Job Description

The Assistant Legal Officer is a member of the protection team in the country office. He/she will report to the Protection Officer (IDPs).  The Assistant Legal Officer is relied upon by the office to support UNHCR’s work on domestic law and policy in relation to IDPs in Ethiopia among other IDP-related tasks.  He/she will 1) Arrange meetings, workshops and trainings with government authorities and other stakeholders 2) Undertake legal analysis and research, particularly into domestic law 3) Provide technical support and capacity development to authorities to implement the 2009 Kampala Convention.  The incumbent also acts as an advisor to management on Ethiopian law and represents the organization to authorities, UN sister agencies, partners and other stakeholders on protection doctrine, law and policy.

 - Completion of UNHCR learning programmes on protection

would be an asset or any other equivalent external courses.

#እናትነት_እና_አባትነት
“እናትነት እውነት ነው ፡ አባትነት እምነት ነው”
#ስለ_እናትነት
የተፈጥሮ ጉዳይ ሆኖ ለሴቶች ልጅን አርግዞ መውለድ በተፈጥሮ የተሰጠ ፀጋ በመሆኑ አንድ ልጅ ተወልዶ ወደዚህች ምድር ሲቀላቀል እናቱ ማናት የሚል ጥያቄ ሊነሳ አይችልም ፡ ምክንያቱም እናቱ አርግዛ የወለደችው ንትና ፡፡ በቤተሰብ ህጉ አንቀፅ 124 መሰረት እናት ፡ ልጁን የወለደችው በመሆኗ ብቻ እናትነቷ ይታወቃል ይላል ፡፡ በመሆኑም በቤተሰብ ህጉ ላይ አባትነትን ወደመቀበል ወይም አባትነትን በፍርድ ቤት ውሳኔ ስለማሳወቅ የሚሉ ጉዳዮች ለአባት ብቻ እንጂ ለእናት የሚሰራ ፅንሰ ሀሳብ አይደለም ፡፡ እናት የወለደችው ልጅ ልጇ በመሆኑ እንድትቀበል ምንም አይነት ፍቃድ የማያስፈልግ ሲሆን ፡ የወለደችውን ልጅ አባት በሚመለከት የእሷ ስምምነት እና እምነት ያስፈልጋል ፡፡ ለዚህም ነው በቤተሰብ ህጉ ውስጥ እናት ልጇን ፈቅዳ የምትቀበልበት ወይም የማትቀበልበት ስርአት የሌለው ማለት ነው ፡፡

#ስለ_አባትነት
አባትነትን በእርግጠኝነት ፡ ማወቅ አስቸጋሪ የሚሆንባቸው ተፈጥሮአዊ አጋጣሚዎች በርካታ በመሆናቸው ፡ አባትነትን ልክ እንደ እናትነት በእርግጠኝነት ማወቅ ሁል ግዜ ቀላል አይሆንም ፡፡ ለዛም ነው ፡ እናትነት እውነት ነው ፡ አባትነት እምነት ነው የሚባለው ፡፡ በቤተሰብ ህጉ አንቀፅ 125 መሰረት የአንድ ልጅ አባት ሊታወቅ የሚችለው በሶስት ምክንያቶች መሆኑን ያስገነዝበናል ፡፡ እነሱም
1, ልጅ በሚፀነስበት ወይም በሚወለድበት ጊዜ በእናትየዋና በአንድ ወንድ መካከል በህግ የታወቀ ግንኙነት መኖሩ በመረጋገጡ ምክንያት አባትነት ይታወቃል (የሕግ ግምት [ከአንቀፅ 126 -130])፡፡
2, አባትየው ልጁን ልጄ ሲል በመቀበሉ ምክንያትም አባትነት ሊታወቅ ይችላል፡፡ (ልጅን መቀበል [ከአንቀፅ 131 -142])
3, በፍርድ ቤት በሚሰጥ ውሳኔም አባትነት እንዲታወቅ ሊደረግ ይችላል፡፡ (የፍርድ ቤት ዉሳኔ ናቸዉ፡፡[ከአንቀፅ 143 -145])

በ ቁጥር አንድ ስር በህግ የታወቀ ግንኙነት ሲባል በባህል ፡ በሀይማኖት ወይም በክብር መዝገብ ሹም ጋብቻቸውን በፈፀሙት ባልና ሚስት አማካኝነት ስለሚፀነሰው ወይም ስለሚወለደው ልጅ የሚመለከት ነወ ፡፡ ይህ ማለት ግን ፡ እንደ ባልና ሚስት ሆነው በሚኖሩት ሰዎች መካከል ስለተፀነሰው ወይም ስለተወለደው ልጅ ህጉ እውቅና አይሰጥም ማለት አይደለም ፡፡ ለሁለቱም አይነት ቤተሰባዊ ግንኙነቶች ፡ አባትነት ሊረጋገጥ ይችላል ፡፡ ቀጥለን አባትነት የሚረጋገጥባቸው መንገዶች እንመለከታለን ፡፡

#አባትነት_የሚረጋገጥባቸው_መንገዶች
ቀጥለው ባሉት ዘዴዎች አባትነት የሚረጋገጠው የልጅ የተፈጥሮ አባት /biological father/ ነው፡፡ ይህም ከልጅ እናት ጋር ፆታዊ ግንኙነት በመፈፀም ልጁ እንዲወለድ ምክንያት የሆነውን አባት ማረጋገጥ ይሆናል፡፡ በትክክለኝነት ለማረጋገጥ አስቸጋር በመሆኑ ይህንን ሁኔታ ለማረጋገጥ ሕጉ የተለያዩ ዘዴዎችን ይጠቀማል፡፡

ሀ. #የሕግ_ግምት
የሕግ ግምት መሠረት የሚያደርገው ልጁ በሚፀነስበት ወይም በሚወለድበት ጊዜ በእናትና በአንድ ወንድ መካከል በሕግ የታወቀ ግንኙነት መኖርን በማረጋገጥ ነዉ፡፡ ይህም ልጁ ሲፀነስ ወይም ሲወለድ ከልጅ እናት ጋር በጋብቻ የነበረ ባል ወይም ጋብቻ ሳይፈጽም አብሯት የነበረው ወንድ የልጅ አባት ነዉ ብሎ ሕጉ ግምት ይወስዳል፡፡ በመሆኑም በልደት ምስክር ወረቀት አባቱ ሌላ ነው ተብሎ ቢፃፍም እንኳን ይህ የሕጉ ግምት አይቀየርም፡፡
ልጅ የተፀነሰው በጋብቻ ወይም አብሮ በኖሩበት ጊዜ ውስጥ ነው የሚባለው ጋብቻው ከተፈጸመበት ወይም አብሮ መኖር ከተጀመረበት ከ180 ቀናት በኋላ ልጅ ሲወለድ መሆኑ በሕጉ በግልጽ ተመልክቷል፡፡ እንዲሁም ጋብቻው ፈርሶ ወይም አብሮ መኖር አብቅቶ ከሆነ ከፈረሰበት ወይም ካበቃበት ቀን ጀምሮ በ300 ቀናት ዉስጥ ልጅ የተወለደ እንደሆነ ነው፡፡ በመሆኑም የልጅ አባት የሚባለዉ በተመለከቱ ጊዜያት ከልጅ እናት ጋር አብሮ ያለው ወይም የነበረ ሰው ነው፡፡ ይህንን የሕጉን ግምት በሌላ ማስረጃ ማስተባበል አይቻልም፡፡,የሕግ ግምት [ከአንቀፅ 126 -130]

ለ. #ልጅነትን_ስለመቀበል
በመቀበል አባትነት የሚረጋገጠዉ አባትየዉ ልጁን ልጄ ነዉ ብሎ በሚሰጠዉ ማረጋገጫ ስያረጋግጥ ነዉ፡፡ የአነባትነት ማረጋገጫ በመስጠት አባትነት የሚረጋገጠዉ የልጅ አባት በሕግ ግምት ለመረጋገጥ የማይቻል ሲሆን ነዉ፡፡ ይህ ሊሆን የሚችለዉ ልጁ የተፀነሰዉ ወይም የተወለደዉ እናት ከአንድ ወንድ ጋር በጋብቻ ወይም ያለጋብቻ በአብሮ መኖር ሥርዓት ሳትመሰርት ልጅ ሲወለድ ነዉ፡፡ በእንዲህ ባለ ሁኔታ አንድ ሰዉ አንድን የተፀነሰ ወይም የተወለደ ልጅ የእርሱ ልጅ መሆኑን አምኖ በመቀበል ቃሉን የሰጠ እንደሆነ የልጁ አባት ይባላል፡፡
መቀበሉን የሚገልጽበት ፎርም ወይም ሥርዓት በክብር መዝገብ ሹም ፊት በመቅረብ በሚሰጠዉ ቃል ወይም በጽሑፍ በሚያደርገዉ ኑዛዜ ወይም በሌላ በማናቸዉም ሥልጣን በተሰጠዉ ባለስልጣን በተረጋገጠ ሠነድ አማካኝነት ነዉ፡፡
በመርህ ደረጃ የመቀበል ቃሉን መስጠት ያለበት አባት ብቻ ነዉ፡፡ አባትየዉ ሞቶ ከሆነ ወይም ፈቃዱን ለመስጠት የማይችል በሆነ ጊዜ ከአባትየዉ ወላጆች አንዱ በእርሱ ስም ልጁን ሊቀበል ይችላል፡፡ አባት ነኝ ባዩ ቃሉን በሚገባዉ ሥርዓት ቢሰጥም እንኳን የልጁ እናት የተቀባዩ አባት እዉነተኝነት ያለዉ መሆኑን ካላመነች የተሰጠዉ ቃል በሕግ ፊት ዉጤት የለዉም፡፡ ይህ ማረጋገጫ ሳትሰጥ እናት ሞታ ወይም ፈቃድ መስጠት የማትችል ከሆነች ከእናት ወላጆች በአንዱ ሊሰጥ ይችላል፡፡ በመርህ ደረጃ አባትነት መቀበል የሚቻለዉ የልጁ በሕይወት እያለ ብቻ ነዉ፡፡ ልጅን መቀበል [ከአንቀፅ 131 -142]

ሐ. #በፍርድ_ቤት_ዉሳኔ_አባትነትን_ማወቅ
በሕግ የታወቀ ግኙኝነት ሳይኖር የሚወለድ ልጅ አባት ባይ ሰዉ በፈቃዱ ካልተቀበለ አባት የሚያጣበት ሁኔታ መኖሩ እሙን ነዉ፡፡ በመሆኑም በመካድ ወይም ባለመቀበል አባትነትን የሚያጡ ልጆች በፍርድ ቤት በሚሠጥ ዉሳኔ አባት እንዲያገኙ ህጉ ይኸንን ሶስተኛዉን ዘዴ አስቀምጧል፡፡

አባትነት በፍ/ቤት በሚሰጥ ዉሳኔ እንዲረጋገጥ: መሟላት ያለባቸዉ ሁኔታዎችም፤
ሀ. ልጁ በተፀነሰበት ጊዜ በእናቲቱ ላይ የመደፈር ወይም የመጠለፍ ተግባር የተፈጸመባት ሲሆን፣
ለ. ሆነ ተብሎ በተደረገ የተንኮል ድርጊት ሥልጣንን ያለ አግባብ በመጠቀም አገባሻለሁ በማለት ተስፋ ቃል በመስጠት ወይም በሌላ ተመሳሳይ መንገድ ልጁ በሚፀነስበት ጊዜ ከእናት ጋር ፆታዊ ግኝኙነት የተፈጸመባት ሲሆን
ሐ. አባት ነዉ በተባለዉ ሰዉ የተጻፈና በማያሻማ ሁኔታ አባትነቱን የሚያረጋግጡ ደብዳቤዎች ወይም ሌሎች ጽሑፎች ሲኖሩ፣
መ. በሕግ የታወቁ ግንኙነት ሳይኖራቸዉ የልጁ እናትና አባት የተባለዉ ሰዉ በሕግ በተመለከተዉ የእርግዝና ጊዜ ቀጣይነት ባለዉ ሁኔታ በግብረ ሥጋ ግንኙነት አብረዉ የኖሩ እንደሆነ ነዉ፡፡
ከእነኝህ ከአምስቱ ሁኔታዎች በአንዱ ምክንያት ልጅ ተፀንሶ ከሆነ በድርጊቱ ላይ የነበረዉ ወንድ አባት ተብሎ በፍርድ ቤት ይወሰናል፡፡ የፍርድ ቤት ዉሳኔ ናቸዉ፡፡[ከአንቀፅ 143 -145]
