ሰብአዊ መብትን የሚያከብር መሆኑ፡- አሳልፎ የመስጠት ጥያቄ የቀረበለት አገር የቀረበለትን ጥያቄ በመቀበል ወይም በመከልከል ለሚሰጠው ውሳኔ የሚያገናዝባቸው ልዩ ልዩ መነሻዎች እንደሚኖሩ የሚጠበቅ ሲሆን በተለይ ተላልፎ የሚሰጠው ሰው የሰብአዊ መብት ጥሰት በተለይም ተላልፎ ከተሰጠ በኋላ ለአካላዊ ድብደባና ወ.ዘ.ተ ቅጣቶች የማይጋለጥ መሆኑን፣ በፍርድ ሂደትም ቢሆን ሊጠበቁለት የሚገቡ መሰረታዊ የሂደት መብቶች የሚጠበቁለት መሆኑን ማረጋገጥ የሚጠበቅበት ይሆናል፡፡ ከዚህ ጋር ተያይዞ ተፈላጊው ሰው የተፈለገበት መነሻ ዘሩን፣ ሀይማኖቱን፣ ዜግነቱን፣ ብሔሩን፣ የፖለቲካ አስተያየቱን ወይም ማሕበረሰባዊ መደቡን መሰረት ያደረገ ከሆነ ጥያቄው ውድቅ እንደሚደረግ ይጠበቃል፡፡ ስለሆነም የትብብር ጥያቄ በእነዚህ ላይ ተመስርቶ ያልቀረበ መሆኑን ማረጋገጥ አስፈላጊ ነው፡፡
የተጠያቂውን አገር ሕግ ያገናዘበ መሆን፡- አሳልፎ የመስጠት ጉዳይ በዋናነት የሚወሰነው ትብብር በተጠየቀው አገር ሕግ እና ለጉዳዩ ተፈጻሚነት ባላቸው ስምምነቶች መሰረት ነው፡፡ በተለይ ግን አንዳንዶቹ ጉዳዮች ብዙውን ጊዜ የሚወሰኑት ትብብር በተጠየቀው አገር ሕግ መሰረት በመሆኑ የተጠያቂው አገር ሕግ በእነዚህ ጉዳዮች ላይ የሚደነግገውን ማወቅ ለውጤታማ ተላልፎ የመሰጠት ሂደት በጣም አስፈላጊና መሰረታዊ ነው፡፡ ይልቁንም ትብብር ጠያቂው አገርና ትብብር በተጠየቀው አገር የሚከተሉት የሕግ ሥርዓት (Legal System) የተለያየ ከሆነ የሕግ አሰራራቸው ይበልጥ የመራራቅ ዝንባሌ የሚኖረው በመሆኑ ከዚህ አንጻር የአገሩን ሕግ መገንዘብ አስፈላጊነቱ ከፍተኛ ነው፡፡ በተጠያቂው አገር ሕግ ውስጥ መገናዘብ ከሚገባቸው ዋና ዋና ጉዳዮች መካከል ከአሳልፎ መስጠት ጉዳይ አንጻር መገናዘባቸው ይበልጥ አስፈላጊ የሆነው የሚከተሉት ናቸው፡-
• አሳልፎ የመስጠት ጥያቄ ሊከለከል የሚችልባቸው መነሻዎችን ማወቅ፤
• ተፈላጊው ሰው ተላልፎ እስኪሰጥ ድረስ በእስር ሊቆይ ስለሚችልበት ሁኔታ ወይም እንዳይጠፋ ሆኖ ስለሚቆይበት ሁኔታ ማወቅ፤
• አሳልፎ የመስጠት ጥያቄው ከሚቀርብበት ጊዜ ጀምሮ ተላልፎ እንዲሰጥ በመፍቀድ ወይም በመከልከል ውሳኔ እስከሚሰጥበት ጊዜ ድረስ ያለው ቆይታ ወይም ጊዜ ምን ያህል እንደሆነ ማወቅ፤
ለውጤታማ የአሳልፎ መስጠት ጥያቄና ሂደት አስፈላጊና መሰረታዊ ጉዳዮች ናቸው፡፡
የገደብ መርሕን (rule of specialty) ማክበር፡- የገደብ መርሕ የሚባለው የተፈለገው ሰው በተላልፎ ይሰጠኝ ጥያቄ በግልጽ ተጠቅሶ ከተመለከተው የወንጀል ጉዳይ ውጭ በሌላ ወንጀል በትብብር ጠያቂ አገር እንዳይጠየቅና እንዳይከሰሰ እንዲሁም ያለ አሳልፋ ሰጭዋ አገር ፍቃድ ለሌላ ሦሥተኛ አገር ተላልፎ እንዳይሰጥ የሚከለከል መርሕ ሲሆን ለዚህም ትብብር ጠያቂው አገር በምታቀርበው የአሳልፎ ይሰጠኝ ጥያቄ ውስጥ ይህን መርሕ እንደምታከብር ማረጋገጫ መስጠት ይኖርባታል፡፡ ከዚህ ባሻገር የአሳልፎ ይሰጠኝ ጥያቄው በውስጡ ከሚይዘው የተላልፎ ይሰጠኙን የተመለከተ ዝርዝር ባሻገር እንደአስፈላጊነቱ መሟላት ያለባቸውን የፍርድ ቤት የመያዣ ትዕዛዝ ወይም ፍርድ ወ.ዘ.ተ. ሰነዶች፣ ከጥያቄው ጋር አብሮ ማቅረብ ይገባል፡፡
አሳልፎ መስጠትን በተመለከተ ከላይ የተነሱት ጉዳዮች እንደተጠበቁ ሆነው በዚህ ሂደት ውስጥ በተለይ ከፍተኛ ሚና ያላቸው አካላት እንደአገሩ ሁኔታ ልዩነት ቢኖርም ማዕከላዊ ባለስልጣን ሆኖ የሚሰራ የጠቅላይ ዐቃቤ ሕግ ወይም ፍትሕ ሚኒስቴር፣ የፍርድ ቤቶች፣ ፖሊስና ማረሚያ ቤቶች ሚና ተጠቃሽ ነው፡፡ አሳልፎ የመስጠት ጉዳይን በተመለከተ የመወሰን ስልጣን እንደአገሩ ሁኔታ በአስፈጻሚው አካል ወይም በፍርድ ቤት ሊወሰን የሚችል ሲሆን አገራችንን በተመለከተ የአሳልፎ መስጠት ጉዳዮችን ጨምሮ በወንጀል ጉዳዮች ዓለም ዓቀፍ ትብብርን የማድረግ ስልጣን በአዋጅ ቁጥር 943/2008 መሰረት ለጠቅላይ ዐቃቤ ሕግ የተሰጠ ነው፡፡ ሆኖም ጉዳዮቹን ከመወሰን አንጻር ተፈጻሚነት ያለው ሕግ የተሟላና በበቂ ሁኔታ ግልጽ እንዲሆን ማድረግ አስፈላጊ ነው፤ ለዚህም ወደፊት እንደሚጸድቅ የሚጠበቀው የወንጀል ስነ ስርአትና የማስረጃ ሕግ በረቂቁ የያዘው ጉዳይ ወሳኝነት የሚኖረው ይሆናል፡፡
በአገራችን ሁኔታ የአሳልፎ መስጠት ጥያቄ ሊቀርብ የሚገባው በአዋጁ መሰረት ለጠቅላይ ዐቃቤ ሕግ ሲሆን አገራችን ለሌሎች አገራት የምታቀርበው የአሳልፎ መስጠት ጥያቄ የሚቀርበውም በዚሁ አካል አማካኝነት ነው፡፡ ይሁን እንጂ የአሳልፎ መስጠት ትብብር ስኬታማ እንዲሆን የሌሎች ባለድርሻ አካላት ማለትም የውጭ ጉዳይ ሚኒስቴር፣ የኢሚግሬሽን፣ ፍርድ ቤቶች፣ የብሔራዊ ኢንተርፖል፣ የፖሊስና ማረሚያ ቤት ተቋማት ሚና እጅግ ከፍተኛ ነው፡፡

የተጠያቂውን አገር ሕግ ያገናዘበ መሆን፡- አሳልፎ የመስጠት ጉዳይ በዋናነት የሚወሰነው ትብብር በተጠየቀው አገር ሕግ እና ለጉዳዩ ተፈጻሚነት ባላቸው ስምምነቶች መሰረት ነው፡፡ በተለይ ግን አንዳንዶቹ ጉዳዮች ብዙውን ጊዜ የሚወሰኑት ትብብር በተጠየቀው አገር ሕግ መሰረት በመሆኑ የተጠያቂው አገር ሕግ በእነዚህ ጉዳዮች ላይ የሚደነግገውን ማወቅ ለውጤታማ ተላልፎ የመሰጠት ሂደት በጣም አስፈላጊና መሰረታዊ ነው፡፡ ይልቁንም ትብብር ጠያቂው አገርና ትብብር በተጠየቀው አገር የሚከተሉት የሕግ ሥርዓት (Legal System) የተለያየ ከሆነ የሕግ አሰራራቸው ይበልጥ የመራራቅ ዝንባሌ የሚኖረው በመሆኑ ከዚህ አንጻር የአገሩን ሕግ መገንዘብ አስፈላጊነቱ ከፍተኛ ነው፡፡ በተጠያቂው አገር ሕግ ውስጥ መገናዘብ ከሚገባቸው ዋና ዋና ጉዳዮች መካከል ከአሳልፎ መስጠት ጉዳይ አንጻር መገናዘባቸው ይበልጥ አስፈላጊ የሆነው የሚከተሉት ናቸው፡-
• አሳልፎ የመስጠት ጥያቄ ሊከለከል የሚችልባቸው መነሻዎችን ማወቅ፤
• ተፈላጊው ሰው ተላልፎ እስኪሰጥ ድረስ በእስር ሊቆይ ስለሚችልበት ሁኔታ ወይም እንዳይጠፋ ሆኖ ስለሚቆይበት ሁኔታ ማወቅ፤
• አሳልፎ የመስጠት ጥያቄው ከሚቀርብበት ጊዜ ጀምሮ ተላልፎ እንዲሰጥ በመፍቀድ ወይም በመከልከል ውሳኔ እስከሚሰጥበት ጊዜ ድረስ ያለው ቆይታ ወይም ጊዜ ምን ያህል እንደሆነ ማወቅ፤
ለውጤታማ የአሳልፎ መስጠት ጥያቄና ሂደት አስፈላጊና መሰረታዊ ጉዳዮች ናቸው፡፡
የገደብ መርሕን (rule of specialty) ማክበር፡- የገደብ መርሕ የሚባለው የተፈለገው ሰው በተላልፎ ይሰጠኝ ጥያቄ በግልጽ ተጠቅሶ ከተመለከተው የወንጀል ጉዳይ ውጭ በሌላ ወንጀል በትብብር ጠያቂ አገር እንዳይጠየቅና እንዳይከሰሰ እንዲሁም ያለ አሳልፋ ሰጭዋ አገር ፍቃድ ለሌላ ሦሥተኛ አገር ተላልፎ እንዳይሰጥ የሚከለከል መርሕ ሲሆን ለዚህም ትብብር ጠያቂው አገር በምታቀርበው የአሳልፎ ይሰጠኝ ጥያቄ ውስጥ ይህን መርሕ እንደምታከብር ማረጋገጫ መስጠት ይኖርባታል፡፡ ከዚህ ባሻገር የአሳልፎ ይሰጠኝ ጥያቄው በውስጡ ከሚይዘው የተላልፎ ይሰጠኙን የተመለከተ ዝርዝር ባሻገር እንደአስፈላጊነቱ መሟላት ያለባቸውን የፍርድ ቤት የመያዣ ትዕዛዝ ወይም ፍርድ ወ.ዘ.ተ. ሰነዶች፣ ከጥያቄው ጋር አብሮ ማቅረብ ይገባል፡፡
አሳልፎ መስጠትን በተመለከተ ከላይ የተነሱት ጉዳዮች እንደተጠበቁ ሆነው በዚህ ሂደት ውስጥ በተለይ ከፍተኛ ሚና ያላቸው አካላት እንደአገሩ ሁኔታ ልዩነት ቢኖርም ማዕከላዊ ባለስልጣን ሆኖ የሚሰራ የጠቅላይ ዐቃቤ ሕግ ወይም ፍትሕ ሚኒስቴር፣ የፍርድ ቤቶች፣ ፖሊስና ማረሚያ ቤቶች ሚና ተጠቃሽ ነው፡፡ አሳልፎ የመስጠት ጉዳይን በተመለከተ የመወሰን ስልጣን እንደአገሩ ሁኔታ በአስፈጻሚው አካል ወይም በፍርድ ቤት ሊወሰን የሚችል ሲሆን አገራችንን በተመለከተ የአሳልፎ መስጠት ጉዳዮችን ጨምሮ በወንጀል ጉዳዮች ዓለም ዓቀፍ ትብብርን የማድረግ ስልጣን በአዋጅ ቁጥር 943/2008 መሰረት ለጠቅላይ ዐቃቤ ሕግ የተሰጠ ነው፡፡ ሆኖም ጉዳዮቹን ከመወሰን አንጻር ተፈጻሚነት ያለው ሕግ የተሟላና በበቂ ሁኔታ ግልጽ እንዲሆን ማድረግ አስፈላጊ ነው፤ ለዚህም ወደፊት እንደሚጸድቅ የሚጠበቀው የወንጀል ስነ ስርአትና የማስረጃ ሕግ በረቂቁ የያዘው ጉዳይ ወሳኝነት የሚኖረው ይሆናል፡፡
በአገራችን ሁኔታ የአሳልፎ መስጠት ጥያቄ ሊቀርብ የሚገባው በአዋጁ መሰረት ለጠቅላይ ዐቃቤ ሕግ ሲሆን አገራችን ለሌሎች አገራት የምታቀርበው የአሳልፎ መስጠት ጥያቄ የሚቀርበውም በዚሁ አካል አማካኝነት ነው፡፡ ይሁን እንጂ የአሳልፎ መስጠት ትብብር ስኬታማ እንዲሆን የሌሎች ባለድርሻ አካላት ማለትም የውጭ ጉዳይ ሚኒስቴር፣ የኢሚግሬሽን፣ ፍርድ ቤቶች፣ የብሔራዊ ኢንተርፖል፣ የፖሊስና ማረሚያ ቤት ተቋማት ሚና እጅግ ከፍተኛ ነው፡፡

የሀገራት አለምአቀፍ ግንኙነት መርሆች

ሰላም ጤና ይስጥልን ውድ የኢ.ፌ.ዴ.ሪ ጠቅላይ ዐቃቤ ህግ የፌስቡክ ገጽ ተከታታዮቻችን እንዴት ናችሁ ለዛሬ የሀገራት አለማቀፍ ግንኙነት መርሆዎች ምንድን ናቸው በሚለው ላይ አንድ ጥንቅር ወደ እናንተ ልናደርስ ወደናል ከወዲሁ መልካም ንባብ ተመኝን፡፡
1. የሀገራት ግንኙነትና የሚመራበት ህግ ማዕቀፍ
የአለም ሀገራት በተለያዩ ጉዳዮች ዙሪያ ግንኙነት ይፈጥራሉ፡፡ በተለይ በአሁኑ ወቅት የአለም ሀገራት የጠበቀ ግንኙነት በመፍጠር በጋራ የሚሰሩበት ወቅት ላይ እንገኛለን፡፡ የሀገራት ግንኙነት በኢኮኖሚ፣ ንድግ፣ በፖለቲካ ወይም በፀጥታ ዘርፍ በትብብር መስራት ላይ የተመሰረተ ሊሆን ይችላል፡፡
በሀገራት መካከል የሚደረግ ማናቸውም ግንኙነት የሚገዛው በአለምአቀፍ ህግ መሰረት ነው፡፡አለምአቀፍ ህግ ደግሞ የራሱ የሆኑ መርሆዎች፣ መብቶችና የሀገራት ግዴታዎች ያሉት ሰፊ ማእቀፍ ነው፡፡ አለምአቀፍ ህግ በተለያዩ የአለምአቀፍ ግንኙነት ዘርፎች ገዢ የሆኑ ድንጋጌዎችና ደንቦች አሉት፡፡የአለም አቀፍ ህግ ምንጭ በዋናነት የሀገራት የፅሁፍ ስምምነት (ሁለትዮሽም ሆነ ባለብዙ)፣ የዳበረና የታወቀ ልማድ፣ ጠቅላላ መርሆች እና እነዚህን የሚያረጋግጡ አለምአቀፍ ፍርዶችና የታወቁ ምሁራን ፅሁፎች ናቸው፡፡
2. የሀገራት ግንኙነት መርሆች ምንድን ናቸው?
እንያንዳንዱ ሀገር ትልቅም ሆነ ትንሽ፣ ደሀም ሆነ ባለፀጋ እኩል መብትና ግዴታ አለው፡፡ በተጨማሪም የሉዓላዊ ስልጣን ባለቤትና የሚያስተዳድረው ግዛት አንድነት የማይደፈር፣ በሀገሩ ያሉ ሰዎችና ንብረት ላይ ሙሉ ስልጣን ያለው ነው፡፡ ከዚህም አንፃር የሚከተሉት የታወቁና የተጠበቁ የአለምአቀፍ ህግ ግንኙነት መርሆች ናቸው፡- ሁሉም ሀገራት እኩል መሆናቸው፣ ሀገራት ሉዓላዊ ስልጣን ያላቸው መሆናቸው፣ አለምአቀፍ ግንኙነቶችን በቅን ልቦና ማድረግ፣ በአንድ ሀገር የውስጥ ጉዳይ ማንም ጣልቃ መግባት አለመቻሉ፣ በአለምአቀፍ ግንኙነት ራስን በመከላከል ካልሆነ በቀር ሀይልን አለመጠቀም፣ አለመግባባቶችን በሰላማዊ መንገድ መፍታት የሚሉት ይገኙበታል፡፡
ሀገራት ግንኙነታቸውን እና በተለያዩ ጉዳዮች ያሉ ትብብራቸውን ለማሳለጥ በሁለትዮሽ ግንኙነትም ይሁን በባለብዙ ዘርፍ ግንኙነት በጋራ እየሆኑ አለምአቀፍ እና አህጉራዊ ድርጅቶችን መስርተው በጋራ ለመስራት ጥረት ያደርጋሉ፡፡ የማናቸውም ሀገራት ግንኙነት ከላይ በተመለከቱት አጠቃላይ የአለምአቀፍ ህጎች እና መርሆች የሚገዙ ናቸው፡፡ ማናቸውም ሀገር የሌላው ሀገር ሉአላዊነት፣ የግዛት አንድነት፣ የፖለቲካ ነፃነት፣ እኩልነት ማክበርና እና በውስጥ ጉዳይ ከመግባት መቆጠብ አለባቸው፡፡ አንድ ሀገር ከሌላ ሀገር ጋር ግንኙነቱ የሻከረ እንደሆነ ወይም አለመግባባት የተፈጠረ እንደሆነ ይህን ለማስተካከል ሰላማዊ በሆነ መንገድ በቀጥታ ወይም ሶስተኛ ወገንን ጨምሮ መነጋገርና ችግሮችን በሰለጠነ መንገድ ለመፍታት ከመጣር በዘለለ በሌላ ሀገር ጉዳይ ጣልቃ መግባት አይችሉም፡፡
በሌላ አገላለፅ በአንድ ሀገር ውስጥ አንድን ወገን መደገፍ ሌላውን መቃወም ወይም አንድ መንግስት ይህን አድርግ ይህን አታድርግ በማለት ኢኮኖሚያዊ ወይም ፖለቲካዊ ጫና ወይም ማእቀብ በመንግስት ላይ ማድረግ በአንድ ሀገር የውስጥ ጉዳይ በቀጥታ ጣልቃ መግባት ማለት ነው፡፡ አንድ ሀገር በሌላ ሀገር ውስጥ ጉዳይ ላይ በራሱም ሆነ ሌሎች ሀገራት ጫና እንዲያደርጉበት፣ እንዲያገሉት ወይም ግንኙነት እንዳያደርጉ ማድረግ ግልፅ የሆነ በውስጥ ጉዳይ ጣልቃ የመግባት እርምጃ እና የአለም አቀፍ ህግ ጥሰት ነው፡፡ ነገር ግን ሀገራት ከእነዚህ መርሆች ውጭ የተለያዩ ምክንያቶችን መነሻ በማድረግ በሌላ ሀገር የውስጥ ጉዳይ ጣልቃ ሲገቡ እና የተለያዩ ጫናዎችን ሲፈጥሩ ይስተዋላል፡፡ በተለይም ግብዣ ሳይቀርብና ፈቃድ ሳይሰጥ በአንድ ሀገር የውስጥ አስተዳደር ጉዳይ በመግባት እንዲህ አድረጉ ወይም እንደዚህ አታድርጉ በማለት በውስጥ ጉዳይ ውሳኔ አሰጣጥ ላይ ጫና ለመፍጠር የሚደረግ ጥረት አለምአቀፍ ህግን የጣሰ ተግባር ነው፡፡
በሌላ በኩል ሀገራት በፈቃዳቸው ያቋቋሙት እና አባል የሆኑበት የተባበሩት መንግስታት ድርጅት ዋነኛ አላማዎች ወይም ተግባራት መካከል አለምአቀፍ ሰላምና ፀጥታ ማስጠበቅ፣ የሀገራትን ወዳጅነት በሉአላዊ እኩልነት ላይ ተመስርቶ ማራመድ፣ የኢኮኖሚ ማህበራዊና ባህላዊ ችግሮችን ለመፍታትና ሰብአዊ መብቶችን ለማስከበር በትብብር መስራት ይገኙበታል፡፡ ከዚህ አንፃር በአንድ ሀገር ያሉ ሁነቶች አለምአቀፍ ሰላምና ጸጥታን የሚመለከቱ ከሆኑ ወይም በሁለት ሀገራት መካከል ያለ ግንኙነት አለምአቀፍ ሰላምና ፀጥታን የሚያደፈርስ ከሆነ ጉዳዩን በመመልከት ህጋዊ የሆነ መፍትሄ የመስጠት ሀላፊነት ይኖረዋል፡፡ አባል ሀገራትም በዚህ ማእቀፍ ውስጥ ለመስራት ይችላሉ፡፡
የሀገራት ግንኙነት ሊመራ የሚገባው በዚህ ማዕቀፍ ቢሆንም በአንድ ሀገር ውስጥ ሊከሰት የሚችለው ችግር አለምአቀፍ ሰላምና ፀጥታን የሚመለከቱ ጉዳዮች ባልሆነ ጊዜ የሀገራትን ግንኙነት መርሆችን ተከትሎ መንቀሳቀስ ላይ የወጥነት ችግር እና መርህን መሰረት አለማድረግ እንደ ችግር ይታያል፡፡ አለምአቀፍ ሰላምና ፀጥታን የሚመለከት ችግር ባጋጠመ ጊዜ የግጭቶች አካሄድ አለምአቀፍ ህግን ያከበረ እንዲሆን እና ወደ ጎረቤት ሀገሮች ግጭቶች እና ችግሮች ተስፋፍተው አካባቢያዊ ሰላምና ፀጥታን የሚያደፈርስ እንዳይሆን የመከታተልና የመደገፍ ስራ እንደ የተባበሩት መንግስታት ድርጅት ያሉ ተቋማት ሊሰሩ ይችላሉ፡፡ ከዚህም አንፃር ቢሆን የተባበሩት መንግስታት በጉዳዩ የሚመለከተው በአንድ ሀገር የውስጥ ጉዳይ ሳይሆን ሀገራት የገቡትን አለምአቀፍ ግዴታ ከማክበራቸው አንፃር እና የሀገራት እርምጃ ከአለም አቀፍ ሰላምና ፀጥታ መጠበቅ ላይ ከሚኖረው ተፅእኖ አንፃር ብቻ ሊሆን ይገባል፡፡
በሌላ በኩል የሰብአዊ መብት ጥሰቶች የሚያጋጥሙ ቢሆን የአንድ ሀገር የውስጥ ጉዳይ እና አለምአቀፍ ግዴታን የመወጣት ጉዳይ ነው፡፡ የሰብአዊ መብት ጥሰት ከፍ ያለ እና ስርአታዊ (systemic) መልክ ያለው ሲሆን የተባበሩት መንግስታት ችግሩን ለመቅረፍ ድጋፍና ትብብር እንዲያደርግ የሚጋብዝ ከሚሆን ውጪ አለምአቀፍ ሰላምና ፀጥታን የሚያናጋ እስካልሆነ ድረስ በስልጣኑ ስር የሚወድቅ ጉዳይ አይሆንም፡፡ በተመሳሳይ የሰብአዊ እርዳታ በምግብም ሆነ መጠለያ በስፋት ማስፈለጉ የአንድ ሀገር የውስጥ ጉዳይ ቢሆንም አለምአቀፍ ህብረተሰቡ ድጋፍ የማድረግ ሰብአዊ ግዴታ አለበት፡፡ ከዚህ አንፃርም የተባበሩት መንግስታት ድጋፍ ከማድረግ ባለፈ አንድን ሀገር ይህን አድርግ ይህን አታድርግ ለማስባል የሚበቃ አይደለም፡፡ ወደእዚህ ደረጃ ከፍ ሊል የሚችለው ችግሩ አለምአቀፍ የሰላምና ፀጥታ ችግር ወደ መሆን ደርሷል ወይም ሊደርስ ይችላል የሚባል ሲሆን ብቻ ነው፡፡
በመሆኑም ሀገራት በአለምአቀፍ ግንኙነታቸው አንዱ የሌላውን እኩልነት እና ሉአላዊነት ማክበር፣ በቅን ልቦና ግንኙነቶችን ማድረግ፣ በሌሎች ሀገሮች የውስጥ ጉዳይ ጣልቃ አለመግባትና ጫና አለማድረግ ያስፈልጋል፡፡ የተባበሩት መንግስታት በበኩሉ የስልጣንና ሀላፊነት ወሰኑን በሚገባ በመጠበቅ አለምአቀፍ ሰላምና ፀጥታ ጉዳዮች ላይ ማተኮር እና የአባል ሀገራትን እኩልነት እና ሉአላዊነት ማክበርና ማስከበር ይጠበቅበታል፡፡ በተጨማሪም ሀገራት አለምአቀፍ ግዴታቸውን ለመወጣት የሚያደርጉትን ጥረት የመደገፍ እና ሰብአዊ ድጋፍ የማድረግ አለምአቀፍ ግዴታውን በተቻለ መጠን ለመወጣት ጥረት ማድረግ ይኖርበታል፡፡

ሰላም ጤና ይስጥልን ውድ የኢ.ፌ.ዴ.ሪ ጠቅላይ ዐቃቤ ህግ የፌስቡክ ገጽ ተከታታዮቻችን እንዴት ናችሁ ለዛሬ የሀገራት አለማቀፍ ግንኙነት መርሆዎች ምንድን ናቸው በሚለው ላይ አንድ ጥንቅር ወደ እናንተ ልናደርስ ወደናል ከወዲሁ መልካም ንባብ ተመኝን፡፡
1. የሀገራት ግንኙነትና የሚመራበት ህግ ማዕቀፍ
የአለም ሀገራት በተለያዩ ጉዳዮች ዙሪያ ግንኙነት ይፈጥራሉ፡፡ በተለይ በአሁኑ ወቅት የአለም ሀገራት የጠበቀ ግንኙነት በመፍጠር በጋራ የሚሰሩበት ወቅት ላይ እንገኛለን፡፡ የሀገራት ግንኙነት በኢኮኖሚ፣ ንድግ፣ በፖለቲካ ወይም በፀጥታ ዘርፍ በትብብር መስራት ላይ የተመሰረተ ሊሆን ይችላል፡፡
በሀገራት መካከል የሚደረግ ማናቸውም ግንኙነት የሚገዛው በአለምአቀፍ ህግ መሰረት ነው፡፡አለምአቀፍ ህግ ደግሞ የራሱ የሆኑ መርሆዎች፣ መብቶችና የሀገራት ግዴታዎች ያሉት ሰፊ ማእቀፍ ነው፡፡ አለምአቀፍ ህግ በተለያዩ የአለምአቀፍ ግንኙነት ዘርፎች ገዢ የሆኑ ድንጋጌዎችና ደንቦች አሉት፡፡የአለም አቀፍ ህግ ምንጭ በዋናነት የሀገራት የፅሁፍ ስምምነት (ሁለትዮሽም ሆነ ባለብዙ)፣ የዳበረና የታወቀ ልማድ፣ ጠቅላላ መርሆች እና እነዚህን የሚያረጋግጡ አለምአቀፍ ፍርዶችና የታወቁ ምሁራን ፅሁፎች ናቸው፡፡
2. የሀገራት ግንኙነት መርሆች ምንድን ናቸው?
እንያንዳንዱ ሀገር ትልቅም ሆነ ትንሽ፣ ደሀም ሆነ ባለፀጋ እኩል መብትና ግዴታ አለው፡፡ በተጨማሪም የሉዓላዊ ስልጣን ባለቤትና የሚያስተዳድረው ግዛት አንድነት የማይደፈር፣ በሀገሩ ያሉ ሰዎችና ንብረት ላይ ሙሉ ስልጣን ያለው ነው፡፡ ከዚህም አንፃር የሚከተሉት የታወቁና የተጠበቁ የአለምአቀፍ ህግ ግንኙነት መርሆች ናቸው፡- ሁሉም ሀገራት እኩል መሆናቸው፣ ሀገራት ሉዓላዊ ስልጣን ያላቸው መሆናቸው፣ አለምአቀፍ ግንኙነቶችን በቅን ልቦና ማድረግ፣ በአንድ ሀገር የውስጥ ጉዳይ ማንም ጣልቃ መግባት አለመቻሉ፣ በአለምአቀፍ ግንኙነት ራስን በመከላከል ካልሆነ በቀር ሀይልን አለመጠቀም፣ አለመግባባቶችን በሰላማዊ መንገድ መፍታት የሚሉት ይገኙበታል፡፡
ሀገራት ግንኙነታቸውን እና በተለያዩ ጉዳዮች ያሉ ትብብራቸውን ለማሳለጥ በሁለትዮሽ ግንኙነትም ይሁን በባለብዙ ዘርፍ ግንኙነት በጋራ እየሆኑ አለምአቀፍ እና አህጉራዊ ድርጅቶችን መስርተው በጋራ ለመስራት ጥረት ያደርጋሉ፡፡ የማናቸውም ሀገራት ግንኙነት ከላይ በተመለከቱት አጠቃላይ የአለምአቀፍ ህጎች እና መርሆች የሚገዙ ናቸው፡፡ ማናቸውም ሀገር የሌላው ሀገር ሉአላዊነት፣ የግዛት አንድነት፣ የፖለቲካ ነፃነት፣ እኩልነት ማክበርና እና በውስጥ ጉዳይ ከመግባት መቆጠብ አለባቸው፡፡ አንድ ሀገር ከሌላ ሀገር ጋር ግንኙነቱ የሻከረ እንደሆነ ወይም አለመግባባት የተፈጠረ እንደሆነ ይህን ለማስተካከል ሰላማዊ በሆነ መንገድ በቀጥታ ወይም ሶስተኛ ወገንን ጨምሮ መነጋገርና ችግሮችን በሰለጠነ መንገድ ለመፍታት ከመጣር በዘለለ በሌላ ሀገር ጉዳይ ጣልቃ መግባት አይችሉም፡፡
በሌላ አገላለፅ በአንድ ሀገር ውስጥ አንድን ወገን መደገፍ ሌላውን መቃወም ወይም አንድ መንግስት ይህን አድርግ ይህን አታድርግ በማለት ኢኮኖሚያዊ ወይም ፖለቲካዊ ጫና ወይም ማእቀብ በመንግስት ላይ ማድረግ በአንድ ሀገር የውስጥ ጉዳይ በቀጥታ ጣልቃ መግባት ማለት ነው፡፡ አንድ ሀገር በሌላ ሀገር ውስጥ ጉዳይ ላይ በራሱም ሆነ ሌሎች ሀገራት ጫና እንዲያደርጉበት፣ እንዲያገሉት ወይም ግንኙነት እንዳያደርጉ ማድረግ ግልፅ የሆነ በውስጥ ጉዳይ ጣልቃ የመግባት እርምጃ እና የአለም አቀፍ ህግ ጥሰት ነው፡፡ ነገር ግን ሀገራት ከእነዚህ መርሆች ውጭ የተለያዩ ምክንያቶችን መነሻ በማድረግ በሌላ ሀገር የውስጥ ጉዳይ ጣልቃ ሲገቡ እና የተለያዩ ጫናዎችን ሲፈጥሩ ይስተዋላል፡፡ በተለይም ግብዣ ሳይቀርብና ፈቃድ ሳይሰጥ በአንድ ሀገር የውስጥ አስተዳደር ጉዳይ በመግባት እንዲህ አድረጉ ወይም እንደዚህ አታድርጉ በማለት በውስጥ ጉዳይ ውሳኔ አሰጣጥ ላይ ጫና ለመፍጠር የሚደረግ ጥረት አለምአቀፍ ህግን የጣሰ ተግባር ነው፡፡
በሌላ በኩል ሀገራት በፈቃዳቸው ያቋቋሙት እና አባል የሆኑበት የተባበሩት መንግስታት ድርጅት ዋነኛ አላማዎች ወይም ተግባራት መካከል አለምአቀፍ ሰላምና ፀጥታ ማስጠበቅ፣ የሀገራትን ወዳጅነት በሉአላዊ እኩልነት ላይ ተመስርቶ ማራመድ፣ የኢኮኖሚ ማህበራዊና ባህላዊ ችግሮችን ለመፍታትና ሰብአዊ መብቶችን ለማስከበር በትብብር መስራት ይገኙበታል፡፡ ከዚህ አንፃር በአንድ ሀገር ያሉ ሁነቶች አለምአቀፍ ሰላምና ጸጥታን የሚመለከቱ ከሆኑ ወይም በሁለት ሀገራት መካከል ያለ ግንኙነት አለምአቀፍ ሰላምና ፀጥታን የሚያደፈርስ ከሆነ ጉዳዩን በመመልከት ህጋዊ የሆነ መፍትሄ የመስጠት ሀላፊነት ይኖረዋል፡፡ አባል ሀገራትም በዚህ ማእቀፍ ውስጥ ለመስራት ይችላሉ፡፡
የሀገራት ግንኙነት ሊመራ የሚገባው በዚህ ማዕቀፍ ቢሆንም በአንድ ሀገር ውስጥ ሊከሰት የሚችለው ችግር አለምአቀፍ ሰላምና ፀጥታን የሚመለከቱ ጉዳዮች ባልሆነ ጊዜ የሀገራትን ግንኙነት መርሆችን ተከትሎ መንቀሳቀስ ላይ የወጥነት ችግር እና መርህን መሰረት አለማድረግ እንደ ችግር ይታያል፡፡ አለምአቀፍ ሰላምና ፀጥታን የሚመለከት ችግር ባጋጠመ ጊዜ የግጭቶች አካሄድ አለምአቀፍ ህግን ያከበረ እንዲሆን እና ወደ ጎረቤት ሀገሮች ግጭቶች እና ችግሮች ተስፋፍተው አካባቢያዊ ሰላምና ፀጥታን የሚያደፈርስ እንዳይሆን የመከታተልና የመደገፍ ስራ እንደ የተባበሩት መንግስታት ድርጅት ያሉ ተቋማት ሊሰሩ ይችላሉ፡፡ ከዚህም አንፃር ቢሆን የተባበሩት መንግስታት በጉዳዩ የሚመለከተው በአንድ ሀገር የውስጥ ጉዳይ ሳይሆን ሀገራት የገቡትን አለምአቀፍ ግዴታ ከማክበራቸው አንፃር እና የሀገራት እርምጃ ከአለም አቀፍ ሰላምና ፀጥታ መጠበቅ ላይ ከሚኖረው ተፅእኖ አንፃር ብቻ ሊሆን ይገባል፡፡

የፌዴራል ጠቅላይ ፍርድ ቤት ሰበር ሰሚ ችሎት የሰበር ሰሚ ችሎት ሰኔ 30 ቀን 2013 ዓ.ም በዋለው ችሎት በመዝገብ ቁጥር 189472 “ክስ ወደ ሌላ ሥፍራ ይዛወርልኝ (Change of venue)” ላይ የቀረበን የሰበር አቤቱታ መርምሮ ውሳኔ ሰጥቷል፡፡ የውሳኔ ግልባጩን ለግንዛቤ እንዲሆናችሁ እንዲህ አካፈልናችሁ፡፡
ሰበር‼️ መልካም ዜና! ኑሮ ውድነት ላስጨነቀው!
ስንዴ፣ ዘይት፣ ስኳር እና ሩዝ ከቀረጥና ታክስ ነጻ እንዲሆኑ ተወሰነ!
የዋጋ ንረት በህብረተሰቡ ላይ የሚያሳድረውን ጫና ለመቀነስ ስንዴ፣ ዘይት፣ ስኳር እና ሩዝ ከቀረጥና ታክስ ነጻ እንዲሆኑ መወሰኑን የገንዘብ ሚኒስቴር አስታወቀ።
የገንዘብ ሚኒስትር ዲኤታ ዶክተር ኢዮብ ተካልኝ ዛሬ በሰጡት መግለጫ፥ ወሳኝ በሆኑ ሸቀጦች ላይ ቀረጥና ታክስ ማሻሻያ መደረጉን ተናግረዋል።
በመግለጫቸውም ፖስታ እና ማካሮኒ የጉምሩክ ቀረጡ እንዳለ ሆኖ ተጨማሪ እሴት ታክስ እንደተነሳላቸውም ነው የተናገሩት።
ስንዴ፣ ዘይት፣ ስኳር እና የሩዝ ምርቶች ከውጭም ሆነ ከሃገር ውስጥ ግዥ ሲፈጸም ከማንኛውም ቀረጥ ነጻ እንዲሆኑ ተወስኗልም ብለዋል በመግለጫቸው።
ከዚህ ባለፈም በዶሮ እንቁላል ላይ የነበረው ተጨማሪ እሴት ታክስ ፍላጎት እና አቅርቦት እስከሚጣጣም ከተጨማሪ እሴት ታክስ ነጻ ሆኖ ለገበያ እንዲቀርብ ተወስኗልም ነው ያሉት።
ይህም ከዛሬ ጀምሮ ለሚመለከታቸው መስሪያ ቤቶች እና አስፈጻሚ አካላት መመሪያ መተላለፉን አንስተዋል።
ሚኒስትር ዲኤታው በመግለጫቸው የፍራንኮ ቫሉታ ፈቃድ በመራዘሙ ምርት ማስገባት የጀመሩ መቀጠል እንደሚችሉም ጠቁመዋል።

Job Summary: –
handles a range of legal issues related to all Ethiopia laws including commercial, civil, public, international, administrative, tax laws and other instruments governing the company’s activities and operations in consultation with his/her immediate supervisor.
Key Responsibilities
In consultation with his/her supervisor
Provide legal opinions/advice on a wide range of legal issues, involving, inter alia, issues relating to the company’s policies and rules, labor law, commercial law and tax laws in consultation with his/her supervisor.
Prepare or review legal documents inter alia, contracts, agreements, Memorandum of Understanding, Non-Disclosure agreements and similar documents
Undertake extensive review/research of laws, legal documents, instruments, or other material that are applicable on Dashen and prepare studies, briefs, reports and correspondence
Represent Dashen before court of law, arbitration, and any tribunals or administrative proceedings,
Prepare and/or assist in the preparation of company policies and regulations.
Ensure commercial registration, business license, COC and other legal requirements of the company valid in renewed on time
Update the newly issued laws, regulations and rules that apply on Dashen; and prepare legal review
Prepares periodic performance report and submit to his/her immediate supervisor.
Perform any other related duties assigned by his/her immediate supervisor.

INTRODUCTION
The Danish Refugee Council (DRC), an international non-governmental organization (NGO), has been providing relief and development services in the Horn of Africa since 1997. DRC promotes and supports solutions to the problems faced by refugees, internally displaced people (IDPs), and migrants. The organization has offices across the region, and has been operational in Ethiopia since 2009. With funding from bilateral and multilateral donors, DRC is currently implementing a range of activities across Ethiopia and Djibouti, including WASH and shelter provision, child and youth protection, Gender based violence response, awareness-raising of migration risks, protection monitoring of migration routes, and livelihoods support for returning migrants or those at-risk of migration.
OVERALL PURPOSE OF THE ROLE:
The Danish Refugee Council (DRC), in partnership with Mercy Corps, is planning to implement a 44-month action entitled Strengthened Socio-Economic Development and Better Employment Opportunities for Refugees and Host Communities in the Jigjiga Area. In line with the Government of Ethiopia’s commitments to the Comprehensive Refugee Response Framework (CRRF), the action will aim to improve employment and livelihood opportunities for up to 54,000 members of the refugee and host community in the Fafan zone of the Somali region. As part of the action, DRC will seek to support decent jobs and the rights of refugees engaged in formal employment. Furthermore, DRC will collaborate with Jigjiga University to extend the provision of legal aid services to both refugees and host community members. DRC, therefore, is seeking a highly qualified, enthusiastic and action-oriented individual for the position of Legal Protection Officer to support with the implementation of the action’s legal components. Applicants are expected to have a demonstrated legal background combined with experience in project implementation. DRC highly encourages female applicants.
RESPONSIBILITIES
Technical Responsibilities
Support the Legal Protection Specialist in collaboration and coordination with Jigjiga University’s legal aid clinic to provide services to refugee and host communities. This entails regular field work in refugee and host communities.
Provide beneficiaries who require more detailed information on legal matters and related issues with counselling services and technical assistance as well as facilitate referrals and possible legal advice;
Ensure case management tool implemented and project documents and databases are properly kept and updated;
Assist Jigjiga University to extend basic legal advice to small and medium businesses.
Train local authorities and selected refugee and host community groups to provide information on and make referrals to legal aid services.
Contribute to enhancing customary dispute resolution techniques for and between refugee and host communities, including conflict management, mediation, negotiation and reconciliation.
Ensure all components of the action adhere to protection standards and principles as well DRC guidelines and accountability standards.
Implementation
Lead the daily implementation of legal components of the action. This entails ensuring weekly and monthly work, financial and procurement plans are in place and closely followed.
Work closely with the action’s MEAL team to monitor project achievements. When activities are identified as behind schedule or are facing technical or logistical challenges, work with the Legal Protection specialist to identify and implement corrective actions.
Contribute to regular reviews of achievements and spending for the action and contribute to all project reporting related to legal activities.
