भारतीय दिवाला एवं दिवालियापन बोर्ड (आईबीबीआई) ने 19 मार्च 2019 को भारतीय प्रतिभूति एवं विनिमय बोर्ड (सेबी) के साथ एक सहमति पत्र (एमओयू) पर हस्ताक्षर किए। आईबीबीआई और सेबी दरअसल दिवाला एवं दिवालियापन संहिता, 2016 और इससे संबंधित नियम-कायदों पर कारगर ढंग से अमल किए जाने के पक्ष में हैं, जिन्होंने डेट एवं इक्विटी के आपसी ताल्लुकात को नए सिरे से परिभाषित किया है और जिनका उद्देश्य उद्यमिता एवं डेट मार्केट को बढ़ावा देना है। आईबीबीआई और सेबी ने सहमति पत्र के तहत संहिता के बेहतर कार्यान्वयन के लिए एक-दूसरे के साथ सहयोग करने पर सहमति जताई है। हालांकि, इस संबंध में लागू कानूनों द्वारा तय की गई सीमाओं को ध्यान में रखना होगा। उपर्युक्त एमओयू पर सेबी के कार्यकारी निदेशक श्री आनंद बैवर और आईबीबीआई के कार्यकारी निदेशक श्री रितेश कावडि़या ने मुम्बई में हस्ताक्षर किए।

जीएसटी काउंसिल ने 19 मार्च 2019 की बैठक में रियल एस्टेट सेक्टर के लिए की गई दरों में कटौती की व्यवस्था को लागू करने की योजना को मंजूरी दे दी है। बैठक के बाद मीडिया से बातचीत में राजस्व सचिव ए बी पांडेय ने कहा कि राज्यों से बातचीत कर डिवेलपर्स को नई व्यवस्था के तहत आने के लिए जरूरी समय मुहैया कराया जाएगा। उन्होंने कहा कि बिल्डर्स निर्माणधीन रिहायशी प्रोजेक्ट के लिए दो टैक्स स्लैब में किसी का चयन कर सकते हैं।

मोजाम्बिक में भयंकर समुद्री तूफान
दक्षिण अफ्रीकी देश मोजाम्बिक में आए भयंकर समुद्री तूफान से बड़ी तबाही मची है। एक हजार से ज्यादा लोगों के तूफान में मारे जाने की आशंका है। तूफान ने पड़ोसी जिम्बाब्वे में भी खूब तबाही मचाई है। वहां दर्जनों लोगों की मौत हो गई है और 150 से ज्यादा लोग लापता हो गए हैं। समुद्री तूफान इडाई को मोजाम्बिक के बेरा शहर में अपने साथ तबाही लेकर आया। तेज हवा और अचानक बाढ़ से जानमाल का काफी नुकसान हुआ है। बाढ़ का पानी अपने साथ हजारों घरों और सड़कों को बहा ले गया है।

IBBI, SEBI sign MoU for IBC
The Insolvency and Bankruptcy Board of India (IBBI) signed a Memorandum of Understanding (MoU) on 19 March 2019 with the Securities and Exchange Board of India (SEBI). The IBBI and the SEBI seek effective implementation of the Insolvency and Bankruptcy Code, 2016 (Code) and its allied rules and regulations, which have redefined the debt-equity relationship and aims to promote entrepreneurship and debt market. They have agreed under the MoU to assist and co-operate with each other for the effective implementation of the Code, subject to limitations imposed by the applicable laws. The MoU was signed by Shri Anand Baiwar, Executive Director, SEBI, and Shri Ritesh Kavdia, Executive Director, IBBI, at Mumbai.

As more frauds related to the Aadhaar-enabled Payment System (AePS) come to the fore, the Unique Identification Authority of India (UIDAI), has turned to artificial intelligence-based systems in a bid to limit the cases — this includes developing technologies around fingerprinting and facial recognition. The UIDAI has rolled out an in-house Artificial Intelligence/Machine Learning technology-based Finger Minutiae Record – Finger Image Record (FMR-FIR) modality which is able to check the liveness of a fingerprint to detect the use of cloned fingerprint during the authentication process.
How does the Aadhaar fingerprint technology work?
The technology was rolled out in February this year and uses a combination of both finger minutiae and finger image to check the liveness of the fingerprint captured.
The measure was implemented after instances of people creating fake fingerprints using silicone to syphon off money from unsuspecting individuals’ bank accounts were reported.
The problem gets compounded on account of the fact that a large part of the AePS user base is in rural areas.
In effect, the AI-based technology is able to identify whether the fingerprint is from a real, or ‘live’ finger, or a cloned one.
Payment frauds on the rise
According to the Home Ministry, in the financial year 2020-21, 2.62 lakhs financial crimes, such as money laundering, bribery, corruption and different kinds of frauds, were reported. The number jumped to 6.94 lakhs in 2022, a report, released by the Standing Committee on Finance — headed by BJP MP Jayant Sinha — said.
Citing data it received from the supervised entities of the Reserve Bank of India (RBI), the committee noted that payment-related frauds are on the rise in India – In FY21, the volume of such frauds was a little over 700,000, which by FY23, increased to close to 20 million.
According to the information submitted to it by the Indian Cyber Crime Coordination Centre (I4C), in the year 2022, out of 6,94,424 complaints related to financial frauds only in 2.6 per cent of cases an FIR was registered.
The details shared with Parliament revealed that between November 2021 and March 2023, more than 2,000 complaints related to AePS were received by the offices of the RBI’s ombudsman.

There are broadly two circumstances under which entities — both government and private — can process an individual’s personal data: (i) There has to be clear consent for such processing; and (ii) for certain “legitimate uses”.
When an entity is processing your personal data for which you have consented, it has to be accompanied by a notice, which is to be made available in all 22 languages of Schedule 8 of the Constitution.
You can directly consent to businesses, and the government can process your personal data, or alternatively use a consent manager.
What happens to your personal data that was collected before this law came into existence?
Any entity that has collected a person’s personal data before the Act came into being should give her a notice about the personal data in its possession “as soon as it is reasonably practicable”.
The notice should include:
The personal data an entity is processing and the purpose for such processing;
The way in which a user can withdraw their consent;
The means of grievance redressal
However, the contents of this notice have been significantly diluted from previous iterations of the many data protection Bill drafts in the last five years.
For instance, the Act doesn’t require companies to state the duration for which they will store personal data, if it will be shared with third-parties, and if it will be sent to a foreign jurisdiction.
There are exemptions to consent requirements as well:
The Act says that the government can exempt itself and its instrumentalities from adhering to any and all provisions of the law that relate to processing of personal data.
Will your rights be restricted in any way?
Broadly, there are three major roadblocks that impose restrictions, or limit the rights prescribed in the provisions of the law from applying to individuals. These are as follows:
Government exemptions: In the interest of national security, friendly relations with other governments and public order among others, many of the provisions of the Act, including rights afforded to citizens will no longer be applicable.
The way we have prepared the law, it has adequate safeguards for citizens. A lot of the fear against the government’s power comes from citizens’ experience with previous governments. But that is not the case today. People have a lot of trust in our government, IT Minister Ashwini Vaishnaw said.
Processing of data for legitimate uses: Neither the government nor private companies need to seek informed consent from citizens for certain legitimate uses.
For the government, this includes processing personal data for offering subsidies and certificates, responding to a medical emergency, for national security, and during natural disasters.
Private entities can assume consent when an individual has not expressly denied her consent.

Recently, India notified its personal data protection framework as a law, signalling the beginning of a new era of privacy legislation in the country. Provisions of the Digital Personal Data Protection Act, 2023 will come in force in a few months, after the Centre has allowed enough transition time to the industry, with users of these platforms — you — experiencing several new notices and rights, as prescribed in the law.
