የክስ ምክንያት ምንድነው?🇪🇹

ለጥያቄው ምላሽ የሰበር ችሎት በ 6 መዝገቦች ላይ እንደሚከተለው የህግ ትርጓሜ ሰጥቷል።

1/ አንድ ሰው አንድን ነገር ከአንድ ሰው ላይ ለማግኘት ፍ/ቤቱ እንዲወስንለት ክስ ለማቅረብና ዳኝነት ለማግኘት የሚያስችለው የፍሬ ነገር ሁኔታ

ማንም ሰው በህግ ችሎታ ኖሮት በሌላ ሰው ላይ ማናቸውንም ክስ ለማቅረብ እንዲችል አስቀድሞ ለክሱ መነሻ በሆነው ነገር ወይም ክሱ በተመሠረተበት ነገር ላይ ጥቅም ወይም መብት ያለው መሆኑ መረጋገጥ እንደሚገባው የፍ/ብ/ሥ/ሥ/ሕ/ቁ. 33 ይደነግጋል፡፡ በዚህም ከሣሽ ከተከሣሽ ላይ ሊፈፀም የሚችል መብት አለኝ ብሎ ለማለት አስቀድሞ ለመብቱ መገኘት መነሻ የሆነውን ነገር በማረጋገጥ የተጠየቀውን ዳኝነት ለማግኘት ከሣሹ በሕግ መብት ያለው መሆን ይኖርበታል፡፡
የክስ ምክንያት አለ ብሎ ለመወሰን የሚቻለው በክሱ ላይ የቀረበው ነገር ቢረጋገጥ ከሣሹ የጠየቀውን ዳኝነት ለማግኘት ሕግ ይፈቅድለታል ወይ? ለሚለው ጥያቄ አዎንታዊ ምላሽ መስጠት ሲቻል ነው፡፡

2/ ሻጭ ከሽያጭ ውሉ በሚመነጭ ግዴታ የተሸጠውን ነገር ስመ ሀብትነት በሚመለከተው ክፍል ቀርቦ ለማዛወር እንደገባው ግዴታ ይፈጽምልኝ የሚል ክስ የክስ ምክንያት አለው፡፡

3/ አንድ ክስ ሊቀርብ የሚገባው የክስ ምክንያት ሲኖረው ሲሆን የክስ ምክንያትም ተከሣሽ ለከሣሽ ሊፈጽመው የሚገባው ግዴታ መኖሩ ጋር ተያይዞ ሊነሣ የሚችለውን ጥያቄ አዎንታዊ ምላሽ መስጠት የሚቻልበት ሁኔታ ስለመኖሩ ሲረጋገጥ የሚታወቅ ነው፡፡

በፍ/ብ/ሕ/ሥ/ሥ/ቁ. 231 ላይ እንደተመለከተው ማንኛውም ፍርድ ቤት የክስ አቤቱታ ሲቀርብለት ተከሣሽ የሆነው ወገን ክሱን እንዲከላከል ከመጥራቱ በፊት ከሳሽ ክሱን ለማቅረብ የሚያስችል መነሻ ምክንያት ያለው ስለመሆኑና ፍ/ቤቱም አቤቱታውን ተቀብሎ ለማየት ስልጣን ያለው ስለመሆኑ መመርመር ይኖርበታል፡፡

5/ አንድ ሰው በተለያዩ ምክንያቶች በአባቱ ብቻ ሳይሆን በአሳዳጊው ስም ጭምር ሊጠራ የሚችልባቸው አጋጣሚዎች መኖራቸው የሚታወቅ ሲሆን እንዲህ ዓይነቱ ሰው ተገቢ ሆኖ ባገኘው ጊዜ በአሳዳጊው ስም ጭምር መጠራቱ ቀሪ ሆኖ በፍትሐብሔር ሕጉ መሰረት በአባቱ ስም ብቻ እንዲጠራ የመወሰን መብት ያለው በመሆኑ ይህንኑ መብቱን በፍርድ ለማረጋገጥ የሚያቀርበው የዳኝነት ጥያቄ የክስ ምክንያት የለውም የሚባልበት ሕጋዊ ምክንያት አይኖርም፡፡

The legal and corporate affairs head is responsible for developing and leading corporate legal strategy to promote and protect the company’s interests. Gashe Yohannes Heroui (1940-2011) was a teacher, judge, and legal scholar. He is widely considered by many of his colleagues and seasoned lawyers who knew or worked with him as one of the greatest Ethiopian jurists with immeasurable integrity. He was extremely generous, selfless, greatly liked and respected by all those who knew him in his personal life us well. This financial scholarship is, therefore, in memory of his commitment and achievements to the Ethiopian legal system.
This financial scholarship is available only for law students who are currently pursuing their undergraduate program in any university. The principal aim of this scholarship program is to offer financial support to current undergraduate law students and to encourage qualified students to continue their studies.

The application letter, a maximum of two pages, should specifically discuss three evaluation criteria: financial need, academic achievements, and career goals. Additional information on recent research projects, off-campus and on-campus activities and accomplishments, and educational plans that would aid the Financer in reaching his decision can also be included.

Job Description

Purpose of the job

The legal and corporate affairs head is responsible for developing and leading corporate legal strategy to promote and protect the company’s interests. The legal head is also responsible for providing accurate and timely counsel to the company in a variety of legal topics (labor law, partnership, corporate, etc.) and for promoting, implementing, and maintaining an organizational culture that encourages ethical business conduct and compliance with the law, the legal and regulatory requirements of the country and the Group’s code of conduct.

Main duties & responsibilities

Advising the Board of Directors and other members of the executive management of the impact on the activities and proposed activities of the company of proposed local, state, and federal laws and regulations and judicial and administrative decisions.

Assessing the merits of major court cases filed against the company and approves, with the advice of the appropriate function head, settlement of such court where warranted.

Providing accurate and timely counsel to the company in a variety of legal topics (commercial law, mergers, and acquisitions, corporate, etc.)

Providing legal consulting in policy development and training about prevention.

Developing and leading corporate legal strategy to promote and protect the company’s interest

Overseeing the delivery of legal service and resources to accomplish corporate goals strategies and priorities.

Participating in the formulation of general management policy as a member of the executive management team.

Managing other members of the legal section.

Overseeing the development or implementation of compliance-related policies and procedures throughout the company.

Overseeing the performance of the retention lawyers and related legal proceedings.

Representing the company in pursuing any legal proceeding.

Ensuring that the legal affairs of the firm are securely maintained for the required time period

Maintaining current knowledge of alteration in legislation

Ensuring that the company carries its commercial activities in full compliance with all national and international laws, regulations, and directives as well as internal (Group) policies, Codes, and guidelines.

Developing and supervision control system with a view to prevent or address a violation of laws, regulations, and guidelines.

Overseeing the periodic review of contracts, policies, and other legal documents of the company to ensure compliance with regulatory and group standards.

Overseeing the periodic review of national, regional, and international laws, procedures, and guides as well as reports with an eye to the hidden risk of non-compliance

Directing the communication of compliance-related issues with employees across all divisions of the organization and address all concerns they may have about legal, ethical, or compliance matters.

 Defining and developing the approach for the mandatory compliance training in collaboration with the training teams.

Overseeing the preparation publication and distribution of authorized commercial partners to achieve clarity o commercial compliance requirements.

Job Requirements

Broad and thorough knowledge of the compliance and ethics profession, theories, and standards.

Expert knowledge of professional compliance and investigation standards; and ability to apply policy and legal concepts to issues.

Commitment to the highest ethical and professional standards.

Excellent written and oral communication skills.

Ability to communicate complex information to all levels of management and administration in a clear and concise manner both written and verbal.

 Ability to work independently and within a team environment.

Ability to share information and build consensus across stakeholders.

Ability to supervise support and professional analyses functions for compliance and ethics programs.
Ability to establish trust and credibility with stakeholders and senior management.

Knowledge of the Group’s ethics and compliance policies, procedures, and programs.

Expected Education and Experience

BA Degree in law or related fields.

12 years of experience of which at least 5 years in a managerial post in the areas of corporate law
