በአዲሱ የጥብቅና ፈቃድ አሰጣጥ እና አስተዳደር አዋጅ ቁጥር 1249/2013 የዩኒቨርሲቲ መምህራን የጥብቅና ፍቃድ አግኝተዉ በጥብቅናና የህግ ማማከር አገልግሎት መሳተፍ የሚችሉ ስለመሆኑ በተደነገገዉ መሰረት የጥብቅና ፍቃድ ማግኘት የሚያስችለዉን ቅድመ ሁኔታ ማሟላት የምትችሉ የዩኒቨርሲቲ መምህራን ከነገ ማለትም ከህዳር 22 ቀን 2014 ዓ.ም ጀምሮ ባምቢስ አካባቢ በሚገኘዉ በፍትህ ሚኒስቴር ዋና መስሪያ ቤት ሁለተኛ ፎቅ የጥብቅና ፍቃድ አስተዳደር እና ነፃ የሕግ ድጋፍ አገልግሎት ዳይሬክቶሬት ተገኝታችሁ እንድትመዘገቡ ጥሪ እናቀርባለን፡፡

Duties and responsibilities

o Attend all external legal council meetings for coordination of all required actions

o Manage projects related to corporate formation, dissolution, and amendments to articles of incorporation by board resolution
• Legal documentation management and archiving
o Indexing and managing digitalization process
• Create efficiently accessible archives for use in financing applications and auditor inquiries
• External stakeholder, shareholder, and grantor relationship management
o Track and organize communication and follow-up to shareholders, lenders, grantors, regulatory agencies, and other stakeholders
o Curate grantor reporting documentation

🚨#የውክልና_አሠራር_በኢትዮጵያ ⁉️ ⤵️⤵️
የኢትዮጵያ የፍትህብሄር ሕግ ቁጥር 2199 ውክልናን እንደተረጐመው “ውክልና ማለት ተወካይ የተባለ አንድ ሰው ወካይ ለተባለው ሰው እንደራሴ ሆኖ አንድ ወይም ብዙ ህጋዊ ሥራዎች በወካዩ ሥም ለማከናወን ግዴታ የሚገባበት ውል ማለት ነው” ይላል፡፡
ከትርጉሙ ለመረዳት እንደምንችለው ውክልና የሚደረገው በወካይና በተወካይ መካከል ሲሆን በውክልናው የሚከናወኑት ስራዎች ህጋዊ መሆን አንዳለባቸው ነው፡፡ ይህ ማለት ደግሞ ህጋዊ ባልሆኑ ነገሮች ላይ የሚደረግ ውክልና ተቀባይነት የለውም ማለት ነው፡፡
በሰፊው ስንመለከት ሁለት አይነት ውክልናዎችን እናገኛለን፡፡ እነሱም በፍተሃብሄር ሕግ ቁጥር 2189 ላይ የተቀመጠው ፍፁም የሆነ እንደራሴነት /disclosed or complete agency/ እና በዚሁ ሕግ ቁጥር 2197 ላይ የተቀመጠው እንደራሴው በራሱ ስም ተግባሮችን የሚፈፅምባቸው የውክልና አይነት/undisclosed agency/ ናቸው::
1. #ውክልና ለምን ያስፈልጋል? ⁉️
አንድ ሰው አንዳንድ ተግባሮችን በራሱ ከማድረግ ይልቅ ሌላን ሰው በመወከል ተግባሮቹ እንዲከናወኑለት ይፈልጋል፡፡ ለዚህም ምክንያቱ የጊዜ ጥበት፣ የቦታ ርቀት ወይም የሁኔታዎች አለመመቻቸት፣ የእውቀት ወይም የክህሎት አለመኖርና የችሎታ ማነስ ዋናዋናዎቹ ሲሆኑ ሌሎችም በምክንያትነት ሊጠቀሱ ይችላሉ፡፡
2. #የውክልና ምንጮች ምንድን ናቸው? ⁉️
በኢትዮጵያ ፍትሃብሄር ሕግ አንቀፅ ቁ. 2179 ውክልና ወይም እንደራሴነት አንድም ከሕግ በሌላ መልኩ ደግሞ ከውል ሊመነጭ እንደሚችል ተመልክቷል፡፡ ከሕግ የሚመነጨው ውክልና ከላይ እንደተገለፀው የውክልና ትርጉም አይነት ወካይና ተወካይ በመስማማት ስምምነት ላይ የሚደርሱበት የውክልና አይነት ሳይሆን ተወካይ የወካይን ተግባሮች ወካይ ባልፈቀደበት ሁኔታ ሊተገብረው የሚያስችለው አይነት ውክልና ነው፡፡ ይህም የውክልና ተግባር በህጉ ከተፈቀዱት የውክልና ሁኔታዎች ውጭ ሊመሠረት አይችልም፡፡ ለዚህ አይነቱ የውክልና አይነት እንደምሣሌነት የሚጠቀሱት ፤ ለአካለ መጠን ያልደረሰን ልጅ ንብረት ለማስተዳደር ሕግ የፈቀደላቸው ጠባቂዎች ውክልና አይነት እና በፍትሃብሄር ህጉ አንቀፅ ቁ. 2257 ላይ በተቀመጠው መልኩ ተግባሮችን የሚተገበሩ ሰዎች ውክልና አይነት ናቸው፡፡
ከውል የሚመነጨው ውክልና አይነት ደግሞ በፅሁፋ መጀመሪያ ውክልናን ለመተርጐም በተመለከተው መልኩ የተቀመጠው ወካይና ተወካይ የውክልና ስምምነት ውል የሚገቡበት አይነት ነው፡፡ በዚህም ፅሁፍ ውስጥ በሰፊው የሚዳሰሰው ይህ ከውል የሚመነጨው የውክልና አይነት ነው፡፡ ስለሆነም ከዚህ በመቀጠል የዚህን የውክልና አይነት አመሠራረትና የተለዩ ክፍሎቹን በፍትሃብሄር ሕግ ከቁጥር 2200-2207 በተቀመጠው መሠረት ለማየት አንሞክራለን፡፡
3 #ውክልና እንዴት ይቋቋማል? ⁉️
ውክልና በግልፅ (ማለትም ወካይ የውክልና ስልጣኑን ለተወካይ እንደሰጠው በግልፅ በማሳወቅ) ወይም በዝምታ ሊሰጥ ይችላል፡፡ ተወካዩም ሊፈፅመው የሚገባው የሥራ ተግባር ስለአፈፃፀሙ በአንደንድ ህጋዊ ፎርም ውስጥ እንዲገባ የሚያስፈልገው ሲሆን ውክልናው ለተወካዩ ሊሰጠው የሚገባው ይኸው ሕግ በሚያዘው ፎርም መሠረት ነው (ፍ/ብ/ህ/ቁ.2200)፡፡ ማለትም ለምሣሌ ተወካዩ ከተወከለ በኋላ ሊያከናውናቸው የሚችሉት ጉዳዬች ወይም የሚዋዋላቸው ውሎች በፅሁፍ መሆን ግድ የሚላቸው አይነት ከሆኑ ከወዲሁ የሚደረገው የውክልና ውልም በፅሁፍ መሆን አለበት ማለት ነው፡፡
በሌላ መልኩ ውክልናውን የሚቀበለው ተወካይ መቀበሉን በግልፅ ወይም በዝምታ ሊፈጽም ይችላል፡፡ ውክልናውን መቀበል የማይፈልግ ከሆነ ደግሞ በግልፅ እንደማይቀበል በመግለፅ ከኃላፊነት እራሱን ማግለል ይችላል፡፡ ስለሆነም ተወካይ ውክልናውን የማይቀበል መሆኑን ከወዲሁ በግልፅ ካላስታወቀ በስተቀር የተወከለበት ነገር ከሚያካሂደው ሥራ ጋር ግንኙነት ያለው ጉዳይ መሆኑ በግለፅ የታወቀ ከሆነ፣ ወይም ከሙያ ሥራው አመራር ጋር የሚመሣሠል ጉዳይ ከሆነ፣ ወይም ይህንን የመሠለውን ጉዳይ ለመሥራት ፍቃደኛ ለመሆኑ በአደባባይ ገልጾ ሀሳብ በማቅረብ አስታውቆ እንደሆነ ውክልናውን እንደተቀበለ ይቆጠራል(ፍ/ብ/ህ/ቁ. 2201)።
በመሠረቱ አንድ ሰው ለቀረበለት ውል ምላሸ ሳይሰጥ ዝም ቢል የቀረበለትን የውል ሀሳብ እንደተቀበለ እንደማያስቆጥርበት የፍትሀብሄር ሕግ.ቁ 1682 ይደነግጋል፡፡ ነገርግን የውክልና ጉዳይ እንደ ልዩ ሁኔታ የሚወሠድ ስለሆነ እንድ ሰው በቀረበለት የውክልና ውል ላይ ግልፅ የሆነ ያለመቀበል ሃሣብ እስካላቀረበ ድረስ ዝምታው የውክልናውን ውል እንደተቀበለ የሚያስቆጥርበት መሆኑን የፍ/ብ/ህ//ቁ 2201 (2) ደንግጓል፡፡ ስለዚህ የውክልናው ውል ውክልናውን ባቀረበውና በተቀበለው ሰው መካከል ይመሠረታል ማለት ነው፡፡ ውክልናው የሚሰጠው ለብዙ ሰዎች ከሆነ ግን የውክልና ስልጣኑን ሁሉም ባንድነት መቀበላቸው ካልተረጋገጠ በቀር ውክልናው እንደጸና አይቆጠርም/የፍ/ብ/ህ/ቁ.2218/1/።
እንግዲህ በዚህ መልኩ ውክልናው ተቋቋመ። ውክልናው ሲቋቋም የውክልናው ወሰን እስከምን ድረስ ነው የሚለው ደግሞ በፍትሃ ብሄር ህጉ አንቀፅ ቁ 2202 ላይ ተቀምጧል። በዚህም መሠረት የውክልናው ወሰን በውሉ ላይ በግልፅ ተጠቅሶ ካልተቀመጠ በስተቀር ለውክልናው የሚሰጠው ወሰን እንደ ጉዳዩ አይነት ነው የሚሆነው (ፍ/ብ/ህ/ቁ 2202 (1))። ወካዩ የውክልናውን ወሰን በውክልናው ውል ላይ በግልፅ ካስቀመጠ ወሰኑ በግልጽ በተቀመጠው መሠረት ይሆናል፡፡ በሌላ በኩል ደግሞ ውክልናው ለአንድ ልዩ ጉዳይ ወይም ለእያንዳንዱ ጉዳዬች ወይም ለወካዩ ጉዳዮች ሁሉ ጠቅላላ ውክልና ሊሆን ይችላል (ፍ/ብ/ህ/ቁ 2202 (2))። ይህ ማለት አንድ ሰው ለአንድ ለተወሠነ ጉዳይ ብቻ ወይንም ለተለያዩ ከአንድ በላይ ለሆኑ ጉዳዬች ወይንም ለሁሉም ጉዳዬቹ ውክልና ሊሰጥ ይችላል ማለት ነው፡፡

በሌላ መልኩ ውክልናውን የሚቀበለው ተወካይ መቀበሉን በግልፅ ወይም በዝምታ ሊፈጽም ይችላል፡፡ ውክልናውን መቀበል የማይፈልግ ከሆነ ደግሞ በግልፅ እንደማይቀበል በመግለፅ ከኃላፊነት እራሱን ማግለል ይችላል፡፡ ስለሆነም ተወካይ ውክልናውን የማይቀበል መሆኑን ከወዲሁ በግልፅ ካላስታወቀ በስተቀር የተወከለበት ነገር ከሚያካሂደው ሥራ ጋር ግንኙነት ያለው ጉዳይ መሆኑ በግለፅ የታወቀ ከሆነ፣ ወይም ከሙያ ሥራው አመራር ጋር የሚመሣሠል ጉዳይ ከሆነ፣ ወይም ይህንን የመሠለውን ጉዳይ ለመሥራት ፍቃደኛ ለመሆኑ በአደባባይ ገልጾ ሀሳብ በማቅረብ አስታውቆ እንደሆነ ውክልናውን እንደተቀበለ ይቆጠራል(ፍ/ብ/ህ/ቁ. 2201)።
በመሠረቱ አንድ ሰው ለቀረበለት ውል ምላሸ ሳይሰጥ ዝም ቢል የቀረበለትን የውል ሀሳብ እንደተቀበለ እንደማያስቆጥርበት የፍትሀብሄር ሕግ.ቁ 1682 ይደነግጋል፡፡ ነገርግን የውክልና ጉዳይ እንደ ልዩ ሁኔታ የሚወሠድ ስለሆነ እንድ ሰው በቀረበለት የውክልና ውል ላይ ግልፅ የሆነ ያለመቀበል ሃሣብ እስካላቀረበ ድረስ ዝምታው የውክልናውን ውል እንደተቀበለ የሚያስቆጥርበት መሆኑን የፍ/ብ/ህ//ቁ 2201 (2) ደንግጓል፡፡ ስለዚህ የውክልናው ውል ውክልናውን ባቀረበውና በተቀበለው ሰው መካከል ይመሠረታል ማለት ነው፡፡ ውክልናው የሚሰጠው ለብዙ ሰዎች ከሆነ ግን የውክልና ስልጣኑን ሁሉም ባንድነት መቀበላቸው ካልተረጋገጠ በቀር ውክልናው እንደጸና አይቆጠርም/የፍ/ብ/ህ/ቁ.2218/1/።
እንግዲህ በዚህ መልኩ ውክልናው ተቋቋመ። ውክልናው ሲቋቋም የውክልናው ወሰን እስከምን ድረስ ነው የሚለው ደግሞ በፍትሃ ብሄር ህጉ አንቀፅ ቁ 2202 ላይ ተቀምጧል። በዚህም መሠረት የውክልናው ወሰን በውሉ ላይ በግልፅ ተጠቅሶ ካልተቀመጠ በስተቀር ለውክልናው የሚሰጠው ወሰን እንደ ጉዳዩ አይነት ነው የሚሆነው (ፍ/ብ/ህ/ቁ 2202 (1))። ወካዩ የውክልናውን ወሰን በውክልናው ውል ላይ በግልፅ ካስቀመጠ ወሰኑ በግልጽ በተቀመጠው መሠረት ይሆናል፡፡ በሌላ በኩል ደግሞ ውክልናው ለአንድ ልዩ ጉዳይ ወይም ለእያንዳንዱ ጉዳዬች ወይም ለወካዩ ጉዳዮች ሁሉ ጠቅላላ ውክልና ሊሆን ይችላል (ፍ/ብ/ህ/ቁ 2202 (2))። ይህ ማለት አንድ ሰው ለአንድ ለተወሠነ ጉዳይ ብቻ ወይንም ለተለያዩ ከአንድ በላይ ለሆኑ ጉዳዬች ወይንም ለሁሉም ጉዳዬቹ ውክልና ሊሰጥ ይችላል ማለት ነው፡፡

Yesterday was a historical day of my life because I was able to meet with our President Joe Biden.
After his speech remarks on Bipartisan Infrastructure law the President went around the room to greet people , at first I was nervous to go in the line to greet him because all State senator's, congressman/women and representatives wants to meet him first.
I waited patiently for my turn but when Governor Tim Walz pass by me he was able recognized my face and ran to greeted me then he asked me if I had met the President yet, I told him no and he was like well go in the line Oballa and share your story with him.
I was so pumped and immediately the President came toward me and ask my name.
I told him my is Oballa Oballa and he giggle 😃 I don't WHY but after that I told him I am a councilman in #Austin and he was like "Austin Texas"? I told him No, Austin MN one of the best city in Minnesota home of Spam 😊
I also shared with him that I fled a genocide from #Gambella Ethiopia which was caused by #TPLF regime and shared the suffering of my Anuak people and others Ethiopian for 27 years under that government.
He felt so sorry and said that should not happen to anybody.
Finally, I shared with him how grateful I am to be this nation where I can dream big and become anything I put my mind into but alot of my people are still suffering in Ethiopia due to conflict caused by #TPLF and America should not support the terrorist.
This is the first time a sitting President of America heard about my people and their suffering. I will be making arrangements soon with his staffs to visit #White #House to share more of my story and the work I do in Austin MN.
This is historical and its something that I will shared with my children years after years as they grow up.
May God bless America and #nomore war in my native country and whole continent of Africa 🙏🏾

The Forum’s operational scope is at federal and regional levels with a focus on legal, institutional and operational issues and processes that commonly concerned the civil society sector in Ethiopia.
The various Networks and Consortia of Civil Society organizations (named as ‘Civil Society Organizations’ in the recently ratified Proclamation No. 1113/2019) operating at Federal and Regional level thus came together and established the) ECSF in May 2013.

ECSF envisions seeing a strong and vibrant civil society sector for sustainable development.
Mission
ECSF aspires to ensure the existence of enabling environment for civil society organizations sector through strong representation, constructive dialogue and partnership using consortiums and other legal establishments as platform for action.

Objectives of the project: Overall Objective: The project is aimed to enhance the ability of civil society organizations (CSOs) engagement in the legal and judicial reforms process.
JOB SUMMARY
In consultation with the ECSF Program Manager and the Legal Project Officer, the Consultant shall provide contractual based legal advisory and other consultancy services, including writing proceedings, developing short concept notes to workshops, preparing activity-based descriptive reports, forwarding practicable recommendations to specific interventions, etc…focusing on the project backed by USAID - Feteh (Justice) Activity in Ethiopia. The contract shall remain for a fixed period of months whereby it is based on certain deliverables from specific activities of the aforementioned project.
Major Duties and Responsibilities
Actively participated and engaged in three relevant consultation workshops on the subject of gathering inputs on the ongoing legislative processes focusing on women, people with disability, and youths.
Gather relevant information from presentations during three public consultations, and interpreted the information in a manner that could be employed to develop recommendations or implications.
Gather inputs on three draft legislations from the network of CSOs focused on women (Network of Ethiopian Women’s Association), youth (Ethiopian Youths Federation) and PWDs (Federation of Ethiopian Associations of People with Disability - FEAPD).
Develop/compile three ‘Input Reports’ on each of the draft legislation to ensure the drafts properly address the rights and constraints of women, youth and PWD and submit to ECSF.
Output/Deliverables
Verbalized three separate reports from inputs collected during consultation workshops among the three target Networks of CSOs.
Compiled three separate reports from interpreted information and presentations during the three specific public consultations.
Compiled a reports based on the inputs collected from the three Networks of CSOs (NEWA, EYF and FEAPD) on the draft legislations.
