⚖️በበርካታ ክርክሮች ላይ የሰው ምስክሮች በማስረጃነት ተጠቅሰው የሚሰሙ ሲሆን የተሰሙት ምስክሮች የተያዘውን ጭብጥ ምን ያህል አስረድተዋል ለማለት እና የተሻለ ያስረዳውን ለመለየት ግምት ውስጥ የሚገቡ መመዘኛዎች ግን ግልፅ ባለመሆናቸው በየደረጃው ያሉ ፍርድ ቤቶች የማስረጃ ምዘና መርህን መሰረት በማድረግ ውሳኔዎችን ሲገለባብጡ ይታያል።

💥በክርክር ሂደቶችም አንድን ፍሬ ነገር ለማስረዳት የተጠሩ የግራ ቀኙ ምስክሮች ቀርበው ሲመሰክሩ የከሳሽም ለከሳሽ፤ የተከሳሽም ለተከሳሽ በሚያስረዱበት ጊዜ ሌሎች ማጣሪያ ማስረጃዎች ከሌሉ ዳኞች እውነተኛውን ምስክር ለመለየት ሲቸገሩ ማየት የተለመደ ነው። ብዙ ጊዜም ዝምድናንና ፀብን ብቻ እንደ መለያ መስፈርት ሲጠቀሙም ይስተዋላል። አንዳንዶች ደግሞ የቃላት ልዩነትና መመሳሰልን ብቻ መሰረት ያደርጋሉ።

💥በዚህ ፅሁፍም በተከራካሪ ወገን የተቆጠሩ የሰው ምስክሮች የሰጡት የምስክርነት ቃል ፍሬ ነገሩን በማስረዳት ረገድ ያላቸውን ተዓማኒነት ለመመዘን ግምት ውስጥ መግባት ያለባቸውን መስፈርቶች ለመግለፅ እንሞክራለን።

1# 🇪🇹ዕድልና አጋጣሚን መሰረት በማድረግ የምስክሮችን ቃል መመዘን


ምስክሮች የሰጡት ቃል ትክክለኛነት ከሚመዘንባቸው መስፈርቶች መካከል አንዱ ዕድልና አጋጣሚ ነው።ማለትም ምስክሩ ቀርቦ የመሰከረው ቃል እርሱ እንደሚለው ለመስማት፣ ለማየት.... ወዘት እንዴት ቻለ? በሚል መጠየቅ ያስፈልጋል። ይህ ጥያቄ አግባብነቱ ለፍትሀብሄርም ለወንጀልም ጉዳዬች ሲሆን ከጊዜ፣ ከቦታ እና ድርጊቱ ሲፈፀም ከነበረው የምስክሩ ባህሪ አንፃር ሊታይ የሚገባውንነው።

ድርጊቱ የተፈፀመበት ቦታ ማስረጃን ለመመዘን ከፍተኛ ድርሻ አለው። ምስክሩ ያስረዳው ድርጊት የተፈፀመበት ቦታ ሊገኝ የቻለበት ዕድልና አጋጣሚ መመርመር ይገባዋል። ይህም ምስክሩ የሚሰጠውን ቃል የሚያውቀውን ወይም ግምቱን እንደሆነ ለመለየት ይረዳል።

ከጊዜ አንፃር ምስክሩ ድርጊቱ በተፈፀመበት ቦታ ሊገኝ መቻልና አለመቻሉን፣ ቢገኝም እንኳ ለመለየት መቻልና አለመቻሉን ለማረጋገጥ ይረዳል። ከዚህ በተጨማሪ ድርጊቱ ሲፈፀም ምስክሩ ዝም ብሎ የመከታተሉን ሁታ የተለመደና ያልተለመደ መሆኑንም በመለየት የምስክሩን ትክክለኛነት ለመመዘኛ መጠቀም ይቻላል።

2# 🇪🇹ቀጥተኛ የሆነና ያልሆነ የምስክር ቃል ምዘና


ቀጥተኛ ማስረጃ ቀጥተኛ ካልሆነ ማስረጃ የተሻለ አስረጅነት አለው ብሎ መገመት ስህተት ሊሆን ይችላል። ፍሬ ነገሩ ቀጥታ በሆነ ሁኔታ አውቃለሁ የሚል ምስክር አካባቢያዊ ሁኔታዎችን ገልፃ ከሚያስረዳ ማስረጃ የተሻለ አስረጅነት አለው ብሎ መደምደም አይቻልም። ዋናው ቁም ነገር የቀረበው ማስረጃ ከብዙ አጋጣሚዎች አንፃር ሲመዘን የሚኖረው የአስረጅነት ብቃት እንጂ ቀጥተኛ መሆን አለመሆን ላይ አይደለም።

በአይን አየሁ የሚለው ምስክር ቃሉ ሲመዘን ከግል ፍላጎቱ፣ ከጥላቻ ወይም ከዝምድና እንዲሁም ጉዳዩን ለማወቅ ካለው አጋጣሚ አንፃር ሲታይ እውነተኛ ላይሆን ይችላል። ቀጥተኛ ያልሆነ ማስረጃም ቢሆን ከሌሎች ተጨማሪ ማስረጃዎች ጋር ተጣምሮ ሲታይ እምነት የሚጣልበት ሆኖ ልናገኘው እንችላለን።

#3 🇪🇹የምስክሮች ቃል አንድነትና ልዩነት መሰረት መመዛን


የምስክሮች ቃል የእርስ በእርስ ግንኙነት ሲመረመር አንዱ ምስክር ከሌላው ምስክር ቃል ጋር ብቻ በማገናዘብ ሳይሆን አንዱ ምስክርም ቢሆን በዋና ጥያቄ፣ በመስቀለኛ ጥያቄ እና በድጋሜ ጥያቄ የሰጠው ቃል ትስስርና ተያያዥነት እንዱሁም የምስክሩ ቃል ከሌላ ዓይነት ማስረጅ ( ሰነድና ኢግዚቢት) ማስረጃ ጋር ያለው ግንኙነት መታየት ይገባዋል።

የምስክሮች ቃል ልዩነት መኖር ምስክሩን አጠራጣሪ፣ ሀሰተኛ እና የማይታመን የሚያደርገው ሲሆን ነገር ግን ሲመዘንና ሲወሰን የሰወችን የግንዛቤ ደረጃ ግምት ውስጥ ያስገባ መሆን ይኖርበታል። ከዚህ በመነሳት ከሰዎች የግንዛቤ ደረጃ ልዩነት አንፃር የምስክር ቃል ልዩነት ሊኖር ስለሚችል ፍርድ ቤቶች ልዩነቱ በጉዳዩ ላይ ለውጥ የሚያመጣ ጉልህና መሰረታዊ መሆንና አለመሆኑ ሊታይ ይገባል።

በአንፃሩ የምስክሮች ቃል መመሳሰል የተሻለ ግምት የሚሰጠው ቢሆንም ስለተመሳሰለ ብቻ በእርግጠኝነት እውነት ነው ብሎም መደምደም አይቻልም። ስለዚህ ማስረጃው ተመሳሳይ ቢሆንም እንኳን መገምገምና መመዘን አስፈላጊ ነው።

#4 🇪🇹ጥቅም ያላቸው ምስክሮች የምስክርነት ቃን ምዘና


ምስክሮቹ ከተከራካሪ ወገኖች ጋር ባላቸው ፀብ፣ ዝምድና ወይም የተለየ የጥቅም ተጋሪነት፣ ወገንተኘትና ሌላ ግንኙነት ያላቸው ሰዎች በጉዳዩ አወሳሰን ላይ የተለየ ፍላጎት ሊኖራቸው ስለሚችል የሚሰጡት የምስክርነት ቃል ምዘና በጥንቃቄ ሊታይ የሚገባው ነው። ዝምድና ያለው ሁልጊዜ ይወግናል ፀብ ያለው ደግሞ ያጠቃል ብሎም መደምደም አይቻልም።

ስለዚህ ፍርድ ቤቶች ፀብ ወይም ዝምድና ያላቸውን፣ የራሳቸው ተከራካሪዎችን፣ የአብሮ አባሮችና የጥቅም ተካፋዬችን ምስክሮች ቃል ሲመዝን ይመሰክሩበታል ከተባለው ፍሬ ነገር ወይም ጭብጥ አካባቢያዊ ሁኔታ አንፃር ማየትና የተሰጠው የምስክርነት ቃል እውናተኛ መሆኗን ወይም ለመጥቀም ወም ለመጉዳት በማሰብ የተቀነባበረ ወይም የተጋነነ መሆኑን ግምት ውስጥ ማስገባት ይኖርበታል። ለመመስከር የተነሱበት ምክንያትም መታየት ይገባዋል።

#5🇪🇹 ልዩ መደብ ያላቸው ምስክሮች ቃል ምዘና

ህፃናት የሚሰጡት የምስክርነት ቃል የተሻለ ተዓማኒነት ያለው ቢሆንም በሌሎች ተፅዕኖ ስር የመውደቃቸው ሁኔታ ከፍተኛ በመሆኑ እና ድርጊቱ የተፈፀመበትና የሚመሰክሩበት ጊዜ ልዩነት ከዕድሜያቸው የማስታወስ ችሎታ አንፃር ስጋት ስለሚፈጥር የሚሰጡት ቃል ከሌሎች ምስክሮች ቃል ጋር ተገናዝቦ በጥንቃቄ ሊመዘን ይገባል።

በዕድሜ የገፉ ሰዎች ምስክርነት ቃልም ከማስታወስ ችሎታ መድከም ጋር ተያይዞ ችግር ሊኖር ስለሚችል ከሌሎች ማስረጃዎች ጋር ተደግፎ መታየት ይኖርበታል።

የኤክስፐርት የሙያ ምስክርነት ቃልም ቢሆን የተዋጣላት በቂ ማስረጃ ተደርጎ የሚወሰድ ሳይሆን ስለሙያ አስተያየቱ ትክክለኛነት የቀረቡ ማረጋገጫዎች፣ የእውቀት ምንጩ ከሌላ ያረጋገጠው ወይስ ራሱ ያወቀው፣ ያለው ገለልተኝነት እና የእውቀት ደረጃው ጭምር መታየት ይኖርበታል።

Purpose of Job

Under the direct supervision of the Project Coordinator, the incumbent will be responsible to properly translate documents, ensure the highest standard of accuracy, and maintain the spirit, context, quality, technical language and nuances of the original version, using precise, clear and proper terminology.

He/She will also be responsible to draft regulations, delegations, agreements and other instruments necessary to fulfil the vision and support the implementation of the Hybrid Court for South Sudan.

Main Functions

Assist in the following up on the activities of the HCSS, including monitoring and evaluating progress made in line with a predefined strategic plan.

Suggest new and expand on existing policy areas for planned research.

Contribute in conducting analysis and generate accurate reports in a timely manner for the HCSS internal use.

Assist in setting the overall research direction of a relevant policy area.

Responsible for the delegation and execution of defined research areas.

Participate in the organisation of relevant meetings, congresses and conferences with stakeholders.

Engage with relevant mid-level stakeholders and develop working relationships.

Support the promotion of the activities of the HCSS.

Assist in drafting reports and participate in the preparation of budget and work programmes related to the functioning of the HCSS

Provide technical support to internal and external stakeholders.

Specific Responsibilities

Under the direct supervision of the Project Coordinator, the Associate Legal Expert will be responsible for the following duties:

Assist in drafting internal procedures, protocols and directions for the Court;

Prepare or work on draft Rules of Procedure and Evidence, if necessary, under the guidance of the Senior Legal Expert;

Prepare, in co-ordination with and under the guidance of the Senior Legal Expert, draft Practice Directions on court procedures, including court filings, as may be required;

Provide input and assistance to the Project Coordinator and Senior Legal Experts in developing and drafting other directives, policies, codes and procedures as necessary;

The selected staff member should be willing to be located either in Juba or in Addis Ababa; and

Undertake any other related tasks as requested by the Legal Counsel or Project Coordinator.

Academic Requirements and Relevant Experience

University Bachelor Degree in International Criminal Law/Public International Law with 5 years’ experience as practicing lawyer, legal or special advisor in the fields of justice, rule of law, criminal or international law.

Candidates with a Masters Degree in in International Criminal Law/Public International Law from a recognized institution must have 2 years’ experience as practicing lawyer, legal or special advisor in the fields of justice, rule of law, criminal or international law.

Experience as a legal/special advisor in an international or hybrid criminal tribunal or court is an added advantage;

Required Skills:

Proven knowledge of international criminal substantive, criminal procedural case law at international or hybrid criminal tribunals or courts;

In-depth theoretical knowledge of criminal law (both substantive and procedural), including knowledge of international legal procedures and instruments;

Demonstrated ability to find creative and pragmatic solutions in a demanding, dead-line driven environment and to establish and maintain effective, constructive working relationships with people from different national and cultural backgrounds.

Previous experience as a legal advisor during the planning or start-up phase of a court;

Previous experience drafting or amending Rules of Procedure or internal court administration or process documents;

Experience in applying expertise to analysing a diverse range of complex and unusual legal issues and problems, and in developing innovative and creative solutions;

International experience, particularly in crisis areas with multi-national and international organisations;

Good understanding of the political, cultural and security situation of the Horn of Africa, in particular South Sudan;

Ability to perform under hardship and strenuous environment; and

Very good interpersonal and communication skills, both written and oral, in Arabic and English;

Knowledge of other working language of the AU or of the local languages of South Sudan.

Tenure of Appointment

Remuneration

The salary attached to the position is an annual lump-sum of US$ 85,212.07 (P2 Step 5) inclusive of all allowances for internationally recruited staff, and US$  66,751.81  inclusive of all allowances for locally recruited staff of the African Union Commission.

የጥብቅና አገልግሎት የሚለውም በተመሳሳይ ‹‹የጥብቅና ሙያ አገልግሎት›› በሚል ተስተካክሏል፡፡ ደላላ የሚለው ቃል ሕጋዊ ቃል ሆኖ በንግድ ሕጉ በመደንገጉ፣ በዚህ አዋጅ ‹‹አገናኝ›› በሚል እንዲተካ መደረጉንም አክሏል፡፡

ጠበቆች የጥብቅና ፈቃዳቸውን ለማሳደስ ‹‹የፀና የመድን ዋስትና›› አንዱ መሥፈርት ሆኖ በረቂቅ ሕጉ ተካቶ የነበረ ቢሆንም፣ አገሪቱም የፀና ዋስትና አሠራር ስለሌላት፣ አስገዳጅ መሥፈርት መሆኑ እንዲቀር ተደርጓል፡፡ ጠበቃው የጥብቅና ፈቃዱን ለሰጪው አካል መልሶ፣ ከሕግ ሥራ ውጪ ከሁለት ዓመት በላይ ከቆየ፣ ፈቃዱን ለማግኘት እንደ አዲስ ፈተና መውሰድ እንዳለበት፣ የቆየው ግን በሕግና ተያያዥ ሥራዎች ላይ ከሆነ ያለፈተና እንደሚወሰድ በአዋጁ ተካቷል፡፡ አዋጁ ለኢትዮጵያ የሕግ ባለሙያዎች ማኅበር መመርያ የማውጣት ሥልጣን ስለሰጠው፣ የአፈጻጸም ዝርዝር እንደሚያወጣም የቋሚ ኮሚቴው የውሳኔ ሐሳብ ያብራራል፡፡

በረቂቅ አዋጁ ላይ ያልነበረና በአንቀጽ 23(4) ሥር የጥብቅና ፈቃድ ሰጪው የፌዴራል ጠቅላይ ዓቃቤ ሕግ ‹‹ቢሮ ማሟላት››ን እንደመሥፈርት ሊጠይቅ እንደማይችል በአዋጁ ተካቷል፡፡

ማንኛውም ጠበቃ በዓመት ከ24 እስከ 30 ሰዓታት የሚደርስ የሕግ ሥልጠና መውሰድ እንዳለበት፣ ጠበቃው ከጠቅላይ ዓቃቤ ሕግ ሳይመደብለት ነፃ የሕግ ድጋፍ አገልግሎት መስጠት እንደሚችልና ትክክለኛነቱና እውነት መሆኑ ተረጋግጦ እውቅና እንደሚሰጠውም በአዋጁ አካቷል፡፡ ጠበቃው የዲሲፕሊን ጥፋት ማለትም ለፍርድ ቤት ወይም ለሚመለከተው አካል ፈቃዱን እንዲያሳይ ሲጠየቅ ፈቃደኛ ካልሆነ፣ የያዘው ጉዳይ የት እንደደረሰ በደንበኛው ሲጠየቅ በአግባቡ ካላሳወቀ ካመናጨቀና ክብሩን ከነካ፣ ያለአሳማኝ ምክንያት በቀጠሮ ቀን ከፍርድ ቤት ከቀረ ወይም ከዘገየ፣ ለማኅበሩ  መክፈል የሚጠበቅበትን ክፍያ በወቅቱ ካልከፈለና ፈቃዱን በወቅቱ ካላሳደሰ ከ5000 ብር እስከ 7000 ብር የሚደርስ የገንዘብ መቀጮ እንደሚጣልበት በአዋጁ ተደንግጓል፡፡ አዋጁ በርካታ ድንጋጌዎች ተካተው በሙሉ ድምፅ ፀድቋል፡፡
