራ በመመሳጠር በማታለል ሰነዶችን በሙሉ ወስደዋል፡፡

አቶ ዳዊት መገርሳ የጠየቁትን ተጨማሪ 300000 (ሶስት መቶ ሺህ ብር) በሚመለከት መልስ ለመስጠት ቀጠሮ ይዘን ከነበረበት አንድ ቀን በፊት ስልካቸውን አጥፍተው መገናኘት ባለመቻላችን የሚሰሩትን እና እያደረጉት የነበረውን አናውቅም ነበር ሆኖም በቅርብ ጉዳዩን ሲያስፈፅሙለት እና በገዥ ማለትም በሻጭ አቶ ዳዊት መገርሳ እና ወ/ሮ አቻምየለሽ አበበ መሀል ሆነው መረጃን ሲሰጡ የነበሩት ደላላ ወ/ሮ ገነት አ/ማሪያም አድራሻቸውን ወይም ስልካቸውን እንዲሰጡን ደጋግመን ብንጠይቅም ፀበል ገብቷል እያሉ በማዘናጋት አቆይተውናል፡፡
ሆኖም ተከራይ አቶ ኤፍሬም የቤት ኪራይ ክፍያ እንደደረሰ በስልክ በሚነገው ጊዜ ነው በሌላ ሰው ስም የክራይ ውል እንዳድስ እየተጠየኩኝ ነው ኮሚቴዎችን አነጋግሯቸው ብሎ ባሳወቀን መሰረት ሂደን በአካል ከደላላ ወ/ሮ ገነት አ/ማሪያም ስናጣራ ሰልኩን አጥፍቶ ተሰውሮ የነበረው ግለሰብ በአቶ ዳዊት መገርሳ ሺያጭ እንደተፈፀመ ቤቱ በላያችን ላይ ማንንም ሳያሳውቁ በድብቅ መሸጡን በኃላም የሺያጭ ውል ኮፒ ለግንፍሌ ኮንደሚንዬም ኮሚቴ አባል የሆነው አቶ ሄኖክ እንደተቀበለ ከደላላ ወ/ሮ ገነት አ/ማሪያም ሰምተናል፡፡ በዚህም ሳያበቃ የኮንደሚንየሙ ኮሚቴ አቶ ሄኖክ ከሚባል የግንፍሌ ኮንደሚኒየም ኮሚቴ አባል እና ደላላ ወ/ሮ ገነት አ/ማሪያም በጋራ ተመሳጥረው አዲስ ቤቱን ገዙት የተባሉትን ግለሰብ የምወክል ሰው ነኝ ከምትል ግለሰብ ጋር ሶስቱም በአካል ሂደው የቤት ኪራይ ውል በዲስ መልክ እንዳድስ አስገደዱኝ ይላል ተከራይ አርቲስት ኤፍሬም።
ይህ ሁሉ ሲሆን ለዚህ ጉዳይ መነሻ የሆነው ዋናው ምክንያት ግንፍሌ ውስጥ የሚገኘውን የቤት አይነት እስትዲዮ ኮንደሚኒየም የመኖሪያ ቤት ጥቅምት 4 ቀን 2002 ዓ.ም የፈፀምነው ውል የብድር ውል እንጅ ሺያጭ ተብሎ በውልና ማስረጃ ያልተመዘገበ ነው በማለት ነው፡፡

ጥቅምት 4 ቀን 2002 ዓ.ም የጋራ የስምምነት ውል በማድረግ በአዲስ አበባ አራዳ ክ/ከተማ ቀበሌ ግንፍሌ ውስጥ የሚገኘውን የቤት አይነት እስትዲዮ ኮንደሚኒየም የመኖሪያ ቤት በህንፃ ቁጥር 5 ፤ ሳይት ግንፍሌ 2 ፤ የቤት ቁጥር G-B5-3/01/ የወለል ቁጥር 3 የቤቱ ስፋት 23.75 ካ.ሜ የሆነ ቤት በተከሳሽ በስማቸው የተመዘገበ ቤት ሲሸጡልኝ በጊዜው መንግስት መሸጥ መለወጥ ከልክሎ ስለነበረ በውልና ማስረጃ ለማድረግ ባለመቻላችን ምክንያት በሁለቱም ወገን ሺያጭ ሆኖ ስምምነታችን ነገር ግን በውልና ማስረጃ የብድር ውል በመፈፀም በሌላ በኩል በሽማግሌ የሽያጭ ውል በሰፈር ተስማምተን ጨርሰን ሻጪም ብራቸውን ወስደው ገዢም ቤታቸውን ተረክበው መኖር ከጀመሩ ከ 11 (አስራ አንድ አመት በላይ ያለፈን ሲሆን በዚህ ሁሉ አመታት ወ/ሮ አቻምየለሽ ለአካል ጉዳተኛ ልጇ የተገዛላትን ይህ ቤት ትርጉሙ ብዙ ነበር። ስለዚህም፤ ይህንን ቤት አከራይታ ለእሷ የሚቀንስ ቤት ተከራይታ በምታገኘው ልዩነት ትርፍ ብር ልጇን እያስተማረች ኑሮዋን እየገፋች ያለች አካል ጉዳተኛ የሆነች የአካል ጉዳተኛ እናት ናት ወ/ሮ አቻምየለሽ። በመሆኑም፤ የቤቱን ጉዳይ በማከራዬት እና በማማከር የቅርብ ታማኝ ወዳጅ ሁና የደላላ እየተቀበለች ቤቱን አከራይታላት የ ኪራይ ብሯን ተቀብላ በባንክ ሂሳብ ቁጥሯ በማስገባት የፅዳትና የግንባታ ክፍያ ሁሉ በመክፈል ለብዙ አመታታ ስታግዛት የነበረችው ደላላ ወ/ሮ ገነት አ/ማሪያም ነበረች።
ደላላ ወ/ሮ ገነት አ/ማሪያም ነገር ግን ሻጪ ከ አስራ አንድ አመት በኋላ እንደገና በመምጣት በውልና ማስረጃ ያልተመዘገበ ነው፡፡ ደግሞም መንግስት የሚያውቀው ውላችን የብድር ውል እንጅ የሺያጭ ውል አይደለም በማለት ተጨማሪ 300000 (ሶስት መቶ ሺህ ብር) ስጡኝ ብለው እየጠየቁ ባለበት ሁኔታ ወ/ሮ አቻምየለሽ አበበ በኤጀንሲ ተቀጥረው ባንክ የፍተሻ ስራ እየሰሩ ከእጅ ወደ አፍ ኑሮ የሚኖሩ ሚስኪን ሰው በመሆናቸው በዚህ ጊዜ ይሄን ያህል ብር ከየት አመጣለሁ እስኪ ጊዜ ስጠኝ ሰው ልለምን ብለው ቢጠይቁትም፤ በክፉ ልቦና እና ተንኮል ቃላቸውን በማጠፍ ከደላላ ወ/ሮ ገነት ከምትባል የውስጥ አዋቂ ሰው ጋር በመመሳጠር ወ/ሮ አቻምየለሽ አበበ የሚጥል በሽታ ተጠቂ እና መዳኒት ተጠቃሚ በመሆናቸውን የሚወስዱት መድሓኒት የማገናዘብ እንዳይችሉ የአዕምሮ ችግር ስለፈጠረባቸው እንዲሁም አካል ጉዳተኛ መሆናቸውን በመረዳት ከዚያም አልፎ የቅርብ ዘመድ እና የሚያማክሩት ሰው እንደሌለ በማሰብ በተለያየዩ ምክንያቶችንን በመደርደር አቶ ዳዊት መገርሳ ተባሉት ግለሰብ ከደላላ ወ/ሮ ገነት አ/ማሪያም በጋራ በመመሳጠር በማታለል ሰነዶችን በሙሉ ወስደዋል፡፡
