የፌደራል ፍርድ ቤቶች በከፍተኛ የትምሕርት ተቋማት ከሚገኙ የሕግ ትምሕርት ቤቶች ጋር በመቀናጀት የሕግ ተማሪዎች በፍርድ ቤቶች የሜንተርሽፕ እና የኢንተርንሽፕ ፕሮግራም እንዲሳተፉ በማድረግ የሚያከናውኑት ተግባር ትውልድን የማነጽ ሥራ መሆኑን የፌደራል የመጀመሪያ ደረጃ ፍርድ ቤት ም/ፕሬዚደንት እና የፌደራል ፍርድ ቤቶች ቃል አቀባይ ክቡር አቶ ተስፋዬ ንዋይ ገለጹ፡፡

የፌደራል ፍርድ ቤቶች ከሚሰጡት የዳኝነት አገልግሎት በተጨማሪ የልዩ ልዩ የሕብረተሰብ ክፍሎችን ንቃተ-ሕግ ለማሳደግ የሚረዳ መርሐ-ግብር ቀርጸው ተግባራዊ በማድረግ ላይ የሚገኙ ሲሆን የዚሁ መርሐ-ግብር አካል የሆነና «የተማሪዎች ቀን» በሚል ስያሜ የተዘጋጀ ፕሮግራም መጋቢት 10 ቀን 2014 ዓ.ም በሒልተን ሆቴል ተካሂዷል፡፡

በፕሮግራሙ ማጠናቀቂያ ላይ ክቡር ም/ፕሬዚደንቱ ባደረጉት ንግግር በቀጣይ የፌደራል ፍ/ቤት ዳኞች ሊሆኑ የሚችሉት የዛሬ የሕግ ተማሪዎች በተጨባጭ በፍርድ ቤት ውስጥ ያሉ አሠራሮችን እና ሥነሥርዓቶችን እንዲረዱ እንዲሁም ዳኞች እንዴት ጉዳዮችን እና ባለጉዳዮችን እንደሚያስተናግዱ ግንዛቤ እንዲጨብጡ የሚያስችል ፕሮግራም መሆኑን ጠቁመዋል፡፡

መርሐ-ግብሩ የሕግ ተማሪዎች ትምሕርታቸውን ሲያጠናቅቁ ዳኛ ሆነው ወደፍ/ቤት ከመምጣታቸው በፊት ፍርድ ቤት ውስጥ ያለው አሠራር ምን እንደሚመስል ቀድመው ተገንዝበው ወደሙያው እንዲገቡ የሚያስችል በመሆኑ ጠቀሜታው የጎላ መሆኑንም አስረድተዋል፡፡

በፌደራል ፍርድ ቤቶች ለሕግ ተማሪዎች የሜንተርሽፕ እና የኢንተርንሽፕ ፕሮግራም እንዲጀመር በማድረግ የነገ ዳኞችና የሕግ ባለሙያዎች የሚሆኑት የዛሬ የሕግ ተማሪዎች ከፌደራል ፍርድ ቤቶች ጋር በመቀራረብ በፍርድ ቤቶች ውስጥ የሚከናወኑ ተግባራትን እንዲያውቁ ያስቻለውን መርሐ-ግብር የፌደራል ጠቅላይ ፍ/ቤት ፕሬዚደንት ክብርት ወ/ሮ መዓዛ አሸናፊ በማስጀመራቸው ምስጋናቸውን አቅርበዋል፡፡

የፌደራል ፍርድ ቤቶች ከፍተኛ አመራሮች፣ ዳኞች፣ ጥሪ የተደረገላቸው ግለሰቦችና የሕግ ተማሪዎች በተሳተፉበት በዚህ ዝግጅት ላይ ፍርድ ቤቱ ተግባራዊ ሲያደርግ በቆየው የሜንተርሽፕ እና የኢንተርንሽፕ ፕሮግራም ላይ የተሳተፉ ዳኞችና የሕግ ተማሪዎች ተሞክሯቸውን የሚያሳይ አጭር ፊልም ለተሳታፊዎች ቀርቧል፡፡

የአዲስ አበባ ዩኒቨርሲቴ የ5ኛ ዓመት አራት የሕግ ተማሪዎች የተሳተፉበትና «ከባድ ወንጀል ፈጻሚዎችን በዕድሜ ልክ እስራት መቅጣት ተገቢ ነው ወይስ አይደለም» በሚል ርዕስ ሙግት በምስለ ችሎት (Moot Court) የተካሔደ ሲሆን ሙግቱን የፌደራል ጠቅላይ ፍርድ ቤት ሁለት ዳኞችና የአዲስ አበባ ዩኒቨርሲቲ የሕግ ት/ቤት መምሕር በመዳኘት አሸናፊዎቹ እንዲለዩ አድርገዋል፡፡ ለአሸናፊዎቹም በፌደራል ጠቅላይ ፍርድ ቤት ስጦታ ተበርክቶላቸዋል፡፡

ከመድረኩ መሪ ሐሳብ ጋር ተዛማጅነት ያላቸውና በተማሪዎች የተዘጋጁ ፎቶ ግራፎች ለዕይታ የቀረቡ ሲሆን «ፍትሕ፣ ፍርድ ቤት እና እኔ» በሚል ርዕስ በሥነጽሑፍ ውድድር አሸናፊ የሆነ ጽሑፍም ለተሳታፊዎቹ ቀርቧል፡፡

በፕሮግራሙ ማጠቃለያ ላይ ፍርድ ቤቱ ተግባራዊ ባደረገው የሜንተርሽፕ እና የኢንተርንሽፕ ፕሮግራም ላይ ለተሳተፉ ዳኞችና የሕግ ተማሪዎች የዕውቅና መስጫ ሥነሥርዓት ተካሒዷል፡፡

Major Responsibilities

·Assists the Branch staff in handling all issues related to collateral & the safe custody of all legal documents on real estate mortgage & chattel mortgage;

· Assists in registering & discharging mortgaged items;

· Ensures the safe custody of all legal documents on real esate mortgage & chattel mortgage;

· Draws up draft contracts, agreements, forms, letters of guarantee and other transactional documents, etc. that suit a specified purpose;

· Examines judgments & court rulings; analyzes their impact on company business & advises supervisor on approaches to be followed;

·Gathering facts and establishing evidence, conducting investigations, examination analyses of cases and preparation of contracts and claims;

· Ensures the proper & timely delivery of notices to delinquent clients.

· Investigates & takes proper legal actions to rectify theft, forgeries & misappropriation of funds & property;

·  Complies & analysis information & statistics that would assist in carrying out court activities & provides legal advice & assistance to the branches in legal matters of limited complexity and gravity & in translation work of legal documents.

·  Looks into and analyzes law sources such as statutes, recorded judicial decisions, legal articles and codes to prepare legal documents such as briefs, pleadings, appeals contracts for review, etc.

· Prepares, cases, pleadings, suits, statements of claims, petitions, defenses, affidavits in the name and on behalf of the institution;

· Represents the branches before all levels of courts of law including police stations & public authorities;

·         Submits a written report to the branch & HO legal & Recovery Manager on the status of cases filed at court with collections made through court action.

Job Requirements:·

Diploma in law & minimum 2-years relevant experience

·         Local language knowledge, communication skill & computer skill is advantageous.

አከራይና ተከራይ በቤት ኪራይ ውል በስምምነት ከሚወስኗቸው ጉዳዮች መካከል የኪራዩ የዋጋ ልክ እና ኪራዩ የሚከፈልበት ጊዜ ይጠቀሳሉ፡፡ አከራይና ተከራይ በኪራይ ውሉ የኪራዩን የዋጋ መጠን እና ኪራዩ የሚከፈልበትን ጊዜ ካልወሰኑ፤ በፍትሐብሔር ሕጋችን የተቀመጡ ድንጋጌዎች ተፈጻሚ ይሆናሉ፡፡ የፍትሐብሔር ሕጋችን አንቀጽ 2950(2) አከራይና ተከራይ በውላቸው ውስጥ የኪራዩን የዋጋ መጠን ካላስቀመጡ ወይም በሚያጠራጠር ጊዜ የማዘጋጃ ቤት ባለሥልጣናት በወሰኑት ታሪፍ መሠረት ወይም የተወሰነ ታሪፍ የሌለ እንደሆነ የቦታዎቹን ልማድ በመከተል የኪራዩ የዋጋ መጠን እንደሚወሰን ይደነግጋል፡፡ በተመሳሳይ፣ አከራይና ተከራይ ኪራዩ የሚከፈልበትን ጊዜ በውላቸው ካልተወሰኑ ወይም ካልተስማሙ ተፈጻሚ የሚሆነው ደንብ በፍትሐብሔር ሕጋችን አንቀጽ 2951 ሠፍሯል፡፡ በዚሁ መሠረትም የቤት ኪራይ ውሉ ለአንድ ዓመት ወይም ለተወሰኑ ብዙ ዓመታት ተደርጎ እንደሆነ ኪራዩ በየሦስት ወር መጨረሻ የሚከፈል ይሆናል፡፡ ሆኖም የቤት ኪራይ ውሉ በጣም አጭር ለሆነ ጊዜ ወይም ላልተወሰነ ጊዜ ተደርጎ እንደሆነ በየወሩ መጨረሻ የሚከፈል ይሆናል፡፡

የተከራዩትን ቤት ስለማደስ፡-
በቤት ኪራይ ውል ሊወሰን ወይም ስምምነት ሊደረግበት የሚችለው ሌላኛው ጉዳይ የቤቱ እድሳት ነው፡፡ በፍትሐብሔር ሕጉ አንቀጽ 1954 መሠረት ማደስ የቤቱን መዝጊያዎችን ወይም መስኮቶችን፣ የቤቱን ወለሎችን ወይም ንጣፎችን፣ የውሃ መስመሮችንና የፍሳሽ ማስወገጃዎችን ማደስ እና ቤቱን የማፅዳት እና በደንብ የመያዝ ተግባሮችን ያጠቃልላል፡፡ ተከራይ ለማደስ የተዋዋለውን የተከራየውን ቤት በራሱ ኪሳራ (ወጭ) ለማደስ እንደሚገደድ በፍትሐብሔር ሕጋችን አንቀፅ 1953 ተደንግጓል፡፡ ሆኖም ግን ቤቱ በማርጀት ወይም ካቅም በላይ በሆነ ነገር የተበላሸ ሲሆን ተከራዩ ቤቱን የማደስ ስራ መፈፀም አይጠበቅበትም፡፡ ይሁን እንጂ በቤት ኪራይ ውሉ ውስጥ በማርጀት ወይም ካቅም በላይ በሆነ ነገር የተበላሹትንም ጭምር አድሳለው በማለት ተከራዩ የተስማማ ከሆነ እንዲያድስ ይገደዳል፡፡

የተከራዩትን ስለ ማከራየት (የኪራይ ኪራይ)፡-
ተከራይ የተከራየውን ቤት መልሶ ለማከራየት ይችላል፡፡ ይሁን እንጂ ተከራዩ የተከራየውን ቤት ሊያከራይ የሚችለው አከራዩ ለዚህ የኪራይ ኪራይ ተቃውሞ ከሌለው ብቻ ነው፡፡

የቤት ኪራይ ክፍያን በጊዜው አለመክፈል፡-
ተከራይ የቤት ኪራይ ክፍያውን በጊዜው ያልከፈለ እንደሆነ የሚያስከትለው ውጤት በፍትሐብሔር ሕጋችን አንቀፅ 2952 ሰፍሯል፡፡ የቤት ኪራይ ውሉ ለአንድ ዓመት ወይም ከአንድ ዓመት ለበለጠ ጊዜ ተደርጎ እንደሆነ አከራዩ የሠላሳ ቀን ማስጠንቀቅያ በመስጠት፤ የቤት ኪራይ ውሉ ለአጭር ጊዜ ተደርጎ እንደሆነ ደግሞ አከራዩ የአስራ አምስት ቀን ማስጠንቀቅያ በመስጠት፣ በዚህ ጊዜ ውስጥ ተከራዩ ኪራዩን ያልከፈለ እንደሆነ አከራዩ ውሉን የሚያቆርጥ መሆኑን ለተከራዩ ያሳውቃል፡፡ በዚህ በተሰጠው የማስጠንቀቂያ ጊዜ ውስጥ ተከራዩ ያልከፈለ እንደ ሆነ አከራይ ውሉን ለማቋረጥ ይችላል፡፡

የቤት ኪራይ ውል የሚፈርስባቸው ምክንያቶች፡-
በአከራይና ተከራይ መካከል የተደረገ የቤት ኪራይ ውል በልዩ ልዩ ምክንያቶች ሊፈርስ ወይም ሊቋረጥ ይችላል፡፡ የቤት ኪራይ ውሉ ለተወሰነ ጊዜ ተደርጎ የውሉ ጊዜ ሲያበቃ፤ ተዋዋይ ወገኖች በስምምነት ውላቸውን ለማቋረጥ ሲስማሙ፤ ተከራይ ኪራዩን በጊዜው ባለመክፈሉ አከራዩ የማስጠንቀቂያ ጊዜ ሰጥቶት በዚህ ጊዜ ውስጥም ያልከፈለ እንደሆነ፤ አከራይ ቤቱን ፈልጎት ለተከራይ ማስጠንቀቂያ ጊዜ በመስጠት ወይም ተከራዩ ቤቱን መልቀቅ ፈልጎ ለአከራዩ ማስጠንቀቂያ ጊዜ በመስጠት የቤት ኪራይ ውል ሊቋረጥ ይችላል፡

ተገልጋዮች የማይንቀሳቀሱ ንብረቶችን የሽያጭ ወይም የስጦታ ውል (የመኖሪያ ቤት፣ የሊዝ መብት፣) አገልግሎቶችን ለማግኘት ወደ ተቋማችን ሲመጡ የሚከተሉትን ቅድመሁኔታዎች ማሟላት ይጠበቅባቸዋል፡፡
• የባለቤትነት ካርታ (ጀርባ ማህተም ያረፈበት) ካርታው ዲጂታል ከሆነ የጀርባ ማህተም አያስፈልግም)፡፡
• የሻጭ ወይም የስጦታ አድራጊው ስም የተመዘገበ የባለቤትነት ማረጋገጫ ማስረጃ (ለምሳሌ ካርታ..)፤
• የሻጭ እና የገዥ በዘመኑ የታደሰ መታወቂያ፤

• ንብረቱ የንግድ ማህበር ከሆነ የማህበሩ መመስረቻና መተዳደሪያ ደንብ፣ ዋና ምዝገባ፣ እንደ አስፈላጊነቱ ቃለ-ጉባዔ፤
• የሻጭ ወይም የስጦታ አድራጊው፣ የስጦታ ተቀባዩ እና የሁለት ምስክሮች ጊዜው ያላለፈበት ወይም በዘመኑ የታደሰ መታወቂያ፤
#የኮንዶሚኒየም ቤት ሲሆን፤ የማይንቀሳቀሱ ንብረቶችን የሽያጭ ወይም የስጦታ ዝርዝር እንዳለ ሆኖ በተጨማሪ፡-
• የኮንዶሚኒየሙ ባለቤት ቤቱን ከተረከበው አምስት አመት ስለመሙላቱ ከሚመለከተው አካል የተሰጠ ማረጋገጫ ደብዳቤ
• የተዋዋዬች እና የሁለት ምስክሮች በዘመኑ የታደሰ መታወቂያ
በማህበር የተሰራ ቤት ሲሆን፤ የማይንቀሳቀሱ ንብረቶችን የሽያጭ ወይም የስጦታ ዝርዝር እንዳለ ሆኖ በተጨማሪ፡-
• የባለቤትነት ካርታ ጀርባው ስለትክክለኛነቱ በማህተም የተረጋገጠ፤ ከክፍለ ከተማ ማህበራት ማደራጃ ዕዳ ዕገዳ እንደሌለበት የማረጋገጫ ደብዳቤ፤
• የሻጭ ወይም የስጦታ አድራጊው የጋብቻ ማስረጃ እና የትዳር
