Legal Officer, Human Rights Commission

Project Expedite Justice (PEJ)

Founded in 2016, Project Expedite Justice (PEJ) assists survivors of atrocities and serious human rights abuses in seeking justice through all available legal mechanisms. Our three-step model consists of (1) training local organizations in internationally recognized standards of evidence collection, (2) action learning through peer mentoring, and (3) providing independent legal consulting. This model is adaptable and can be applied in conflict and post-conflict situations and to a range of criminal matters and serious human rights abuses. We partner with local organizations that share our mission and goals, and we work side by side with them to empower local communities, identify and link the perpetrators to the crimes or human rights violations, and ultimately, dismantle criminal networks.

Program Description

Launched in 2020, PEJ’s project “Protecting Human Rights and Promoting Justice in Ethiopia through Evidence Collection and Documentation” aims to increase justice and accountability for serious human rights abuses in Ethiopia and improve human rights protection and observation over the next three-years. Specifically, PEJ will work closely with civil society organizations, lawyer associations, human rights defenders, and the Ethiopian Human Rights Commission to build capacity on evidence collection and preservation, as well as case strategy and advocacy. Specific program objectives are:  1) Increased capacity of these groups to investigate, document, and report serious human rights abuses in line with international standards for evidence collection and preservation; 2) increased capacity of groups to pursue accountability measures for serious human rights abuses in relevant legal and non-legal fora; 3) increased coordination and cooperation between civil society organizations and the Human Rights Commission to monitor, document, and report on serious human rights abuses.

Duties and deliverables

The Legal Officer will work closely with the Senior Investigator Lawyer in the Human Rights Commission to provide support on case development and strategy. The Legal Officer will also support the Senior Investigator Lawyer in developing training materials and conducting trainings. Finally, the Legal Officer will also provide support to the Senior Investigator Lawyer on mentoring and advising investigators in the Human Rights Commission. The Legal Officer will also coordinate with the PEJ Ethiopia field office to provide updates on cases and discuss strategy. The Legal Officer will also be responsible for the following duties:

Conducting research and drafting legal analysis memoranda on a variety of issues

Conducting legal analysis and drafting legal documents

Work closely with Human Rights Commission investigators to map evidence and develop case strategies

Develop training materials and implement trainings to Human Rights Commission investigators.

Provide mentoring and advising support to Human Rights Commission investigators.

Providing assistance with case management and document review.

Duration: 18 months, 3 months probation period

Compensation: Commensurate with experience

#Job Requirements:

Qualifications

Law degree and currently a qualified lawyer

#A minimum of 3-4 years of legal experience in public international law, including international criminal law and human rights law. Human rights litigation experience considered a plus.

Experience in developing and implementing advocacy strategies on human rights issues

Experience working in an NGO

Experience in drafting legal memoranda and legal documents

Experience in evidence analysis and preserving evidence

Experience assisting in advising and mentoring investigators and lawyers

አቤቱቱታ ስለ ማሻሻል - የፍትሐ ብሔር ሥነ-ሥርአት ህግ ቁጥር 91

አቤቱታ ማለት ለፍርድ ቤት የሚቀርብ ክስ/መልስ/ይግባኝ/ወይም ሌላ ማንኛውም አይነት አንድ ባለ ጉዳይ ከፍ/ቤት የሆነ ዳኝነት እንዲወሰንለት በመጠየቅ የሚያቀርበው ማመልከቻ ነው፡፡

አቤቱታ ላይ ያቀረበው ሰው የሚጠየቅው ዳኝነት እና ይህንን ዳኝነት ሊያገኝ የሚገባውን ጉዳይ አብራርቶ መጠየቅ ያለበት ሲሆን ክስ ከቀረበ በኋላ ወይም ጉዳዩ ከጀመረ በኋላ በአቤቱታው ላይ መገለጽ የነበረበት እና አለመገለጹ ባለ ጉዳዩን የሚጎዳ፤ ትክክለኛ ውሳኔ እንዳይሰጥ ሊያደርግ የሚችል እና ለፍትህ አሰጣጥ የሚስቸግር ከሆነ ባለ ጉዳዩ ይህንን አቤቱታ አሻሽሎ ወይም የተጓደለውን አሟልቶ እንዲያቀርብ እንዲፈቀድለት ለፍ/ቤት ሊያመለከት ይቻላል፡፡

አቤቱታ ሲሻሻል ነገሩን በይበልጥ ወይም በተሻለ መንገድ ማብራራት እንጂ በመጀመሪያው ዳኝነት ላይ ያልተጠየቀ እና ፈጽሞ የተለየ ጉዳይ ወይም ዳኝነት ይፈጸምልኝ የሚል ጥያቄ ማቅረብ አይቻልም፡፡

ልጅነት ስለማረጋገጥ

በተሻሻለው የቤተሰብ ሕግ አዋጅ ቁጥር 213/92 አንቀጽ 154 መሠረት በአባት ወይም በእናትነት በኩል ያለ የአንድ ሰው ልጅነት የእከሌ ልጅ ነው/ናት የሚል የልደቴ ሰርተፍኬት በማቅረብ ይረጋገጣል፡፡ ነገር ግን የልደት ሰርተፊኬት ከሌለ የልጅነት ሁኔታ መኖሩን በማስረዳት ሊረጋገጥ ይችላል፡፡ (አንቀጽ 155) የልጅነት ሁኔታ ማለት አንድ ሰው በሚኖርበት ማህበረሰብ ውስጥ የእርሱ ወይም የእርሷ ልጅ ነው እየተባለ የሚገመት እንደሆነ ነው፡፡ ስለዚህ ልጅነት ማረጋገጥ የፈለገ ሰው በዚህ መሠረት የሚያስረዱለትን/የሚመሰክሩለትን የሰው ምስክሮች በማቅረብ ልጅነቱን ሊያረጋግጥ ይችላል፡፡
ልጅነት ማረጋገጥ አስፈላጊ የሚሆነው አንድ ሰው በአሳዳጊ ወይም በሌላ ሰው ስም ሲጠራ ቆይቶ የአባቱን ስም ወደ ትክክለኛ የወላጅ አባቱ ለመቀየር የፈለገ እንደሆነ፤ ከአባት/እናት በኩል የሚገኝ ውርስ ለማግኘት ወራሽነት ለማረጋገጥ/ ለማግኘት ልጅነት ማረጋገጥ አስፈላጊ ሆኖ ከተገኘ፤ የልደት ሰርተፊኬት ለማውጣት እና ውልደቱ በወቅቱ በወሳኝ ኩነቶች ወይም ሌላ ስልጣን ባለው የክብር መዝገብ ሹም ፊት ሳይመዘገብ ቀርቶ የፍርድ ቤት ውሳኔ እንዲያቀርብ የተጠየቀ እንደሆነ ሊሆን ይችላል፡፡
ልጅነት ለማረገጥ ለፍርድ ቤት የሚቀርብ አቤቱታ ከዚህ በታችን በተገለጸው ፎርም የሚቀርብ ሲሆን አባት/እናት በህይወት ካሉ ተጠሪ ሊደረጉ የሚገባ ሲሆን በህይወት ከሌሉ ግን ይህንን በመግለጽ ተጠሪ የለም ብሎ በመጻፍ ሊቀርብ ይችላል፡፡ የሚቀርብበትን ፍ/ቤት አድራሻ በተመለከተ አባት ወይም እና ካሉ እና ተጠሪ ከተደረጉ እነርሱ በሚኖሩበት ክ/ከተማ ባለው የፌደራል ፍ/ቤት ሲሆን አባት እና/ወይም ከሌሉና ተጠሪ ማንም ካልተደረገ አመልካቹ በሚኖርበት ክ/ከተማ ነው፡፡

ሀገራት የሚከተሉት የኢኮኖሚ ሥርዓት የነፃ ገበያ ኢኮኖሚ ወይም የዕዝ ገበያ ኢኮኖሚ ስርዓት በዋናነት የሚጠቀስ ስሆን ሁለቱንም የገበያ ኢኮኖሚ ባማከለ መልኩ የቅይጥ ገበያ ኢኮኖሚ ሥርዓትም ተጠቃሽ እንደሆነ ከተለያዩ ፅሁፎች መረዳት ይቻላል፡፡ የነፃ ገበያ ኢኮኖሚ ሥርዓት ለመገንባት የንግዱን ህብረተሰብ ከፀረ-ውድድር እና ተገቢ ካልሆኑ የገበያ ተግባራት እንዲሁም ሸማቹን ከሚያሳስቱ የገበያ ሁኔታዎች የሚከላከል ሥርዓት መዘርጋት እና ለነፃ ገበያ ውድድር አመቺነት ያለው ሥርዓት ማስፈን አስፈላጊ መሆኑ ይታመናል፡፡
የንግድ እንቅስቃሴዎች ማደግን ተከትሎ የሸማቾችን ጤንነትና ደህንነት አደጋ ላይ የሚጥሉ የንግድ ዕቃዎችንና አገልግሎቶችን መስፋፋት ለመግታት እንዲቻልና ተጠቃሚዎች ላወጡት ዋጋ ተመጣጣኝ የሆኑ የንግድ ዕቃዎችና አገልግሎቶች ማግኘት የሚችሉበትን ሁኔታ ማመቻቸት ያስፈልጋል፡፡

እነዚህ ከላይ የተጠቀሱት እና ሌሎች ምክንያቶች ተደማምረው የንግድ ውድድር እና የሸማቾች ጥበቃ አዋጅ ቁጥር 813/2006 ታውጇል፡፡
የንግድ ውድድርና የሸማቾች ጥበቃን ስናስብ ነጋዴዎች እና ሸማቾች የገበያው ተዋንያን በመሆናቸው በዋናነት በተዘረጋው ሥርዓት መሠረት ሊኖራቸው የሚገባ መብትና ግዴታዎቻቸውን በቅጡ ሊያውቁት ይገባል፡፡

ስለ ነፃ ገበያ ምንነት
የኢኮኖሚ ስርዓት ፅንሰ ሀሳብ ዝጅግ ሰፊና ለመተንተንም ጥልቅ የሆነ የኢኮኖሚክስ ዕውቀት የሚጠይቅ ቢሆንም ለዚህ ፅሁፍ ዓላማ ሲባል መነሻ የሚሆን ቀላልና አጠር ያለ ሀሳብ ከማንሳት ግን የሚገድብ አይደለም፡፡

ዓለማችን የምትመራባቸው ሶስት የኢኮኖሚ ሥርዓቶች ሲኖሩ አነሱም፡- የነፃ ገበያ ኢኮኖሚ፣ የዕዝ ገበያ ኢኮኖሚና የቅይጥ ገበያ ኢኮኖሚ በመባል ይታወቃሉ፡፡ የነፃ ገበያ የኢኮኖሚ ስርዓት ማለት ገበያው ያለመንግስት ጣልቃ ገብነት እራሱን በራሱ የሚመራበት ስርዓት ማልትም ነጋዴዎች መንግስት በሚያወጣላቸው ዕቅድና መመሪያ ሳይሆን በተጨባጭ በገበያ ላይ ባለ ፍላጎትና አቅርቦት መሰረት መስራት የሚያስችላቸው ስርዓት ነው፡፡ የእዝ ገበያ የኮኖሚ ስርዓት የሚባለው ሀገራችን በደርግ ዘመነ መንግስት ትከተለው የነበረ የኢኮኖሚ ስርዓት ሆኖ ገበያው የሚመራው በፍላጎትና አቅርቦት ኃይሎች ባለ ነፃ መስተጋብር ሳይሆን ሙሉ በሙሉ የመንግስት ጣልቃ ገብነት ኖሮበት የሚመራ የገበያ ስርዓት ነው፡፡ የቅይጥ ገበያ የኢኮኖሚ ስርዓት የሚባለው ደግሞ የነፃ ገበያና የዕዝ ኢኮኖሚ የገበያ ስርዓቶች ድብልቅ ሆኖ ሁለቱም አካላት የየራሳቸው ሚና መጫወት የሚያስችል የገበያ ምህዳር ሲኖር ማለት ነው፡፡

ከአዋጁ መግቢያ መገንዘብ እንደሚቻለው ሀገራችን ኢትዮጵያ የምትመራው በነፃ ገበያ የኢኮኖሚ ስርዓት ነው፡፡ የነፃ ገበያ የኢኮኖሚ ስርዓት ትከተላለች ማለት ግን የንግዱን ዘርፍ ልቅ መተው ማለት አይደለም፡፡ የሀገር ኢኮኖሚ አደጋ ላይ እንዳይወድቅና ሸማቹ ማህበረሰብ እንዳይጎዳ ቁጥጥርና ወጥ የሆነ ስርዓት ማበጀት ከመንግስት በእጅጉ ይጠበቃል፡፡

ስለሸማቾች ጥበቃ እና ስለንግድ ዕቃዎችና አገልግሎቶች ስርጭት
የሸማች መብቶች (አን. 14)
ሸማች ማለት ለማምረት ሥራ ወይም መልሶ ለመሸጥ ሳይሆን ዋጋዉን ራሱ ወይም ሌላ ሰዉ የሚከፍልለት ሆኖ ለራሱ ወይም ለቤተሰቡ ፍጆታ የሚሆን የንግድ ዕቃ ወይም አገልግሎት የሚገዛ የተፈጥሮ ሰው ነው (አን. 2(4))፡፡ ማንኛውም ሸማች እንደ ሸማች የተለያዩ መብቶች በአዋጁ መሠረት የተቀመጠ ሲሆን እኚም መብቶች፡- መረጃ ወይም መግለጫ የማግኘት፣ አማርጦ የመግዛት፣ እንዲገዛ ያለመገደድ፣ በአክብሮት የመስተናገድ እና ካሣ እንዲከፍሉት የመጠየቅ ናቸው፡፡

ሀ. መረጃ ወይም መግለጫ የማግኘት መብት፡- ማንያውም ሸማች ስለሚገዛው ዕቃ ወይም አገልግሎት ጥራትና አይነት አስመልክቶ በቂና ትክክለኛ መረጃ ወይም መግለጫ የማግኘት መብት አለው፡፡
ለ. አማርጦ የመግዛት መብት፡- ሸማች መግዛት ወይም መሸመት የሚፈልገው የተለያዩ ዕቃዎችና አገልግሎቶች ይኖራሉ፡፡ አነዚህን ለመሸመት የሚፈልጋቸውን ዕቃዎችንና አገልግሎቶችን አማርጦ የመግዛት መብት አለው፡፡
ሐ. እንዲገዛ ያለመገደድ፡- የዕቃዎችን ወይም አገልግሎቶችን ጥራት ወይም አማራጮችን በማየቱ ወይም የዋጋ ድርድር በማድረጉ ምክንያት እንዲገዛ ያለመገደድ መብት አለው፡፡
መ. በአክብሮት የመስተናገድ መብት፡- ሸማች ወይም ገዢ ዕቃዎችን ወይም አገልግሎቶችን በሚፈልግበት ጊዜ፣ በሚመርጥበት ጊዜ እና በሚገዛበት ጊዜ በትህትናና በአክብሮት የመስተናገድ መብት ይኖረዋል፡፡ በተጨማሪም ሸማች በነጋዴው ከሚደርስበት የስድብ፣ የዛቻ፣ የማስፈራራት እና የስም ማጥፋት ተግባር የመጠበቅ መብት አለው፡፡
ሠ. ካሣ እንዲከፍሉት የመጠየቅ መብት፡- ሸማች ወይም ገዢ የንግድ ዕቃዎችን ወይም አገልግሎቶችን በመግዛቱ ወይም በመጠቀሙ ምክንያት የደረሰበት ጉዳት ካለ፣ ለደረሰበት ጉዳት ካሳ የማግኘት መብት አለው፡፡ ይህን ካሳ የመክፈል ግዴታ ያለባቸው በአምራችነት፣ በአስመጪነት፣ በጅምላ ሻጭነት፣ በችርቻሮ ሻጭነት ወይም በሌላ ማንኛውም ሁኔታ በአቅርቦቱ የተሳተፉ ሰዎች ናቸው፡፡ ሸማቹ ከነዚህ አካላት በተናጠል ወይም በጋራ ካሳ የመጠየቅ መብት አለው፡፡

ሸማቾች ያላቸውን መብት ከላይ ከተዘረዘሩት መብቶቻቸው በተጨማሪም የነጋዴዎች ግዴታ ለሸማቾች መብት እንደሆነ መገንዘብ ይቻላል፡፡ ነጋዴዎች በርካታ ግዴታዎች ያሉባቸው ቢሆንም በዋናነት ግን፡- የዋጋ ዝርዝር በንግድ ቤቱ ላይ መለጠፍ፣ የንግድ ዕቃዎች ላይ መግለጫ መለጠፍ፣ ደረሰኞችን መስጠትና ቀሪዎችን መያዝ፣ የራሱን /የንግድ ስሙን/ ስለመግለጽ፣ የንግድ ማስታወቂያ ትክክለኛ መሆን ወዘተ የሚሉ ግዴታዎች አሉባቸው፡፡ (ከአን. 15-18)

ጉድለቶችን፣ የተከለከሉ ድርጊቶችና በተመለከተ
ሸማች በገዛው የንግድ ዕቃ ወይም አገልግሎት ላይ ያገኛቸውን ጉድለቶችና ጉድለቶቹ ሊያስከትሉ ስለሚችሉት ጉዳት ለሚኒስቴሩ ወይም ለሚመለከተው ቢሮ ማሳወቅ ይችላል፡፡ ለሸማቹ የበለጠ የሚጠቅሙ ዋስትናዎች ወይም የህግ ወይም የውል ድንጋጌዎች በነጋዴው ሊቀርብለት ይችላል፡፡ ሆኖም ሸማቹ ጉድለት ያለበት የንግድ ዕቃን የሚመለከት ሲሆን የንግድ ዕቃው እንዲለወጥለት ወይም ዋጋው እንዲመለስለት ሻጩን መጠየቅ ይችላል፡፡ በተጨማሪም ጉድለት ያለበት አገልግሎት ሲሆን አገልግሎቱ በድጋሜ ያለክፍያ እንዲሰጠው ወይም የአገልግሎት ክፍያው እንዲመለስለት ሻጩን መጠየቅ ይችላል፡፡ ግዥው በተፈጸመ በ15 ቀናት ውስጥ ሻጩን መጠየቅ የሚችል መሆኑን ከአዋጁ እንረዳለን፡፡

ሸማቹ በሕጉ የተሰጡትን መብቶች የሚያስቀሩ በሸማችና በነጋዴ መካከል የሚደረጉ የውል ግዴታዎች ተፈጻሚነት አይኖራቸውም::
ለማንኛውም ነጋዴ የሚከተሉትን ድርጊቶች መፈጸም የተከለከለ ነው፡-
በአጠቃላይ ስለንግድ ዕቃዎችና አገልግሎቶች የተሳሳተ መረጃ መስጠት፤ የንግድ ዕቃዎችን ሞዴል፣ አዲስ የተሠሩ፣ የተለወጡ፣ እንደገና እንደ አዲስ የተሠሩ ወይም ያገለገሉ ስለመሆናቸው ወይም በአምራቹ እንዲሰበሰቡ የተባሉ ስለመሆናቸው በትክክል አለመግለጽ፤ የንግድ ዕቃዎችና አገልግሎቶችን በማስታወቂያ እንደተነገረላቸው አለመሸጥ ወይም ማስታወቂያው የመጠን ውሱንነት መኖሩን ካልገለፀ በስተቀር ሸማቾች በሚፈልጉት መጠን ልክ አለመሸጥ፤ ከንግድ ዕቃ ወይም ከአገልግሎት ሽያጭ ጋር በተያያዘ የተገባ የዋስትና ግዴታን አለመወጣት፤ የንግድ ዕቃ የሚያስፈልገው ጥገና ወይም የሚተኩ ክፍሎቹ

እንደማያስፈልጉት አድርጎ ማቅረብ፤ ማንኛውም አገልግሎት የመስጠት ሥራን በንግድ ሥራው ከሚታወቀው ደረጃ በታች ወይም ባልተሟላ ሁኔታ መስጠት፤ ለሰው ጤናና ደህንነት አደገኛ የሆነ፣ ምንጩ ያልታወቀ፣ የጥራት ደረጃው የወረደ፣ የተመረዘ፣ የአገልግሎት ጊዜው ያለፈ ወይም ከባዕድ ነገሮች ጋር የተደባለቀ የንግድ ዕቃን ለሽያጭ ማቅረብ ወይም መሸጥ፤ በንግድ ዕቃ ወይም የአገልግሎት ግብይት ማንኛውንም የማጭበርበር ወይም የማደናገር ተግባር መፈፀም፤ የሸማቹን መብት ለመጠበቅ ሲባል ካልሆነ በስተቀር የንግድ ዕቃን ወይም አገልግሎትን አልሸጥም ማለት፤ የደረጃዎች ማህተም መጠቀም የሚያስፈልጋቸው የንግድ ዕቃዎችን ወይም አገልግሎቶችን ያለደረጃ ማህተም ለሽያጭ ማቅረብ ወይም መሸጥ፤ የንግድ ዕቃን ወይም አገልግሎትን በንግድ ዕቃው ላይ ወይም በንግድ መደብሩ ውስጥ ከተለጠፈው ዋጋ አስበልጦ መሸጥ፤ የንግድ ዕቃዎች የተሰሩበትን አገር አሳስቶ መግለጽ፤ በሸማቾች መካከል ተገቢ ያልሆነ አድልዎ መፈጸም፤ አንድን የንግድ ዕቃ ወይም አገልግሎት ለመሸጥ ሸማቹ ያልፈለገውን ሌላ የንግድ ዕቃ ወይም አገልግሎት አብሮ እንዲገዛ ማስገደድ፤ ህገ ወጥ በሆነ ማንኛውም የመለኪያ መሳሪያ መጠቀም እና የመሳሰሉት የተከለከሉ ናቸው፡፡
