Purpose of the job
The legal and corporate affairs head is responsible for developing and leading corporate legal strategy to promote and protect the company’s interests. The legal head is also responsible for providing accurate and timely counsel to the company in a variety of legal topics (labor law, partnership, corporate, etc.) and for promoting, implementing, and maintaining an organizational culture that encourages ethical business conduct and compliance with the law, the legal and regulatory requirements of the country and the Group’s code of conduct.
Main duties & responsibilities
Advising the Board of Directors and other members of the executive management of the impact on the activities and proposed activities of the company of proposed local, state, and federal laws and regulations and judicial and administrative decisions.
Assessing the merits of major court cases filed against the company and approves, with the advice of the appropriate function head, settlement of such court where warranted.
Providing accurate and timely counsel to the company in a variety of legal topics (commercial law, mergers, and acquisitions, corporate, etc.)
Providing legal consulting in policy development and training about prevention.
Developing and leading corporate legal strategy to promote and protect the company’s interest
Overseeing the delivery of legal service and resources to accomplish corporate goals strategies and priorities.
Participating in the formulation of general management policy as a member of the executive management team.
Managing other members of the legal section.
Overseeing the development or implementation of compliance-related policies and procedures throughout the company.
Overseeing the performance of the retention lawyers and related legal proceedings.
Representing the company in pursuing any legal proceeding.
Ensuring that the legal affairs of the firm are securely maintained for the required time period
Maintaining current knowledge of alteration in legislation
Ensuring that the company carries its commercial activities in full compliance with all national and international laws, regulations, and directives as well as internal (Group) policies, Codes, and guidelines.
Developing and supervision control system with a view to prevent or address a violation of laws, regulations, and guidelines.
Overseeing the periodic review of contracts, policies, and other legal documents of the company to ensure compliance with regulatory and group standards.
Overseeing the periodic review of national, regional, and international laws, procedures, and guides as well as reports with an eye to the hidden risk of non-compliance
Directing the communication of compliance-related issues with employees across all divisions of the organization and address all concerns they may have about legal, ethical, or compliance matters.
Defining and developing the approach for the mandatory compliance training in collaboration with the training teams.
Overseeing the preparation publication and distribution of authorized commercial partners to achieve clarity o commercial compliance requirements.
Job Requirements:
Broad and thorough knowledge of the compliance and ethics profession, theories, and standards.
Expert knowledge of professional compliance and investigation standards; and ability to apply policy and legal concepts to issues.
Commitment to the highest ethical and professional standards.
Excellent written and oral communication skills.
Ability to communicate complex information to all levels of management and administration in a clear and concise manner both written and verbal.
Ability to work independently and within a team environment.
Ability to share information and build consensus across stakeholders.
Ability to supervise support and professional analyses functions for compliance and ethics programs.
Ability to establish trust and credibility with stakeholders and senior management.

የገንዘብ ሚኒስቴር በኢትዮጵያ የኢኮኖሚ አሻጥር እየተሰራ መሆኑ አውቂያለሁ ብሏል።
የኢትዮጵያ ብሄራዊ ባንክ ለጊዜው ማንኛውንም ህንፃ፣ ቤት ፣ መሬት በመያዣነት ተጠቅመው ብድር እንዳለቁ ለባንኮች መመሪያ ማስተላለፉ ታውቋል።
የገንዘብ ሚኒስትር ዴኤታ የሆኑት ዶክተር እዮብ ተካልኝ የገበያውን መናጋት ለማስተካከል አስፈላጊው እርምጃ ተወስዷል ብለዋል።
ዶ/ር እዮብ ኢኮኖሚያዊ አሻጥር ሆን ተብሎ እየተሰራ መሆኑ አንስተው የገበያውን መናጋት ለማስተካከል ቶሎ እርምጃ መወሰድ አለበት ፤ ይሄ ጊዜ የሚሰጠው ጉዳይ አይደለም ምክንያቱም አደጋው ብዙ ነው ሲሉ ተናግረዋል።
ሚኒስትር ዴኤታው የፀጥታ ተቋም፣ የብሄራዊ ባንክ የተናበበ ስራ መስራት መጀመራቸውን አስረድተዋል።
"የኢትዮጵያ ብሄራዊ ባንክ መመሪያ ይልካል ፤ የቤት ብድር ምናምን እያሉ የሚወሰዱ ገንዘቦች ለጥቁር ገበያው እንደሚውሉ ስለሚታወቅ ባንኮች በእንደዚህ ያሉ ነገሮች ላይ conscious ሆነው እንዲሰሩ መመሪያ እየተላከላቸው ነው ፤ ሰውም ባንኮችም conscious መሆን አለባቸው" ሲሉ አክለዋል።

Yehualashet Tamiru Financial Scholarship in Memorial of Gas he Yohannes Heroui
Available to Current Undergraduate Law Students
2014/2015 Academic Year
Gashe Yohannes Heroui (1940-2011) was a teacher, judge, and legal scholar. He is widely considered by many of his colleagues and seasoned lawyers who knew or worked with him as one of the greatest Ethiopian jurists with immeasurable integrity. He was extremely generous, selfless, greatly liked and respected by all those who knew him in his personal life us well. This financial scholarship is, therefore, in memory of his commitment and achievements to the Ethiopian legal system.
This financial scholarship is available only for law students who are currently pursuing their undergraduate program in any university. The principal aim of this scholarship program is to offer financial support to current undergraduate law students and to encourage qualified students to continue their studies.
The application letter, a maximum of two pages, should specifically discuss three evaluation criteria: financial need, academic achievements, and career goals. Additional information on recent research projects, off-campus and on-campus activities and accomplishments, and educational plans that would aid the Financer in reaching his decision can also be included.

የፍርድ ቤት መር አስማሚነት ከአማራጭ የሙግት መፈቻ ዘዴዎች አንዱ ሲሆን ተክራካሪ ወገኖች አለመግባባታቸውን በፍርድ ቤት በኩል ወይም ፍርድ ቤት በሚመርጣቸው አስማሚዎች ወይም አስታራቂዎች አማካኝነት ወደ ፍርድ ቤት የመጣን ጉዳይ በስምምነት እንዲፈታ የሚደረግበት ሂደት ነው፡፡ይህ ሂደት ከሌሎች አማራጭ የሙግት መፍቻ ዘዴዎች ማለትም ከግልግል ዳኝነት ወይም እርቅ የሚለየው የማስማማት ሂደቱ የሚከናወነው በፍርድ ቤቶች መመሪያ እና ስነ ስርዓት እንዲሁም ፍርድ ቤቶች በሚመድቡት በማስማማት ሞያ በሰለጠነ የህግ ባለሞያ አማካኝነት እና ፍርድ ቤቶች በሚያዘጋጁት ቦታ መሆኑ ነው፡፡በሌሎች አማራጭ የሙግት መፈቻ ዘዴዎች ተከራካሪ ወገኖች ገዳያቸውን እራሳቸው በመረጡት አደራዳሪ ወይም አስራራቂ እና እራሳቸው በፈለጉት ቦታ እና በመረጡት ህግ መፍታት የሚችሉ ሲሆን በፍርድ ቤት መር ማስማማት ወቅት ግን ይህ ተግባራዊ አይሆንም፡፡ይልቁንም ሂደቱ ሊከተል ስለሚገባው ስነ ስርዓት እና አጠቃላይ ህግ የሚወሰነው በተከራካሪዎች ፍላጎት ሳይሆን በፍርድ ቤቶች ትዕዘዝ ነው፡፡
አስፈላጊነት እና ጥቅም
የፍርድ ቤት መር አስማሚነት እስፈላጊነት በዋናነት ህግ በሚፈቅዳቸው ጉዳዮች ላይ ተከራካሪዎች ጉዳያቸውን በተቻለ መጠን በአጭር ጊዜ እና በአነስተኛ ወጪ በሰላማዊ መንገድ እንዲፈቱ ማስቻል ነው፡፡ ይህም መደበኛው የፍትህ ሂደት ከሚወስደው ባጠረ ጊዜ ጉዳዮች እንዲጠናቀቁ በማስቻል የፍርድ ቤቶችን የስራ ጫና እና የባለጉዳዮችን እንግልት ለመቀነስ ያስችላል፡፡በአብዛህኛው የአለማችን ክፍል የሚከናወን የፍርድ ቤት መር አስማሚነትን ስንመለከት የፍቺ፣የሞግዚትነት፣በስራ ቦታ የሚፈጠሩ አለመግባባቶችን እንዲሁም ከንግድ ጋር በተያያዘ የሚኖሩ ግጭቶችን ለመፍታት በስራ ላይ ይውላል፡፡ ይህም በባህላዊ እና በሀይማዎታዊ ስርዓቶች ለሚከናወኑ የማስማማት ልማዶች ህጋዊ እውቅና በመስጠት በፍትህ ስርዓት ውስጥ እንደያልፉ በማድረግ የፍትህ ስርዓቱን ለማገዝ ያስችላል፡፡
የፍርድ ቤት መር አስማሚነት የሚኖረውን ጥቅም ከሁለት ማዕዘን ማየት ይቻላል፡፡ይህም ከፍርድ ቤቶች(የፍትህ ስርዓት) እንዲሁም ከባለጉዳዮች አንፃር መመልከት ይቻላል፡፡ከፍርድ ቤቶች አንፃር የሚኖረውን ጥቅም ስንመለከት ተለይተው የተወሰኑ ጉዳዮችን በማስማሚያ ማዕከላት መጨረስ የፍርድ ቤቶችን የስራ ጫና በመቀነስ የተቀላጠፈ ፍትህ እንዲኖር ያግዛል፡፡ በሌላ በኩል ለተገልጋዮች የሚኖረውን ጥቅም ስናይ ተከራካሪዎች አለመግባባታቸውን በሰላማዊ መንገድ ለዘላቂው እንዲፈቱ፣ወጪ እና ጊዜ እንዲቆጥቡ ያስችላቸዋል፡፡በተለይም ስምምነቱ በፍርድ ቤት የሚፀድቅ እና የመፈፀም በመሆኑ በሂደት ላይ እምነት እንዲኖራቸው ያደርጋል፡፡ይህም የተገልጋዮችን እርካታ የመጨመር ሚና ይኖረዋል፡፡
የፍርድ ቤት መር አስማሚነት ሂደት
በኢትዮጵያ የፍርድ ቤት መር አስማሚነት እራሱን ችሎ በህግ በፌደራል ፍርድ ቤቶች አዋጅ ከመደንገጉ በፊት ፍርድ ቤቶች በተለያዩ ጉዳዮች ላይ ባለጉዳዮች አለመግባባታቸውን በሰላማዊ መንገድ እንዲፈቱ ሲያነሳሱ እና ሲያበረታቱ መመልከት የተለመደ ነው፡፡ለምሳሌ በተሻሻለው የቤተሰብ ህግ አንቀጽ 82/2 መሰረት የፍቺ ጥያቄ ያቀረቡ ባልና ሚስት ከፍርድ ቤት ውጪ ራሳቸው በሚመርጧቸው ሽማግሌዎች አማካይነት ጉዳያቸውን በእርቅ እንዲጨርሱ ሊጠይቃቸው እንደሚችል ይደነግጋል፡፡ባልና ሚስቱ ጉዳያቸውን በሽማግሌ አማካይነት በዕርቅ ለመጨረስ ያልተስማሙ እንደሆነ ፍርድ ቤቱ ከሶስት ወር ያልበለጠ የማሰላሰያ ጊዜ ሊሰጣቸው እንደሚችል ያስቀምጣል፡፡ ይህም የሚያመለክተው የእርቅ ሂደቱ በተጋቢዎቹ ነጻ ፍቃድ ላይ በመመስረት የሚከናወን መሆኑን ነው፡፡በተጨማሪ በግል አቤቱታ በሚስቀጡ ቀለል ያሉ ወንጀሎች ላይ ክስ ተመስርቶ እንደሆነ የግል ተበዳይ እና ተከሳሽ በእርቅ እንዲስማሙ እና ክሳቸውን እንዲያነሱ ፍርድ ቤቶች ሲያግባቡ እንመለከታለን፡፡ ይህም በወንጀል ህግ አንቀፅ 212 እና በወንጀለኛ መቅጫ ስነ ስርዓት ህግ ቁጥር 254 ላይ በመመስረት የሚከናወን የፍርድ ቤቶች ተግባር ነው፡፡
በሌላ በኩል በፌደራል ፍርድ ቤቶች አዋጅ ቁጥር 1234/2013 እንቀጽ 55 ስር እንደተደነገገው በፌደራል የመጀመሪያ ደረጃ ፍርድ ቤት እና ከፍተኛ ፍርድ ቤት ከሚቀርቡ ጉዳዮች ውስጥ ጠቅላይ ፍርድ ቤት በሚያወጣው መመሪያ የሚወሰኑ በዋናነት የፍትሀ ብሄር ጉዳዮች በፍርድ ቤቶች በሚቋቋም የፍርድ ቤት መር አስማሚነት በኩል እንዲያልፉ ይደረጋል፡፡ተከራካሪዎች በፍ/ቤት መር አስማሚነት በኩል ጉዳያቸውን በስምምነት ካልጨረሱ ይህንኑ የሚገልፅ በአስማሚዎች የተፈረመ ደብደቤ ለፍርድ ቤት በማቅረብ የፍርድ ሂደቱ እንዲቀጥል ይደረጋል፡፡
እንዲሁም በአንደኛው ተከራካሪ ወገን ያለመቅረብ ምክንያት የመስማማት ሂደቱ ካልተሳካ አስማሚው ይህንኑ ለፍርድ ቤቱ ሪፖርት ያደርጋል፡፡በድርድሩ ያልተገኘው ወገን ተገቢውን ክፍያ በመክፈል ወደ መደበኛው የፍርድ ሂደት መመለስ ይችላል፡፡
በፍርድ ቤት መር ማስማማት ተከራካሪ ወገኖች የተስማሙ እንደሆነ የስምምነቱ ሁኔታዎች በአስማሚው በግልፅ ተለይተው ከቀረቡ እና ተከራካሪዎች ከፈረሙበት በኃላ አስማሚው ይህን ሰነድ ለፍርድ ቤት ቀርቦ እንዲፀድቅ ያደርጋል፡፡ሰነዱ የቀረበለት ፍርድ ቤትም ስምምነቱ ለህግ እና ለሞራል ተቃራኒ አለመሆኑ ከተረጋገጠ በኃላ እንዲጸድቅ ያደርጋል፡፡የፀደቀው የስምምነት ሰነድ እንደማንኛውም የፍርድ ቤት ውሳኔ ተፈፃሚ ይሆናል፡፡እንዲሁም በፍርድ ቤት መር አስማሚነትም ይሁን በሌላ አማራጭ የግጭት መፍቻ ዘዴ ግራ ቀኙ ከተስማሙ በደንቡ መሰረት ወጪዎች ተቀንሰው የከፈሉት የዳኝነት ክፍያ ተመላሽ ይደረግላቸዋል፡፡
የአስማሚዎች ሚና
በፍርድ ቤት መር አስማሚነት ሂደት ዋና የአስማሚዎች ሚና የሚሆነው ተከራካሪ ወገኖች ውይይት እንደያደርጉ ሁኔታዎችን ማመቻቸት፣ጭብጦችን እንዲለዩ መርዳት፣የመግባቢያ ነጥቦችን መፈለግ እና የመፍትሄ አማራጮችን ማቅረብ ነው፡፡ በመሆኑም አስማሚዎች አስገዳጅ ውሳኔ የመስጠት ስልጣን የላቸውም ማለት ነው፡፡ይልቁንም ተከራካሪዎች የተስማሙ እንደሆነ የስምምነት ሰነድ በማስፈረም በፍርድ ቤት በማቅረብ ስምምነቱ እንዲፀድቅ እና እንዲፈፀም ያደርጋሉ፡፡
የአስማሚነት መርሆች
እኩልነት እና የባለጉዳዮች ሙሉ ፍላጎት የፍርድ ቤት መር ማስማመት የሚመራባቸው መርሆች ናቸው፡፡በመሆኑም ማንኛውም ሂደት በእኩልነት እና በባለጉዳዮቸ ሙሉ ፍላጎት ላይ ተመስርቶ መከናወን አለበት፡፡ሌላው መርህ ሚስጥራዊ ሲሆን በፍርድ ቤት አስማሚነት በኩል የሚደረግ ማናቸውም የሃሳብ ልውውጦች ሚስጥራዊነት የተጠበቀ ነው፡፡ እንዲሁም በማስማማት ሂደቱ ተከራካሪ ወገኖች የሚሰጡት የእምነት ቃሎች ወይም ማንኛውም ንግግሮች ለፍርድ ቤት በማስረጃነት አይቀርቡም፡፡ለዚሁም አስማሚው ማረጋጫ ይሰጣል፡፡
ስለአስማሚዎች እና ስለ ክፍያ
በአዋጁ መሰረት በአስማሚነት መስራት የሚችሉት የአስማሚነት ስልጠና ወስደው የፌደራል ጠቅላይ ፍርድ ቤት የሚያወጣውን ምዘና ያለፉ ቢያንስ በህግ የመጀመሪያ ዲግሪ ያላቸው እና ከአምስት ዓመት ያላነሰ ጊዜ በህግ ሙያ ያገለገሉ የህግ ባለሞያዎች ናቸው፡፡ ይህም የሚያመለክተው በፍርድ ቤት መር አስማሚነት ሂደት የሚሳተፉ አስማሚዎች በቂ የአስማሚነት ክህሎት ያላቸው እና ባለጉዳዮችን ወደ ስምምነት ለማምጣት የሚችሉ መሆን እንዳለባቸው ነው፡፡በመሆኑም ፍርድ ቤቱ እንደ አስፈላጊነቱ በቋሚነት ወይም በጊዜያዊነት ብቁ አስማሚዎችን ሊቀጥር

የፍርድ ቤት መር አስማሚነት እስፈላጊነት በዋናነት ህግ በሚፈቅዳቸው ጉዳዮች ላይ ተከራካሪዎች ጉዳያቸውን በተቻለ መጠን በአጭር ጊዜ እና በአነስተኛ ወጪ በሰላማዊ መንገድ እንዲፈቱ ማስቻል ነው፡፡ ይህም መደበኛው የፍትህ ሂደት ከሚወስደው ባጠረ ጊዜ ጉዳዮች እንዲጠናቀቁ በማስቻል የፍርድ ቤቶችን የስራ ጫና እና የባለጉዳዮችን እንግልት ለመቀነስ ያስችላል፡፡በአብዛህኛው የአለማችን ክፍል የሚከናወን የፍርድ ቤት መር አስማሚነትን ስንመለከት የፍቺ፣የሞግዚትነት፣በስራ ቦታ የሚፈጠሩ አለመግባባቶችን እንዲሁም ከንግድ ጋር በተያያዘ የሚኖሩ ግጭቶችን ለመፍታት በስራ ላይ ይውላል፡፡ ይህም በባህላዊ እና በሀይማዎታዊ ስርዓቶች ለሚከናወኑ የማስማማት ልማዶች ህጋዊ እውቅና በመስጠት በፍትህ ስርዓት ውስጥ እንደያልፉ በማድረግ የፍትህ ስርዓቱን ለማገዝ ያስችላል፡፡
የፍርድ ቤት መር አስማሚነት የሚኖረውን ጥቅም ከሁለት ማዕዘን ማየት ይቻላል፡፡ይህም ከፍርድ ቤቶች(የፍትህ ስርዓት) እንዲሁም ከባለጉዳዮች አንፃር መመልከት ይቻላል፡፡ከፍርድ ቤቶች አንፃር የሚኖረውን ጥቅም ስንመለከት ተለይተው የተወሰኑ ጉዳዮችን በማስማሚያ ማዕከላት መጨረስ የፍርድ ቤቶችን የስራ ጫና በመቀነስ የተቀላጠፈ ፍትህ እንዲኖር ያግዛል፡፡ በሌላ በኩል ለተገልጋዮች የሚኖረውን ጥቅም ስናይ ተከራካሪዎች አለመግባባታቸውን በሰላማዊ መንገድ ለዘላቂው እንዲፈቱ፣ወጪ እና ጊዜ እንዲቆጥቡ ያስችላቸዋል፡፡በተለይም ስምምነቱ በፍርድ ቤት የሚፀድቅ እና የመፈፀም በመሆኑ በሂደት ላይ እምነት እንዲኖራቸው ያደርጋል፡፡ይህም የተገልጋዮችን እርካታ የመጨመር ሚና ይኖረዋል፡፡
የፍርድ ቤት መር አስማሚነት ሂደት
በኢትዮጵያ የፍርድ ቤት መር አስማሚነት እራሱን ችሎ በህግ በፌደራል ፍርድ ቤቶች አዋጅ ከመደንገጉ በፊት ፍርድ ቤቶች በተለያዩ ጉዳዮች ላይ ባለጉዳዮች አለመግባባታቸውን በሰላማዊ መንገድ እንዲፈቱ ሲያነሳሱ እና ሲያበረታቱ መመልከት የተለመደ ነው፡፡ለምሳሌ በተሻሻለው የቤተሰብ ህግ አንቀጽ 82/2 መሰረት የፍቺ ጥያቄ ያቀረቡ ባልና ሚስት ከፍርድ ቤት ውጪ ራሳቸው በሚመርጧቸው ሽማግሌዎች አማካይነት ጉዳያቸውን በእርቅ እንዲጨርሱ ሊጠይቃቸው እንደሚችል ይደነግጋል፡፡ባልና ሚስቱ ጉዳያቸውን በሽማግሌ አማካይነት በዕርቅ ለመጨረስ ያልተስማሙ እንደሆነ ፍርድ ቤቱ ከሶስት ወር ያልበለጠ የማሰላሰያ ጊዜ ሊሰጣቸው እንደሚችል ያስቀምጣል፡፡ ይህም የሚያመለክተው የእርቅ ሂደቱ በተጋቢዎቹ ነጻ ፍቃድ ላይ በመመስረት የሚከናወን መሆኑን ነው፡፡በተጨማሪ በግል አቤቱታ በሚስቀጡ ቀለል ያሉ ወንጀሎች ላይ ክስ ተመስርቶ እንደሆነ የግል ተበዳይ እና ተከሳሽ በእርቅ እንዲስማሙ እና ክሳቸውን እንዲያነሱ ፍርድ ቤቶች ሲያግባቡ እንመለከታለን፡፡ ይህም በወንጀል ህግ አንቀፅ 212 እና በወንጀለኛ መቅጫ ስነ ስርዓት ህግ ቁጥር 254 ላይ በመመስረት የሚከናወን የፍርድ ቤቶች ተግባር ነው፡፡
በሌላ በኩል በፌደራል ፍርድ ቤቶች አዋጅ ቁጥር 1234/2013 እንቀጽ 55 ስር እንደተደነገገው በፌደራል የመጀመሪያ ደረጃ ፍርድ ቤት እና ከፍተኛ ፍርድ ቤት ከሚቀርቡ ጉዳዮች ውስጥ ጠቅላይ ፍርድ ቤት በሚያወጣው መመሪያ የሚወሰኑ በዋናነት የፍትሀ ብሄር ጉዳዮች በፍርድ ቤቶች በሚቋቋም የፍርድ ቤት መር አስማሚነት በኩል እንዲያልፉ ይደረጋል፡፡ተከራካሪዎች በፍ/ቤት መር አስማሚነት በኩል ጉዳያቸውን በስምምነት ካልጨረሱ ይህንኑ የሚገልፅ በአስማሚዎች የተፈረመ ደብደቤ ለፍርድ ቤት በማቅረብ የፍርድ ሂደቱ እንዲቀጥል ይደረጋል፡፡
እንዲሁም በአንደኛው ተከራካሪ ወገን ያለመቅረብ ምክንያት የመስማማት ሂደቱ ካልተሳካ አስማሚው ይህንኑ ለፍርድ ቤቱ ሪፖርት ያደርጋል፡፡በድርድሩ ያልተገኘው ወገን ተገቢውን ክፍያ በመክፈል ወደ መደበኛው የፍርድ ሂደት መመለስ ይችላል፡፡
በፍርድ ቤት መር ማስማማት ተከራካሪ ወገኖች የተስማሙ እንደሆነ የስምምነቱ ሁኔታዎች በአስማሚው በግልፅ ተለይተው ከቀረቡ እና ተከራካሪዎች ከፈረሙበት በኃላ አስማሚው ይህን ሰነድ ለፍርድ ቤት ቀርቦ እንዲፀድቅ ያደርጋል፡፡ሰነዱ የቀረበለት ፍርድ ቤትም ስምምነቱ ለህግ እና ለሞራል ተቃራኒ አለመሆኑ ከተረጋገጠ በኃላ እንዲጸድቅ ያደርጋል፡፡የፀደቀው የስምምነት ሰነድ እንደማንኛውም የፍርድ ቤት ውሳኔ ተፈፃሚ ይሆናል፡፡እንዲሁም በፍርድ ቤት መር አስማሚነትም ይሁን በሌላ አማራጭ የግጭት መፍቻ ዘዴ ግራ ቀኙ ከተስማሙ በደንቡ መሰረት ወጪዎች ተቀንሰው የከፈሉት የዳኝነት ክፍያ ተመላሽ ይደረግላቸዋል፡፡
የአስማሚዎች ሚና
በፍርድ ቤት መር አስማሚነት ሂደት ዋና የአስማሚዎች ሚና የሚሆነው ተከራካሪ ወገኖች ውይይት እንደያደርጉ ሁኔታዎችን ማመቻቸት፣ጭብጦችን እንዲለዩ መርዳት፣የመግባቢያ ነጥቦችን መፈለግ እና የመፍትሄ አማራጮችን ማቅረብ ነው፡፡ በመሆኑም አስማሚዎች አስገዳጅ ውሳኔ የመስጠት ስልጣን የላቸውም ማለት ነው፡፡ይልቁንም ተከራካሪዎች የተስማሙ እንደሆነ የስምምነት ሰነድ በማስፈረም በፍርድ ቤት በማቅረብ ስምምነቱ እንዲፀድቅ እና እንዲፈፀም ያደርጋሉ፡፡
የአስማሚነት መርሆች
እኩልነት እና የባለጉዳዮች ሙሉ ፍላጎት የፍርድ ቤት መር ማስማመት የሚመራባቸው መርሆች ናቸው፡፡በመሆኑም ማንኛውም ሂደት በእኩልነት እና በባለጉዳዮቸ ሙሉ ፍላጎት ላይ ተመስርቶ መከናወን አለበት፡፡ሌላው መርህ ሚስጥራዊ ሲሆን በፍርድ ቤት አስማሚነት በኩል የሚደረግ ማናቸውም የሃሳብ ልውውጦች ሚስጥራዊነት የተጠበቀ ነው፡፡ እንዲሁም በማስማማት ሂደቱ ተከራካሪ ወገኖች የሚሰጡት የእምነት ቃሎች ወይም ማንኛውም ንግግሮች ለፍርድ ቤት በማስረጃነት አይቀርቡም፡፡ለዚሁም አስማሚው ማረጋጫ ይሰጣል፡፡
ስለአስማሚዎች እና ስለ ክፍያ
በአዋጁ መሰረት በአስማሚነት መስራት የሚችሉት የአስማሚነት ስልጠና ወስደው የፌደራል ጠቅላይ ፍርድ ቤት የሚያወጣውን ምዘና ያለፉ ቢያንስ በህግ የመጀመሪያ ዲግሪ ያላቸው እና ከአምስት ዓመት ያላነሰ ጊዜ በህግ ሙያ ያገለገሉ የህግ ባለሞያዎች ናቸው፡፡ ይህም የሚያመለክተው በፍርድ ቤት መር አስማሚነት ሂደት የሚሳተፉ አስማሚዎች በቂ የአስማሚነት ክህሎት ያላቸው እና ባለጉዳዮችን ወደ ስምምነት ለማምጣት የሚችሉ መሆን እንዳለባቸው ነው፡፡በመሆኑም ፍርድ ቤቱ እንደ አስፈላጊነቱ በቋሚነት ወይም በጊዜያዊነት ብቁ አስማሚዎችን ሊቀጥር

ጉዳዩ የቀረበለት የወረዳው ፍ/ቤትም የግራ ቀኙን ክርክር ተመልክቶ የጋብቻ ውሉ ሕጋዊ አይደለም በማለት አመልካች ያቀረቡትን ጥያቄ ተቀብሎ ንብረቶቹን የግራ ቀኙን የጋራ ስለሆኑ እኩል ይካፈሉ በማለት ወስኗል በዚህም ወ/ሮ ሀና በለስ የቀናቸው ይመስላል፤ ነገር ግን አሁንም ክርክሩ ከረር እያለ ሄደ የቀድሞ ባል አቶ አየለ ይህማ አይደረግም በማለት በውሣኔው ቅር በመሰኘት ይግባኝ ለዞን ከፍተኛ ፍ/ቤት አቀረቡ በዚህ ሂደትም እድል ከሳቸው ጋር አልነበረችም ይባስ ብሎ ይግባኙ የቀረበለት ፍ/ቤት የወረዳ ፍ/ቤት ውሣኔ ስህተት የለውም በማለት የይግባኝ ቅሬታውን ውድቅ አድርጎታል፡፡
አሁንም አቶ አየለ ተስፋ አልቆረጡም ሂደቱን በአልሸነፍ ባይነት ቀጠሉ ለክልሉ ጠቅላይ ፍ/ቤት ሁለተኛ ይግባኝ አቀረቡ ፍ/ቤቱ ግራ ቀኙን ካከራከረ በኋላ ግራ ቀኙ የንብረት ግንኙነታቸውን በተመለከተ አቶ አየለ ለቀድሞ ባለቤታቸው ለ/ወሮ ሀና በወር ከሚያገኙት ገቢ ውስጥ በዓመት ብር 120,000 (አንድ መቶ ሃያ ሺ) ሊከፍላት ከዚህ ውጪ ሌላ ንብረት ግንኙነት እንደማይኖር መስማማታቸው ሕጉን አይቃረንም በማለት ከመጋባታቸው በፊት አቶ አየለ የሠራውን ሆነ ወ/ሮ ሀና ከገባች ወዲህ ታድሷል የተባለውን ቤት እንድትካፈል መወሰኑ ተገቢ አይደለም በማለት የሥር ፍ/ቤትን ውሣኔ ሽሮ አመልካች ቤቱን ልትካፈል አይገባም በማለት ወስኗል በዚህ ጊዜ እድል ፊቷን ወደ አቶ አየለ አዙራለች ነገር ግን ሂደቱ ቀጥሏል…
እርስዎ ቀጣዩ የሰበር ችሎት ውሳኔ ምን ሊሆን ይችላል ብለው ያስባሉ? እንወያይ ሀሳብ አስተያየትዎን ያካፍሉን; እኛም ቀጣዩን የሰበር ውሳኔ ከእናንተ ሀሳብ አስተያየት በኋላ ይዘን የምንቀርብ ይሆናል በቀጣይ እስክንገናኝ ሰላም፡፡

ክርክሩ ጦፏል፤ የቀረበው ጉዳይ የጋብቻ ውልን የሚመለከት ነው፡፡ ወ/ሮ ሀና ጌታቸው እና አቶ አየለ ደሳለኝ አብሮ የመኖር ጊዜያችን እዚህ ላይ እንቋጭ በማለት ጋብቻቸው በፍቺ ከፈረሰ በኋላ የቀጠለውን የንብረት ክፍፍል በተመለከተ አመልካች ጥያቄያቸውን ለአንድ የወረዳ ፍ/ቤት አቅርበዋል ተጠሪም አቶ አየለም በመሃከላችን የጋብቻ ውል አለ በዚህም መሠረት አመልካችን ያገባኋት በአመት 120,000 /አንድ መቶ ሃያ ሺ/ ብር ልከፍላት ልብስ ከገዛው ከደሞዟ ሊታሰብ የሕክምና ወጪ ልሸፍን እንጂ በእኩል ባለመብት እንድትሆን አልተስማማሁም በማለት የቀድሞ ባለቤታቸው ንብረት ለመካፈል ያቀረቡትን ጥያቄ ተቃውመዋል፡፡

ከጋብቻ በፊትም ይሁን ከጋብቻ በኃላ ተጋቢዎች የነበሯቸው ንብረቶች የግል መሆኗቸው እስካልተረጋገጠ ድረስ የጋራ ነው ተብለው እንደሚገመቱ የቤተሰብ ህጉ ያስቀምጣል።በሌላ ሁኔታ ተጋቢዎች ንብረትን በተመለከተ የሚኖራቸው ግኑኝነት መስማማት እንደሚችሉ የሚገልፅ ሲሆን ስምምነታቸው የቤተሰብ ህጉ መሰረታዊ መርህ የተከተለና በፍርድ ቤት ቀርቦ መፅደቅ ያለበት ስለመሆኑ አንቀፅ 80 /1/ እና/2/ያሳያሉ። ስምምነታቸው በፍርድ ቤት ቀርቦ ሊፀድቅ ከተፈለገባቸው ምክነያቶች ዋነኛው ስምምነቱ የቤተሰብ ህጉ መሰረታዊ መርህ የተከተለ መሆን አለመሆንና ስምምነቱ የልጆችን መብት የማይነካ መሆኑ ለማረጋገጥ ነው።rule of equal partition አንዱ የቤተሰብ ህጉ መርህ መሆኑ በተጋቢዎች መሀከል የነበረ ንብረት የግል መሆኑ አንደኛው ተጋቢ እስካላረጋገጠ ድረስ የጋራ ነው ተብሎ መገመቱ እና ተጋቢዎች የጋራ ንብረታቸው እኩል የመካፈል መብት ከሚሉት ሁለት ድንጋጌዎች/መርሆች/መገንዘብ ይቻላል።በመሆኑም አሁን በያዝነው ጉዳይ በተጋቢዎቹ መሀከል ስምምነት ነበረ ቢባልም እንኳን ስምምነቱ የቤተሰብ ህጉ መርህ ያልተከተለ በመሆኑ ተቀባይነት ስለሌለው ንብረቱ ለተጋቢዎቹ እኩል እንዲካፈሉት መደረጉ አግባብ ነው ባይ ነኝ።...እጄ ላይ የቤተሰብ ህጉ ባለመኖሩ ሁሉንም ሀሳቤ በህግ/በአንቀፅ ስላላስደገፍኩኝ ይቅርታ!
