Legal Age of Marriage for Women
πThe Union Cabinet has taken a decision to raise the legal age of marriage for women from 18 to 21 year bringing the age of marriage for both men and women at par.
πPersonal laws of various religions that deal with marriage have their own standards, often reflecting custom.
πThe Hindu Marriage Act, 1955 sets 18 years as the minimum age for the bride and 21 years as the minimum age for the groom.
πThe Special Marriage Act, 1954 and the Prohibition of Child Marriage Act, 2006 also prescribe 18 and 21 years as the minimum age of consent for marriage for women and men, respectively.
πIn Islam, the marriage of a minor who has attained puberty is considered valid.
πIn June 2020, the Ministry for Women and Child Development set up a task force headed by Jaya Jaitly along with other members- NITI Aayog member (Health) Dr V K Paul and secretaries of several ministries.
πThe committee was to look at the feasibility of increasing the age of marriage and its implication on women and child health, as well as how to increase access to education for women.
πThe committee has to recommend a timeline by which the government could roll out the implementation of the policy, as well as the amendments that would need to be made in existing laws.
πThe committee received feedback from young adults from 16 universities across the country.
πOver 15 NGOs were also engaged to reach out to young adults in far-flung areas and marginalised communities.

Criminalising Marital Rape
π A batch of petitions seeking criminalisation of marital rape, has been filled in the Delhi High Court.
πThe petition seeks to amend the criminal law, which includes Section 375 (rape) of the Indian Penal Code (IPC).
πThe grounds for βmarital immunityβ for rape prosecution have emerged from the patriarchal discourse in society.
πUnder the impact of the second wave of feminism in the seventies, Australia became the first common law country to pass reforms in 1976 and after it, many Scandinavian and European countries made rape in marriage a criminal offence.
πSection 375 of the Indian Penal Code, which exempts forceful sexual intercourse by a man with his own wife from the offence of rape, provided the wife is above 15 years of age, also known as the βmarital rape exceptionβ.
πThis exception clause violates the womenβs fundamental right to equality, freedom of speech and expression, and most of all the right to life and personal liberty.
πThe Justice J. S. Verma Committee, constituted in the aftermath of the horrific Nirbhaya gang rape in 2012.
