ንብረት ለማስመለስ በቀረበ ክስ ላይ ንብረቱ የሚመለስ ከሆነ ተከሳሽ በንብረቱ ላይ ያፈሰሰውን ሀብት /ያወጣውን ወጪ/ መጠየቅ የሚችለው በተከሰሰበት መዝገብ ተገቢውን ዳኝነት ከፍሎ የተከሳሽ ከሳሽነት ክስ /ወይም ሌላ አዲስ ክስ/ በማቅረብ እንጂ በመከላከያ መልሱ ላይ በሚያቀርበው መከራከሪያ አይደለም፡፡

መስቀለኛ ይግባኝ ስለሚስተናገድበት ስርዓት በሕጉ በተለየ ሁኔታ በግልጽ የተመለከተ ነገር እስከሌለ ድረስ በፍ/ብ/ሥ/ሥ/ሕ/ቁ. 337 እና 338 ድንጋጌዎች የተመለከተው የክርክር አመራር ስርዓት ለመስቀለኛ ይግባኝም በተመሳሳይ ሁኔታ ተፈጻሚነት የሚኖረው በመሆኑ በፍ/ብ/ሥ/ሥ/ሕ/ቁ. 340(2) በተመለከተው መሰረት መልስ ሰጪው ወገን የሚያቀርበው የይግባኝ ማመልከቻ ግልባጭ በፍ/ብ/ሥ/ሥ/ሕ.ቁ. 338 መሰረት ለይግባኝ ባዩ እንዲደርስ ሊደረግ የሚችለው ይግባኙ በፍ/ብ/ሥ/ሥ/ሕ/.ቁ. 337 መሰረት ያልተሰረዘ በሆነ ጊዜ ብቻ ነው፡፡ በመሆኑም መልስ ሰጪው ወገን ያቀረበው የይግባኝ አቤቱታ ከተሰማ በኋላ የሌላኛውን ወገን ክርክር መስማት ሳያስፈልግ ይግባኙ በፍ/ብ/ሥ/ሥ/ሕ/ቁ. 337 መሰረት እንዲሰረዝ የሚሰጥ ትዕዛዝ በፍ/ብ/ሥ/ሥ/ሕ/ቁ. 340(2) የተመለከተውን የክርክር አመራር ስርዓት የሚቃረን ነው ለማለት አይቻልም፡፡
