The Lok Sabha on 7 August 2023 passed the Digital Personal Data Protection Bill, 2023, a first-ever legislation dedicated for digital privacy amid concerns of MPs regarding the removal of the data localisation mandate and increased government control.

The Bill was passed with an amendment to a minor drafting error. Once the Bill comes into effect, all digital platforms will be required to obtain unconditional, free, specific, and informed consent from users for processing their data.
They will also need to issue a notice explaining the purpose of data processing and the rights of the users.
The government will appoint a data protection board, an independent body that will examine personal data breaches and impose penalties.
The latest version of the Bill does not mandate local storage of personal data, providing a major relief to big tech firms like Google, Meta, and Amazon.
The government may, however, notify a list of countries in future, where data cannot be transferred.
The Bill prescribes penalties of up to Rs 250 crore for each instance of a data breach arising from a lack of reasonable safeguards on platforms.
The government may block the operations of entities not complying with the law even after two instances of penalties. The draft Bill of the final version was released for public consultation in November 2022.
Models for data protection laws
The EU model:
The GDPR focuses on a comprehensive data protection law for the processing of personal data.
It has been criticised for being excessively stringent, and imposing many obligations on organisations processing data, but is the template for most of the legislation drafted around the world.
In the EU, the right to privacy is enshrined as a fundamental right that seeks to protect an individual’s dignity and her right over the data that she generates.
The US model:
Privacy protection is largely defined as a “liberty protection” — focused on the protection of the individual’s personal space from the government, and, therefore, is viewed as being somewhat narrow in focus by virtue of enabling the collection of personal information as long as the individual is informed of such collection and use. The US template has been viewed as inadequate in key respects of regulation.
Unlike the EU’s GDPR, there is no comprehensive set of privacy rights or principles that collectively address the use, collection and disclosure of data in the US. Instead, there is limited sector-specific regulation. The approach towards data protection in the US is different for the public and private sectors.
The China model:
New Chinese laws issued over the last 15 months on data privacy and security includes the Personal Information Protection Law (PIPL), which came into effect in November 2021. It gives Chinese data principal’s new rights as it seeks to prevent the misuse of personal data.
The Data Security Law (DSL), which came into force in September 2021, requires business data to be categorised by different levels of importance and puts new restrictions on cross-border transfers.
These regulations will have a significant impact on how companies collect, store, use and transfer data, but are essentially focused on giving the government overreaching powers to both collect data and regulate private companies that collect and process information.

Cabinet on 16 August 2023 approved extension of Digital India project with an outlay of Rs 14,903 crore. The minister said that the extended Digital India project will add on to the work done under the previous version of the scheme.

Under the project 5.25 lakh IT professionals will be reskilled and upskilled and 2.65 lakh persons will be trained in IT.
Under the extended Digital India project, nine more super computers will be added under the National Supercomputing Mission (NCM). The minister said that 18 super computers have been deployed under NCM.
The Digital India programme was launched in July 2015 to enable the digital delivery of services to citizens.
The programme is now extended to a period of five years starting from 2021-2022 to 2025-2026.
The government will support over 1,200 startups from Tier-II, and –III cities during the extended period.

As a pilot, Kisan Credit Cards will be offered in Madhya Pradesh and will be available to customers for up to Rs 1.6 lakh to begin with.
MSME loans will be available across the country and loans up to Rs 10 lakh will be offered to customers.

With banks enabling the interoperability of Unified Payments Interface’s (UPI) Quick Response (QR) code with their central bank digital currency (CBDC) or e₹ application, users of retail digital rupee will be able to make transactions by scanning any UPI QR at a merchant outlet. Merchants can also accept digital rupee payments through their existing UPI QR codes. This integration of UPI and CBDC is part of the Reserve Bank of India’s (RBI) ongoing pilot project on pushing the retail digital rupee (e₹-R).
What is interoperability?
Interoperability is the technical compatibility that enables a payment system to be used in conjunction with other payment systems, according to the RBI.
Interoperability allows system providers and participants in different systems to undertake, clear and settle payment transactions across systems without participating in multiple systems.
Interoperability between payment systems contributes to achieving adoption, co-existence, innovation, and efficiency for end users.
What is UPI QR code-CBDC interoperability?
Interoperability of UPI with the digital rupee means all UPI QR codes are compatible with CBDC apps. Initially, when the pilot for the retail digital rupee was launched, the e₹-R users had to scan a specific QR code to undertake transactions.
However, with the interoperability of the two, payments can be made using a single QR code.
The digital rupee issued by the RBI, or the CBDC, is a tokenised digital version of the rupee.
The e₹ is held in a digital wallet, which is linked to a customer’s existing savings bank account. UPI is directly linked to a customer’s account.
How will it benefit customers and merchants?
The interoperability of UPI and CBDC will ensure seamless transactions between a customer and merchant without having the need to switch between multiple digital platforms.
It will allow a digital rupee user to make payments for their daily needs, such as groceries and medicines, by scanning any UPI QR codes at any merchant outlet.
Even merchants are not required to keep a separate QR code to accept the digital rupee payments. They can accept CBDC payments on their existing QR code.
What is a QR code?
A Quick Response (QR) code consists of black squares arranged in a square grid on a white background, which can be read by an imaging device such as a camera.
It contains information about the item to which it is attached, according to the National Payments Corporation of India (NPCI). QR code is an alternate contactless channel of payments. It allows merchants or businesses to accept payments from their customers directly into their bank accounts.

What is UPI QR code-CBDC interoperability?
Interoperability of UPI with the digital rupee means all UPI QR codes are compatible with CBDC apps. Initially, when the pilot for the retail digital rupee was launched, the e₹-R users had to scan a specific QR code to undertake transactions.
However, with the interoperability of the two, payments can be made using a single QR code.
The digital rupee issued by the RBI, or the CBDC, is a tokenised digital version of the rupee.
The e₹ is held in a digital wallet, which is linked to a customer’s existing savings bank account. UPI is directly linked to a customer’s account.
How will it benefit customers and merchants?
The interoperability of UPI and CBDC will ensure seamless transactions between a customer and merchant without having the need to switch between multiple digital platforms.
It will allow a digital rupee user to make payments for their daily needs, such as groceries and medicines, by scanning any UPI QR codes at any merchant outlet.
Even merchants are not required to keep a separate QR code to accept the digital rupee payments. They can accept CBDC payments on their existing QR code.
What is a QR code?
A Quick Response (QR) code consists of black squares arranged in a square grid on a white background, which can be read by an imaging device such as a camera.
It contains information about the item to which it is attached, according to the National Payments Corporation of India (NPCI). QR code is an alternate contactless channel of payments. It allows merchants or businesses to accept payments from their customers directly into their bank accounts.
