ከአምስት አመት በፊት በእንጀራ እናቷ ተገደለች የተባለችው ግለሰብ በህይወት ተገኘች

ሚያዚያ 09 ቀን 2013 (ኢዜአ) በሰሜን ሸዋ ዞን ሞጃና ወደራ ወረዳ ከአምስት ዓመት በፊት በእንጀራ እናቷ ተገደለች የተባለችው ግለሰብ በህይወት መገኘቷ ታወቀ።

ግለሰቧ መሞቷ በሀሰተኛ ምስክሮች ተረጋግጦ የእንጀራ እናቷ የ20 ዓመት እስር ቅጣት ተጥሎባቸው ነበር።

ሞታለች የተባለችው ግለሰብ እና ከሳሽ የነበሩት በቁጥጥር ስር ውለዋል።

የዞኑ ማረሚያ ቤቶች አስተዳደር ህዝብ ግንኙነት ባለሙያ ኮማንደር ደበበ መኩሪያ ለኢዜአ እንዳሉት፤ በተደራጀ የሃሰተኛ ምስክሮች የሚፈፀሙ ወንጀሎች የማህበረሰቡን መልካም እሴቶች የሚሸረሽሩ ናቸው።

በሃሰተኛ ምስክሮች በደል ከደረሰባቸው ግለሰቦች መካከልም በሞጃና ወደራ ወረዳ ሰላ ድንጋይ ከተማ ነዋሪ ጉዳይ አንዱ እንደሆነ አስረድተዋል።

ግለሰቧ የእንጀራ ልጃቸውን ገድለዋል በሚል የሰሜን ሸዋ ዞን ዐቃቤ ህግ የወንጀል መዝገብ ቁጥር 134/2008 ክስ ተመስርቶባቸው ሲከራከሩ መቆየታቸውን ኮማንደር ደበበ አስታውሰዋል።

የዞኑ ከፍተኛ ፍርድ ቤት የቀረበውን ወንጀል በመመርመር ምስክር በማሰማት ጥፋተኛ ናት ብሎ በ20 ዓመት ጽኑ እስራትና በአምስት ዓመት ከማንኛውም ማህበራዊ ግንኙነት እንዲገለሉ ውሳኔ ማስተላለፉን ጠቅሰዋል።

በተሰጠው ውሳኔ መሰረትም ግለሰቧ አምስት ዓመት ከሁለት ወራት ያህል በማረሚያ ቤት በእስር ላይ እንደሚገኙ ገልጸዋል።

ሆኖም ሞተች ተብላ በሃሰተኛ ምስክሮች የተረጋገጠላት ግለሰብ ከሌላ አካባቢ በህይወት ቆይታ በቅርብ ጊዜ ወደ ትውልድ አካባቢ መምጣቷን ማወቅ እንደተቻለ ኮማንደር ደበበ አብራርተዋል።

ሞተች ተብላ ጥፋተኛ ያልሆነችን ግለሰብ እንደጥፋተኛ ተቆጥራ ማረሚያ ቤት እንድትወርድ ያደገችው ግለሰብ ማንነቷ በአካባቢው ማህብረተሰብ እንደተረጋገጠ ገልጸዋል።

“በሃሰተኛ ምስክሮች እና በምርመራ መላላት የማህበረሰቡን መልካም እሴቶች ከማጠልሸቱም በላይ በመንግስት ሀብት ያለአግባብ የሚያባክኑ በመሆናቸው ሃሰተኛ ከሳሾችና ምስክሮች መንግስት ጠበቅ ያለ እርምጃ ሊወስድ ይገባል” ብለዋል።

ግለሰቧ በአማራ ክልል የተሻሻለው የይቅርታ አሰጣጥ መወሰኛ መመሪያ ቁጥር 30/2010 መሰረት ጉዳያቸውን ለይቅርታ ቦርዱ በማቅረብ በሚሰጠው ውሳኔ መሰረት ተፈጻሚ እንደሚሆን ኮማንደር ደበበ አስረድተዋል።

ተበዳይዋ ግለሰብ በበኩላቸው በወቅቱ ጉዳዩን ሀሰት እንደሆነ ለመከራከር ብሞክሩም በፍትህ መዛባት ምክንያት ያለ ጥፋታቸው ለእስር እንደተዳረጉ ገልጸዋል።

ሞታለች የተባለችው ልጅ በህይወት መገኘቷ በመረጋገጡም በአፋጣኝ ከእስር እንዲለቀቁና ለደረሰባቸው በደልም ካሳ እንዲከፈላቸው ጠይቀዋል።

ሃሰተኛ ምስክሮችና ከሳሾች በፈፀሙት ወንጀል በህግ እንዲጠየቁ መደረግ እንዳለበትም አስገንዝበዋል።

PROJECT OVERVIEW

JES is seeking an experienced and qualified Team leader / Senior criminal justice reform expert for the anticipated European Commission-funded project, Support to Criminal Justice Reform in Ethiopia.   

The purpose of this project is to support the Government of Ethiopia in its efforts to reform the criminal justice system in Ethiopia through the provision of ongoing technical assistance, advice and support to key institutions involved in the reforms and to ensure increased access to justice for all.

The project has three objectives:

Enhanced horizontal and vertical coordination, collaboration and cooperation between key criminal justice institutions.

This will be achieved by increasing capacity of justice institutions at Federal level (particularly the Federal AG Office and Federal Supreme Court) and Regions to jointly strategically plan, budget, implement and monitor reform activities. In addition, a dedicated programme website and internal knowledge management platform will be established and regularly updated.

Increased effectiveness, efficiency, fairness and accountability of the criminal justice system.

This will be achieved through the compliance and implementation of new approaches, rules and procedures in Criminal Procedure Code, and by increasing capacity of Police and Prosecutors to conduct criminal investigations and collect, analyse and use forensic evidence in criminal trials.  Juvenile justice policy / legislation as well as gender equity and equality policies will be drafted and adopted.  In addition, an electronic case management system will be established and integrated IT system will be strengthened

Improved access to justice for all, in particular the poor, women and other groups in vulnerable situations.

This will be achieved by establishing legal aid coordination mechanism, including legislation, and increasing capacity of Public Defenders, NGOs and university legal aid clinics to provide legal aid and assistance to defendants and victims of crime (particularly women and child victims).

THE ROLE

The Team leader / Senior criminal justice reform expert has a crucial role in implementing the programme:

DUTIES & RESPONSIBILITIES

Day-to-day implementation and management of the entire programme.

Providing ongoing technical advice and assistance to all programme beneficiaries, including but not limited to legal advice and assistance, research, monitoring and evaluation assistance, financial management assistance, and capacity development activities such as training, mentoring / coaching and hand-holding.

Managing a short-term expert facility to provide ongoing short-term expertise (in addition to that provided by the members of the TAU) as required by programme partners and approved by the Programme Steering Committee (PSC).

 QUALIFICATIONS & SKILLS

Education

Post-graduate degree in law.

General Professional experience

At least 10 years' experience in criminal justice / justice sector reform.

Experience in aid delivery methods and in implementation of international cooperation. Experience with EU projects and programmes (especially in judicial reform and/or criminal justice) is an advantage.

Minimum of three years' experience as Team Leader in similar assignments.

Demonstrated cross-cultural sensitivity; interpersonal, communication and negotiation skills.

Computer literacy, excellent report writing skills and ability to produce quality documents.

Excellent oral and written communication skills in English.

Experience in Africa is a requirement. Specific experience in Ethiopia would be considered an advantage.

 Specific professional experience

Previous experience in the practice of law, as criminal (defence) lawyer, judicial officer, prosecutor or as a senior member of a police or prison service is required. Specific experience in the aforementioned in Sub-Saharan Africa will be an advantage.

Practical experience in designing and delivering capacity development activities for members of the criminal justice system.

Demonstrated experience in identifying and designing development programmes with a gender and rights-based approach, notably in the field of governance, rule of law, access to justice and/or legal aid.

Demonstrable experience in strategic planning, project management, financial management, and monitoring and reporting.

Experience in legal research and/or drafting will be an advantage.

፬/ የአስተዳደር ፍርድ ቤቱ ውሳኔ በሰጠ በአምስት የሥራ ቀናት ውስጥ የውሳኔውን ግልባጫ ለይግባኘ ባዩ ወይም ለመስሪያ ቤቱ ተወካይ እንዲደርሰው ማድረግ አለበት፡፡

፩/ ማንኛውም የመንግስት መስሪያ ቤት የአስተዳደር ፍርድ ቤቱ የሰጠውን ውሳኔ በደረሰው በአስር የሥራ ቀን መፈጸም አለበት፡፡
፪/ በዚህ አዋጅ አንቀጽ ፹፩(፫) እና (፬) መሠረት ፍርድ ቤቱ የሰጠው ውሳኔ እስከ ፴ ቀን ድረስ አልተፈጸመልኝም በማለት የውሳኔው ተጠቃሚ ሲያመለክት የአስተዳደር ፍርድ ቤቱ ውሳኔውን እንዲያስፈጽምለት ለፌደራል የመጀመሪያ ደረጃ ፍርድ ቤት ይመራለታል፡፡
