የከተማ ፍርድ ቤቶች የፌዴራል ፍርድ ቤቶች አዋጅ ቁጥር 1234/2013 በስራ ላይ ሲውል ስልጣንና ሀላፊነታቸውን በማሻሻል ብቅ ብሏል፡፡ ይህ ጽሑፍ እነዚህ የከተማ ፍርድ ቤቶች ምን አይነት አዲስ ስልጣን ተጨመረላቸው?፣ በፍትሐብሔር እና በወንጀል ጉዳዮች ሥልጣናቸው እስከምን ድረስ ነው? እና በተጨመረላቸው ስልጣን ምክንያት የስራ ጫና ሊኖር ስለሚችል ምን አይነት ዝግጅት ማድረግና በህዝብና በተገልጋዩ ማህበረሰብ አመኔታ ያላቸው ፍርድ ቤቶች ለመሆን ምን ማድረግ ይጠበቅባቸዋል የሚሉትን በአጭሩ ያስዳስሰናል፡፡

የወራሽነት ምስክር ወረቀት (certificate of heir)

የወራሽነት ምስክር ወረቀት(certificate of heir) ምንድነው?

# የወራሽነት ምስክር ወረቀት በአጭሩ ለመግለጽ ህጋዊ የውርስ ስርዓት ለሟላ የሟች ወራሽ ለሆነው ሰው የሟቹ ወራሽ መሆኑንና ከውርሱ የሚገባውን ድርሻ በተመለከተ ስልጣን ባለው ፍርድ ቤት ተረጋግጦ የሚሰጥ የጽሁፍ ማረጋገጫ ነው ለማለት ይቻላል።

ወራሽ የሆነው ሰው ከውርሱ የሚያግኘውን ድርሻ የሚያመለክት የወራሽነት ምስክር ወረቀት እንዲሰጡት ዳኞችን ለመጠየቅ እንደሚችል የፍ/ህግ 996(1) ይደነግጋል።ከፍርድ ቤት የወራሽነት ምስክር ወረቀት መያዝ በወራሹ ሲጠየቅ የሚሰጥ እንጂ ህጉ ሟችን ለመውረስ የግድ ከፍርድ ቤት የወራሽነት ማስረጃ ማውጣት እንዳለበት የሚያስገድድ አይደለም።
በዚህ ጉዳይ የፌ.ጠ.ፍ/ቤት ሰበር ሰሚ ችሎት ቅጽ 22 መ/ቁ 130284 ለይ በሰጠው አስገዳጅ የህግ ትርጉም የውርስ ሰርተፊኬት አንድ ሰው የራሱን ወራሽነት ለማስረዳት የሚወስደው ማስረጃ እንጂ ሌሎች ወራሾች አለመኖራቸውን የሚያሳይ ሰነድ ስላለመሆኑ፣ እና በግራ ቀኙ የሟች ወራሾች መሆናቸው በማረጋገጥ ፍርድ ቤቶች የሰጡት ውሳኔ ከማስረጃነት በዘለለ የፍ/ብ/ስ/ስ/ህግ በሚያዘው መሰረት ከሌሎች ሰዎች ክርክር ተደርጎበት ውሳኔ ያገኘና በፍርድ ያለቀ መቃወሚያ የማይቀርብበት ተደርጎ ሊወሰድ የማይገባ ስለመሆኑ ትርጉም ተሰጥቶበታል።በተመሣሣይ መልኩ በፌ.ጠ.ፍ.ቤት ሰበር ሰሚ ችሎት ቅጽ14 መ/ቁ 73247 አንድ ወራሽ የወራሽነት መብት በሌለው ንብረት ላይ ከህግ ውጪ የወራሽነት ሠርተፍኬት መያዙ በተረጋገጠ ጊዜ ይኸው ማስረጃ እንዲሰረዝ አቤቱታ ሊቀርብ እንደሚችል አስገዳጅ የህግ ትርጉም ተሰጥቶበታል።
#በመሠረቱ የመወረስ መብት የሚገኘው በህግ ወይም በኑዛዜ ሲሆን ፍ/ቤት አስቀድሞ ለአመልካቹ ያለውን የውርስ መብቱ አረጋግጦ የሚሰጥ እንጂ ለአመልካቹ የውርስ መብትን የሚስጥ አይደለም።በፌ.ጠ.ፍ/ቤት ሰበር ሰሚ ችሎት ቅጽ 20 መ/ቁ 113529 ለይ በተሰጠው አስገዳጅ የህግ ትርጉም ለአንድ ውርስ ወራሽ የሆነ አንድ ሰው ውርስ ከተከፈተ ቡሃላ የሞተ እንደሆነ የወራሽነት ማረጋገጫ የምስክር ወረቀት ባያወጣም ለውርሱ አይገባም እስካልተባለ ድረስ የወራሸነት መብቶች ለእርሱ ወራሾች የሚተላለፍ ስለመሆኑ የህግ ትርጉም ተሰጥቶበታል። የወራሽነት ሰርትፍኬት አስገዳጅ የሆነ ህጋዊ ውጤት ይኖረዋል።
# የወራሽነት ምስክር ወረቀት የያዘው ወራሽ የምስክር ወረቀቱ እስካልተሰረዘ ድረስ ህጋዊ የውርስ መብት እንዳለውና ከውርሱ ድርሻ የሚገባ እንደሆነ ተደረጎ ይቆጠራል።አሁን በተግባር ባለው ሁኔታ የወራሽነት ምስክር ወረቀት አንደ ሰው ከያዘ ቡሃላ ወራሹ በሰርተፍኬቱ መሠረት ህጋዊ ውጤት ያላቸውን(valid juridical acts) ተግባራት መፈጸም ይጀምራል ማለትም ስመ ንብረት የማዞር ከባንክ ገንዘብ የማውጣትና ሌሎች መብቶች ማከናወን ይችላል ማለት ነው።የውርስ ሰርተፍኬት ውርሱ ከመጣራቱ በፊት ነው ወይስ የውርስ መጣራቱ ሂደት ከተጠናቀቀ ቡሃላ ነው ሊሰጥ የሚገባው የሚለው ጥያቄ አከራካሪ ሲሆን ይታያል የውርስ ማጣራት ሂደት ከመጠናቀቁ በፊት የሚሰጠው ምስክር ወረቀት ህጋዊ ወራሾች ከመለየታቸው በፊት እና ከማነኛውም እዳ ነጻ የሆነ የውርስ ንብረት ተጣርቶ ባልተለየበት ሁኔታ የሚሰጥ በመሆኑ አግባብነቱ አጠያያቂ ይሆናል በዚሁ ጉዳይ ለይ የፌ.ጠ.ፍ/ቤት ሰበር ሰሚ ችሎት ቅጽ18 መ/ቁ110022 በሰጠው ውሳኔ ፍ/ቤቶች የወራሽነት ማስረጃ ወይም የምስክር ወረቀት ብቻ አንዲሰጡ ማመልከቻ ሲቀርብላቸው ውርስ እንዲጣራ የሚሰጡት ትእዛዝ የማይገባና አላስፈላጊ ስለመሆኑ ትርጉም ሰጥቶት እናግኛለን።

The Corporate Lawyer is responsible and accountable for ensuring that the 54 FMCG Group 

Companies’ business strategies, policies, and programs are developed and applied in full 

recognition of legal implications and risks.

The Corporate Lawyer makes sure that the Group Companies are complying with the 

applicable laws and regulations of the land (as well as international laws where applicable) and 

works with all stakeholders to make sure they and their teams understand and respect the laws. 

He/she is protecting the company interests and assets and provides legal advice and actions 

in relation to legal cases, litigations and third-party management.


DUTIES AND RESPONSIBILITIES:

The principal duties and responsibilities of the Corporate Lawyer (Group Legal Advisor) are:

Consult and handle all corporate legal processes in regards to, including but not limited to: mergers & acquisitions and other corporate transactions, intellectual property, compliance issues, commercial transactions, contracts and agreements, lawsuits and litigations, other legal matters, etc.;

Develop and continuously improve the Group policy and position on legal issues (Legal Manual);

Research, anticipate and protect the Group Companies against legal risks;

Advise and guide the Group Executive Team, managers and employees to ensure compliance awareness and practical compliance with rules and regulations;

Structure, draft and review reports, legal documents, legal letters, etc.;

Represent the Group Companies interests in legal proceedings (administrative boards, court hearings and litigations, arbitration, etc.);

Draft, review and administer all contracts and agreements;

Consult and assist stakeholders in negotiating the deals;

Liaise with government offices and agencies

Job Requirements:

COMPETENCIES: 

Excellent knowledge of the Substantive and Procedural laws and legal frameworks of Ethiopia and practical knowledge of international laws.

Commercial and Business awareness

Advocacy aptitude and experience

Excellent negotiation and communications skills (in English and Amharic)

Analytical ability and strong attention to detail

Active contributor to the development of the desired organizational culture
