ከ62 ዓመታት በኋላ ለመጀመሪያ ጊዜ ተሻሽሎ እንደ አዲስ የተዘጋጀው የንግድ ህግ በሕዝብ እንደራሴዎች ምክር ቤት ፀደቀ፡፡

ንግድና ከንግድ ጋር የተያዙ ህጎች ከዚህ ቀደም በተለያዩ አዋጆች ተበታትነው የተደነገጉ ነበሩ የተባለ ሲሆን አሁን ህጎቹ በአንድ ተሰባስበው በአዲሱ ሕግ በመድብል መልክ ተዘጋጅቷል፡፡

ህጉን ለማፅደቅ የሚያስችለውን የውሳኔ ሐሳብ ለምክር ቤቱ ያቀረቡት የንግድና ኢንዱስትሪ ጉዳዮች ቋሚ ኮሚቴ ሰብሳቢ ወ/ሮ መሰረት አባተ እንዳሉ አዲሱ የንግድ ህግ ከአለም የንግድ ህጎችን አሰራሮች ጋር እንዲጣጣም ተደርጓል፡፡

በተጨማሪም ኢትዮጵያ በአለም የንግድ ድርጅት አባል ለመሆን እያደረገች ባለችው ጥረትና እንቅፋት የነበሩ ድንጋጌዎች ከህጉ እንዲፋቁ መደረጉም ተነግሯል፡፡

የቀደመው የንግድ ህግ በ1952 ዓ/ም ጀምሮ ስራ ላይ ከዋለ በኋላ ለንግድ እንቅስቃሴው መቀላጠፍና ለአፈፃፀም አመቺ እንዲሆን ያስችላሉ የተባሉ ጥናቶች ላለፉት 34 አመታት ሲካሄድ የቆየ መሆኑንም ወ/ሮ መሰረት አስታውሰዋል፡፡

ህጋዊ ሰውነት ያላቸው የአስተዳደር አካላትን የሃይማኖት ተቋማት፣ የሲቪል ማህበረሰብ ድርጅቶችና የህብረት ስራ ማህበራት በሽርክና የንግድ ማህበራት ውስጥ ባለድርሻ ሆነው ቢሳተፉ እንደ ነጋዴ ተቆጥረው ህጉ በእነዚህም ላይ የሚሰራ እንዲሆን መደንገጉንም ተናግረዋል፡፡

የተበታተነና ውስብስብ ችግር ነበረበት የተባሉ የንግድ ህጎችን በአንድ መመደብ የያዘው አዲሱና ዛሬ የታቀደው የንግድ ህግ ኢትዮጵያን ለንግድ ህግ ምቹ እንድትሆን ያደርጋል ተብሎ ተስፋ ጥሎበታል፡፡

የህዝብ እንደራሴዎች ምክር ቤት ዛሬ ባካሄደው 12ኛ መደበኛ ስብሰባው ኢትዮጵያና ኡጋንዳ በወንጀል የሚፈለጉ ሰዎችን አሳልፎ ለመስጠት የደረሱትን የስምምነት ሰነድም አፅድቋል፡፡

የፌዴራል የጥብቅና አሰጣጥና አስተዳደር ረቂቅ አዋጅን ደግሞ በዝርዝር እንዲታይ ለሚመለከታቸው ቋሚ ኮሚቴ ተመርቷል፡፡

አጭር መረጃ ስለተሻሻለው የንግድ ህግ ፦

ላለፉት 62 ዓመታት ያህል በስራ ላይ የነበረው የንግድ ህግ ዛሬ በህዝብ ተወካዮች ምክር ቤት ተሻሽለ ፀድቋል።

- የህዝብ ተወካዮች ምክር ቤት ከሌሎች አዋጆች በተለየ እስከ 3 ወር ጊዜ ተወስዶ ተወያይቶ ነው ዛሬ ያፀደቀው

- 825 አንቀፆች ማሻሻያ ተደርጎባቸዋል፤

- የተሻሻለው አዋጅ ወቅቱን እና ቴክኖሎጂን ታሳቢ ያደረገ ነው ፤ ኢትዮጵያ የዓለም ንግድ ተሳፍቶ ለምታደርገው ጥረት የሚያቀል ነው።

- ማንኛውም ሰው ወደ ንግድ ስርዓት ለመግባት ይቸገርበት የነበረውን ረጅም አሰራር የሚያሳጥር ነው።

- የተሻሻለው ህግ የሚመለከተው የንግድ ስራን ብቻ ሲሆን የባንክ እና ሂሳብ ጉዳይ የሚመለከተው ከነበረው የንግድ አወጅ እንዲወጣ ተደርጎ ለብቻው እንዲታይ ተደርጓል።

- ማንኛውም ግለሰብ እና ድርጅት ባለው ካፒታል በንግድ ስርዓቱ ውስጥ ለመሳተፍ በፈለገበት ወቅት ሃሳቡን አቅርቦ በፈለገው ሞያ ላይ መሳተፍ ይችላል፤ ነገር በህግ የተከለከሉትን አይመለከትም።

- ማኛውም ሁለት እና ከዚያ በላይ የሆኑ ሰዎች በህብረት ስራ ማህበራት መስርተው በንግድ ላይ መሳተፍ ይችሉ ነበር ነገር ግን በግለሰብ ደረጃ ማህበር መመስረት አይቻልም ይህ እንዲቀር ተደርጎ ማንኛውም ግለሰብ ብቻውን ሆኖ የንግድ ህብረት ስራ ማህበር መስርቶ በንግድ ውስጥ እንዲንቀሳቀስ መብት ይሰጣል።

- የውጭ ባለሃብቶች በሀገር ውስጥ በተለያዩ የስራ መስኮች እንዲሰማሩ የሚያመቻችበት ምቹ ሁኔታ ፈጥሯል።

- ከዚህ ቀደም ትናንሽ የሚባሉ ስራዎች (1ና 2 ሰው ተሳትፎ የሚሰራባቸው) በንግድ ስርዓት ውስጥ እንዲየልፉ ይገደዳሉ በዚህም ከትንሽ ተነስተው ወደ ትልቅ ደረጃ ለመድረስ የሚየስቡ ነጋዴዎች በስርዓቱ ምክንያት ከስራው ሲወጡ ነበር ይህን ለመቅረፍ በአዲሱ አዋጅ ትናንሽ ስራዎች ነጋዴ ተብለው እንዳይመዘገቡ እና ያለ ንግድ ፍቃድ ስራቸውን እንዲሰሩ የሚፈቅድ ነው ፤ በአዋጁ ላይ አንድ ወይም ሁለት ብሎ በቁጥር ተቀምጧል።
ለምሳሌ ፦
- እርሻ እና ከብት ማርባት
- የደን ልማት
- የእደጥበብ ስራዎችም በነጋዴ የሚለው ውስጥ እንዳይካተቱ ተደርገዋል።

ነገር ግን ካፒታል ያላቸው ወይም ተጨማሪ ስራቸውን ለመስራት የሚያስችል ከሆነ በዚህ ውስጥ አይስተናገዱም ፥ ካፒታላቸው ምን ያህል ነው የሚለው በቀጣይ በሚወጣ ዝርዝር የህግ አዋጅ የሚካተት ነው።

- ዛሬ ተሻሽሎ የፀደቀው አዋጅ ለ30 ዓመታት ስራ ላይ ይውላል ተብሎ የሚጠበቅ አዋጅ ነው።

የተሻረው እና አዲሱ የኤክሳይዝ ታክ ድንጋጌዎች ንጽጽር በተለይም በጨው

መግቢያ

በሀገራችን የኤክሳይዝ ታክስን በተመለከተ በሥራ ላይ የነበረው አዋጅ ቁጥር 307/2002 (እንደተሻሻለ) ተሽሮ በአዲስ የኤክሳይዝ አዋጅ ቁጥር 1186/2020 የተተካ ስለመሆኑ ይታወቃል፡፡ በመሆኑም ይህ ጽሁፍ ሁለቱ አዋጆች የኤክሳይዝ ታክስ የተጣለባቸው ዕቃዎችን፤ ታክሱን የመክፈል ግዴታን እና ታክሱ ስለሚሰላበት ስሌትን በተመለከተ ያስቀመጡትን ድንጋጌዎች ከጨው ምርት ጋር በተያያዘ በወፍ በረር ለማነጻጽር ነው፡፡

 

1. በተሻረው እና በአዲሱ የኤክሳይዝ ታክስ አዋጅ መሰረት ታክሱ የተጣለባቸው ዕቃዎች፤ ታክሱን የመክፈል ግዴታ እና ታክሱ የሚሰላበት ስሌት፤

1.1 የተሻረው የኤክሳይዝ ታክስ አዋጅ፤

በቀድሞ የኤክሳይዝ ታክስ አዋጅ ቁጥር 307/2002 (እንደተሻሻለ) አንቀጽ 4 መሰረት የኤክሳይዝ ታክስ የተጣለባቸው ዕቃዎች በአገር ውስጥ ሲመረቱ (When produced locally) ወይም ከውጭ ወደሀገር ውስጥ ሲገቡ (When imported) የኤክሳይዝ ታክስ እንደሚከፈልባቸው የሚደነግግ ሲሆን፤ ታክሱን የመክፈል ግዴታ በተመለከተ በአዋጁ አንቀጽ 6 መሰረት በአገር ውስጥ በሚመረቱ ዕቃዎች ላይ የኤክሳይዝ ታክስ የመክፈል ግዴታ የተጣለው በአምራቹ (by the Producer) ላይ ሲሆን ወደ አገር ውስጥ በገቡ ዕቃዎች ላይ ደግሞ የመክፈል ግዴታ የተጣለው በአስመጭው (by the importer) ነው፡፡

በተሻረው የኤክሳይዝ ታክስ አዋጅ የቃል ትርጉም ላይ ለአምራች የተሰጠው ትርጉም ባይኖርም ከአዋጁ ጠቅላላ ድንጋጌ አምራች ማለት የኤክሳይዝ ታክስ የተጣለባቸውን ዕቃዎችን የሚያመርት/Producer/ እንጂ፤ የሚፈበርክ/Manufacturer/ ማለት እንዳልሆነ በቀላሉ መረዳት ይቻላል፡፡ ይሁን እንጂ Producer ተብሎ በተሻረው አዋጅ ለተጠቀሰውም ሆነ Manufacturer ተብሎ በአዲሱ የኤክሳይዝ ታክስ አዋጅ ላይ ለተጠቀሰው የኢንግሊዘኛ ቃል የተሰጠው የአማረኛ አቻ ትርጉም አምራች ቢሆንም Producer and Manufacturer የተለያዩ ትርጉም ያለቸው ቃላቶች ናቸው፡፡ በንግድ ምዝገባና ፈቃድ አዋጅ ቁጥር 980/2016 አንቀጽ 2 ንዑስ አንቀጽ 14 መሰረት “Manufacturing” includes any formulation, alteration, assembling or processing…or operation activity carried out by using industry ማለት ነው፡፡

ይህ የቃል ትርጉም በአዋጁ አንቀጽ 2 ንዑስ አንቀጽ 13 ለኢንዱስትሪ ከተሰጠው ትርጉም ጣምራ ንባብ መደራት የሚቻለው Manufacturing ማለት ኢንዱስትሪን በመጠቀም በሞተር ኃይል የመቀመም፤ የመለወጥ፤ የመገጣጠም፤ የማሰናዳት ወይም የማምረት ሥራን ማከናወን ማለት ነው፡፡  ለዚህም ጥሩ ማሳያ የሚሆነው በተሻረው አዋጅ መሰረት በጨው ላይ 30% የኤክሳይዝ ታክስ የተጣለው በአምራቹ (Producer) በመሆኑ በጨው መሸጫና መግዥ የዋጋ ግንባታ ላይ 30% የኤክሳይዝ ታክስ የተካተተው በጥሬ ጨው አምራች ገበሬዎች የመሸጫ ዋጋ ብር 257.95 ላይ እንጂ፤ ኢንዱስትሪን በመጠቀም ጥሬ-ጨው በማሰናዳትና በማቀነባበር /Processing/ ለምግብ ወይም ለሌላ ጥቅም በሚፈበርኩ /Manufacturer/ ፋብሪካዎች የመሸጫ ዋጋ ብር 529.68 ላይ የኤክሳይዝ ታክስ አልተካተተም፡፡  

 

በተሻረው አዋጅ አንቀጽ 5 መሰረት በአገር ውስጥ ለተመረቱ ዕቃዎች የኤክሳይዝ ታክስ ስሌት የሚሰላው ከማምረቻ ወጪ (cost of production) ዋጋ ላይ ሲሆን፤ በአዋጅ አንቀጽ 2(8) መሰረት የማምረቻ ወጪ ማለት፡-ለምርት ተግባር በቀጥታ የሚውሉ ጥሬ ዕቃዎችና የጉልበት ዋጋ፤ ቀጥተኛ ያልሆኑ ግብዓቶች ወጪ እና ኦቨር ሄድ ወጪ ያካትታል፡፡ ለምሳሌ የቀድሞ የንግድ ሚኒስቴር ህዳር/2009 ዓ.ም የጥሬ ጨው አምራቾች በማምረቻ ቦታ እና በፋብሪካ የተቀነባበረ አዮዲን ያለው ጨው እስከ ተጠቃሚው ድረስ የዋጋ ግንባታ እና የገበያ ሰንሰለት በሚል በማወጣውና ተግባራዊ በመሆን በሚገኘው ሰነድ ውስጥ በተራ ቁጥር 12 ላይ አንድ ኩንታል ጥሬ ጨው ለማምረት የተያዘው የማምረቻ ወጪ ብር 95.12 ነው፡፡ ይህ ማለት በተሻረው አዋጅ ጨው 30% የኤክሳይዝ ታክስ የሚከፈልበት ዕቃ/ምርት/ በመሆኑ የጨው አምራች የሆነ ገበሬ ኤክሳይዝ ታክስ የመክፈል ግዴታ ያለበት ሲሆን፤  ይህ አምራች ገበሬ የኤክሳይዝ ታክሱን የሚከፍለው ለማምረቻ ወጪ ተብሎ ከተያዘው ብር 95.12 በመሆኑ በኩንታል ሊከፍል የሚገደደው 30% × 95.12 = ብር 28.54 ነው፡፡

ማስታወሻ

የተሻረው የኤክሳይዝ ታክስ አዋጅ የኤክሳይዝ ታክስ ስሌት እንዲሰላ ግዴታ ሲጥል የነበረው ከማምረቻ ወጪ (cost of production) ዋጋ በመሆኑ፤ የቀድሞ የኢፌዴሪ ንግድ ሚኒስቴር ህዳር 30 ቀን 2009 ዓ.ም በደብዳቤ ቁጥር 011.36/7879 የጥሬ ጨው አምራቾች በማምረቻ ቦታ እና በፋብሪካ የተቀነባበረ አዮዲን ያለው ጨው እስከ ተጠቃሚው ድረስ የመግዥና መሸጫ ዋጋ እና የገበያ ሰንሰለት ተግባራዊ እንዲሆን ባስተላለፈው ሰርኩላር ደብዳቤ ላይ 30% የኤክሳይዝ ታክስ ተካቶ የሚገኘው በጥሬ ጨው አምራቾች የመሸጫ ዋጋ ብር 257.95 ላይ እንጂ በፋብሪካ የመሸጫ ዋጋ ብር 529.68 ላይ የኤክሳይዝ ታክስ አልተካተተም፡፡

 

2. አዲሱ የኤክሳይዝ ታክስ አዋጅ፤

 

በሌላ በኩል በአዲሱ የኤክሳይዝ ታክስ አዋጅ ቁጥር 1186/2020 አንቀጽ 5 መሰረት የኤክሳይዝ ታክስ የተጣለው በ3 ጉዳዮች ላይ ነው፡፡ ይህም፡- a) በተፈቀደለት አምራች በኢትዮጵያ ውስጥ በሚመረቱ ዕቃዎች (Manufactured in Ethiopia by a licensed manufacturer); b) ወደ ኢትዮጵያ በሚገቡ የኤክሳይዝ ታክስ የተጣለባቸው ዕቃዎች; እና c) በተፈቀደለት አገልግሎት ሰጪ በኢትዮጵያ ውስጥ የሚሰጡ የአክሳይዝ ታክስ የተጣለባቸው አገልግሎቶች ናቸው፡፡

በአዲሱ አዋጅ አንቀጽ 6 መሰረት የኤክሳይዝ ታክስ የመክፈል ግዴታ የተጣለው ከላይ ከa እስከ c በተጠቀሰው ቅደም ተከተል መሰረት የተፈቀደለት አምራች (Licensed manufacturer) አስመጪው እና አገልግሎቱን ለመስጠት የተመዘገበው ሰው ናቸው፡፡ የኤክሳይዝ ታክስ የመክፈል ግዴታ ከተጣለባቸው 3 አካላት መካከል ጸሃፊው በተፈቀደለት አምራች ላይ ብቻ ትኩረት አድርጓል፡፡

በአዋጅ አንቀጽ 2(20) መሰረት የተፈቀደለት አምራች (Licensed manufacturer) ማለት የኤክሳይዝ ታክስ የተጣለባቸው ዕቃዎችን የሚያመርት በአዋጁ አንቀጽ 17 መሰረት ፈቃድ የተሰጠው ሰው ማለት ነው፡፡ በአዋጁ በአንቀጽ 18(2) መሰረት የኤክሳይዝ ታክስ የሚከፈልባቸውን ዕቃዎች ለሚያመርት ሰው የሚሰጥ ፈቃድ የሚከተሉትን መያዝ አለበት፡-

አምራቹ አንዲያመርት የተፈቀደለት ዕቃ ምድብ እና

አምራቹ ምርቶችን እንዲያመርት የተፈቀደለትን ፋብሪካ ናቸው፡፡

በአዋጁ አንቀጽ 18/3ና4/ መሰረት ፈቃድ የተሰጠው አምራች፡ በተሰጠው ፈቃድ የተመለከተው ፋብሪካ ማምረት የሚችለው በፈቃዱ የተመለከተውን ዕቃ ምድብ ብቻ እንደሆነ እና በተሰጠው ፈቃድ የተመለከተው ፋብሪካ ማምረት የሚችለው በፈቃዱ ላይ አምራች በሚል የተመለከተው ሰው ብቻ እንደሆነ ይደነግጋል፡፡
አቢሲኒያ

በፈቃድ የተመለከተ ዕቃ ምድብ ማለት የኢፌዴሪ ንግድ ሚኒስቴር በ2012 ዓ.ም ባሳተመው የኢትዮጵያ ንግድ ሥራ ፈቃድ መስጫ መደቦች መመሪያ መሰረት በንግድ ሥራ ፈቃድ መስጫ ላይ የተመለከተ የሥራ መደብ ማለት ነው፡፡ ለምሳሌ አንድ አምራች በፈቃዱ ላይ የተመለከተው ዕቃ ምደብ የምግብ ጨው ማምረት ከሆነ ይህ ባለፈቃድ በፋብሪካው ማምረት የሚችለው የምግብ ጨው ብቻ ሲሆን ባለፈቃዱ በፈቃዱ ላይ አምራች መባል አለበት፡፡ በሌላ አገላለጽ አምራች ተብሎ ባልተገለጸ ፈቃድ እና በፈቃዱ ላይ ያልተገለጸን ዕቃ ምድብ ማምረት ክልክል ነው፡፡

በአዲሱ አዋጅ አንቀጽ 2(20) መሰረት ፋብሪካ/Factory/:- ማለት ፈቃድ የተሰጠው አምራች የኤክሳይዝ ታክስ የተጣለባቸውን ዕቃዎች የሚያመርትበት ወይም የሚያከማችበት ሥፍራ ሲሆን፤ የኤክሳይዝ ታክስ የተጣለባቸውን ዕቃዎች ለተጠቃሚው ህብረተሰብ ለገበያ የሚቀርቡበትን ማናቸውንም የአምራቹን የሥራ ቦታ አይጨምርም፡፡ ይህ ማለት ባለፈቃዱ ያመረታቸውን ዕቃዎች ለምሳሌ የምግብ ጨው በተለያዩ የአገሪቱ ክፍል መጋዘን ወይም ሱቅ በማከማቸት ለተጠቃሚዎች የሚያቀርብበት ቦታ እንደ ፋብሪካ ሊቆጠር አይችልም፡፡ 

በመሆኑም በጸሃፊው እምነት በተሻረው አዋጅ መሰረት በአገር ውስጥ በሚመረቱ ዕቃዎች ላይ የኤክሳይዝ ታክሱ የተጣለው በአምራቹ (Producer) በመሆኑ በጨው መሸጫና መግዥ የዋጋ ግንባታ ላይ 30% የኤክሳይዝ ታክስ የተካተተው በጥሬ ጨው አምራች ገበሬዎች የመሸጫ ዋጋ ብር 257.95 ላይ በመሆኑ፤ በተመሳሳይ በአዲሱ አዋጅ በኢትዮጵያ ውስጥ በሚመረቱ ዕቃዎች መካከል በጨው ላይ 25% የኤክሳይዝ ታክስ የመክፈል ግዴታ የተጣለው በተፈቀደለት አምራች (Licensed manufacturer) በመሆኑ ታክሱ የሚመለከተው አምራች ፋብሪካዎችን እንጂ፤ ጨው አምራች (Producer) ገበሬዎችን  አይመለከትም፡፡

ከላይ እንደተመለከተው በተሻረው አዋጅ አንቀጽ 6 መሰረት በአገር ውስጥ በሚመረቱ ዕቃዎች ላይ የኤክሳይዝ ታክስ የመክፈል ግዴታ የተጣለው በአምራቹ (by the Producer) በመሆኑ እና በአዋጁ አንቀጽ 5 መሰረት አምራቹ የሚከፍለው የኤክሳይዝ ታክስ ስሌት የሚሰላው ከማምረቻ ወጪ (cost of production) ዋጋ ላይ በመሆኑ፤ 30% የኤክሳይዝ ታክስ ተካቶ የሚገኘው በአምራች ገበሬዎች የመሸጫ ዋጋ ብር 257.95 ላይ እንጂ በፋብሪካ የመሸጫ ዋጋ ብር 529.68 ላይ የኤክሳይዝ ታክስ አልተካተተም፡፡

3. ማጠቃለያ

የቀደም የኤክሳይዝ ታክስ አዋጅ በአዲስ አንዲተካ ከተደረገበት ምክንያቶች መካከል በዋናነት በአዋጅ ቁጥር 1186/2020 መግቢያ/Preamble/ ላይ በግልጽ እንደተመለከተው በማምረቻ ወጪ ላይ ሲሰላ የነበረውን የኤክሳይዝ ታክስ፤ በፋብሪካ የመሸጫ ዋጋ እንዲተካ ለማድረግ በማሰብ ነው፡፡ በመሆኑ በጸሃፊው እምነት አዲሱ አዋጅ ሲሰራበት የቆየውን የኤክሳይዝ ታክስ ስሌት ከማምረቻ ወጪ ወደ ፋብሪካ የመሸጫ ዋጋ እንዲተካ ያደረገ በመሆኑ በጨው ላይ የተጣለውን 25% የኤክሳይዝ ታክስ ክፍያ መካተት ያለበት በፋብሪካ የመሸጫ ዋጋ ብር 529.68 እንጂ፤ በጨው አምራች ገበሬዎች የመሸጫ ዋጋ ላይ ባለመሆኑ፤ ቀደም ሲል በጨው አምራች ገበሬዎች የመሸጫ ዋጋ ላይ ብር 257.95 ተካቶ የነበረው የኤክሳይዝ ታክስ በአዲሱ አዋጅ ተነስቷል፡፡

VisionFund MFI is currently looking for candidates for Attorney I role. The successful candidates will have skills and experience that meet the following requirements:

 

Major Responsibilities

·         Assists the Branch staff in handling all issues related to collateral & the safe custody of all legal documents on real estate mortgage & chattel mortgage;

·         Assists in registering & discharging mortgaged items;

·         Ensures the safe custody of all legal documents on real esate mortgage & chattel mortgage;

·         Draws up draft contracts, agreements, forms, letters of guarantee and other transactional documents, etc. that suit a specified purpose;

·         Examines judgments & court rulings; analyzes their impact on company business & advises supervisor on approaches to be followed;

·         Gathering facts and establishing evidence, conducting investigations, examination analyses of cases and preparation of contracts and claims;

·         Ensures the proper & timely delivery of notices to delinquent clients.

·         Investigates & takes proper legal actions to rectify theft, forgeries & misappropriation of funds & property;

·         Complies & analysis information & statistics that would assist in carrying out court activities & provides legal advice & assistance to the branches in legal matters of limited complexity and gravity & in translation work of legal documents.

·         Looks into and analyzes law sources such as statutes, recorded judicial decisions, legal articles and codes to prepare legal documents such as briefs, pleadings, appeals contracts for review, etc.

 

·         Prepares, cases, pleadings, suits, statements of claims, petitions, defenses, affidavits in the name and on behalf of the institution;

·         Represents the branches before all levels of courts of law including police stations & public authorities;

·         Submits a written report to the branch & HO legal & Recovery Manager on the status of cases filed at court with collections made through court action.

 

Job Requirements:

·         Diploma in law & minimum 2-years relevant experience

·         Local language knowledge, communication skill & computer skill is advantageous.

·         knowledge of civil & commercial codes & analytical skill

ደረሰኝ በዕቃ ወይም በአገልግሎት ግብይት ላይ ተመሥርቶ ከሻጩ/ አቅራቢው ለገዥው የሚሰጥና ግብይት ስለመፈፀሙ፣ ገንዘብ ስለመሰብሰቡ፣ ዋጋው ስለመከፈሉ ወይም ለወደፊት ለመክፈል ውል መግባቱን የሚያሳይ ሰነድ ነው፡፡

ይህን ኪሳራ ለመቀነስ እና የህግ ተገዢነትን ለማሳደግ የታክስ አስተዳደር ስርዓቱ የራሱ የሆነ ህግ እና ደንብ አለው በዚህም መሰረት ማንኛውም ሰው የተጭበረበሩ ደረሰኞችን ያዘጋጀ፣ ያተመ፣ የሸጠ ወይም ያሰራጨ ወይም የታክስ ዕዳውን ለመቀነስ ወይም ተመላሽ ለመጠየቅ የተጭበረበሩ ደረሰኞችን የተጠቀመ እንደሆነ ብር 100ሺ እና ከ7-10 ዓመት በሚደርስ ጽኑ እሥራት ይቀጣል፤
ሀሰተኛ ደረሰኞችን፣ ለማዘጋጀት/ለማተም የሚያገለግል ማሽን፣ መሳሪያ፣ ወይም ሶፍትዌር የያዘ፣ የሸጠ፣ ያከራየ ወይም በሌላ መንገድ ያቀረበ ማንኛውም ሰው ብር 200ሺ የገንዘብ ቅጣት እና ከ10-15 ዓመት ጽኑ እሥራት ይቀጣል፤
ሀሰተኛ ደረሰኞችን የያዘ፣ ያስቀመጠ፣ ለሽያጭ ያመቻቸ ወይም ሀሰተኛ ደረሰኞች ጥቅም ላይ እንዲውሉ ያደረገ ሰው ከ3-5 ዓመት በሚደረስ ጽኑ እሥራት ይቀጣል፤
ግብይት ሳይፈጸም ደረሰኝ የሰጠ ወይም የተቀበለ ሰው ከብር 100ሺ እስከ ብር 200ሺ ቅጣት እና ከ7-10 ዓመት በሚደርስ ጽኑ እሥራት ይቀጣል፤

Job Description:

Chemonics International, a Washington D.C.-based international development organization, seeks to fill the position of Legal and Policy Specialist for the anticipated USAID Strengthening Accountable Governance and Civic Engagement (SAGCE) project in Ethiopia. The $30 million, five-year project will aim to strengthen sub-national government, increase citizen engagement, and strengthen civil society oversight using locally led, problem-driven, adaptive approaches. The Legal and Policy Specialist will be based in Addis and be responsible for leading all policy activities on the project. Candidates should possess extensive knowledge of effective legal and policy activities in Ethiopia. We are looking for individuals who have a passion for making a difference in the lives of people around the world. 

Responsibilities include, but are not limited to: 

Lead implementation of the project’s policy review, reform, and design activities in support of a strengthened and more effective local government.

Support all initiatives related to policy reform, an enabling environment for private investment, and public-private partnerships.

Ensure productive relationships with other donors, government counterparts, local organizations, and other stakeholders related to all policy activities.

Job Requirements:

Qualifications:

At least 8 years’ experience working in development, preferably in the area of public policy, public administration or law. 

Advanced degree in a relevant field; J.D. or L.L.M. preferred

Experience interacting with host-government agencies and the private sector 

Strong understanding of business enabling environment improvement programs, including with respect to enforcement of contracts
