ስለ ስጦታ የፍትሐብሔር ህግ

👉 የስጦታ ምንነት

በአጭሩ ለማስቀመጥ ስጦታ ማለት ሰጪው ተቀባይ ለተባለ ሌላ ሰው ከንብረቶቹ አንዱን ያለ ዋጋ የሚለቅበት ወይም ግዴታ የሚገባበት ውል ነው።
በመሆኑም ስጦታ በራሱ ውል ነው ማለት ነው።

👉የስጦታ ልዩ ባህሪያት*

በመርህ ደረጃ ስጦት ግላዊ ተግባር ነው ይህም ማለት ስጪው እራሱ የሚያድረገው ተግባር ነው ማለት ነው። ስጦታ የሚደረገው በወኪሉ ሲሆን ደግሞ የሚሰጠው ንብረት አይነት እና ለማን እንደሚሰጥ በግልጽ ሊመለከት ይገባል። ስጦታ የሚደረገው የሰጪው ንብረት በሆነው ለይ ብቻ ነው።ስጦታ አድርጋለሁ ብሎ የተስፋ ቃል መስጠት በህጉ መሠረት ግዴታን አያስከትልም ከዚህም በተጨማሪ ስጦታ ተቀባዩ ስጦታውን እቀበላለሁ በሚል ሀሳቡን
መግለፅ ይኖርበታል።ስጦታ እንዲቀነስ ወይም እንዲሻር የሚቀርበው ጥያቄ ስጦታው ከተደረገበት ቀን አንስቶ እስከ ሁለት አመት ለዳኞች ካልቀረበ በቀር ዋጋ አይኖረውም።

👉የስጦታ ሥርዓት ፍፎርም*

ስጦታ በማይንቀሳቀሱ ንብረቶች ላይ ወይም በሚይንቀሳቀሱ ግዙፍ ንብረቶች ላይ ሊደረግ ይችላል።

*1)በማይንቀሳቀስ ንብረቶች ላይ የሚደረግ ስጦታ *

በማይንቀሳቀስ ንብረቶች ላይ የሚደረግ ስጦታ በፍትሐብሔር ህግ አንቀጽ 881 ላይ በተደነገገው መሠረት በግልጽ ኑዛዜ ሥርዓት ፎርም መሠረት የሚፈጸም መሆኑን ህጉ ያስረዳል።በሌላ በኩል በማይንቀሳቀሱ ንብረቶች ለይ የሚደረገው ስጦታ በፍ/ህግ አንቀጽ 1723 መሠረት በጽሁፍ ሆኖ በፍርድ ቤት መዝገብ ወይም ውል ለማዋዋል ስልጣን በተሰጠው አካል ፊት መሆን አለበት።

*2) በሚንቀሳቀሱ ግዙፍ ንብረቶች ለይ የሚደረግ ስጦታ*

በሚንቀሳቀሱ ግዙፍ ንብረቶች ላይ የሚደረግ ስጦታ በሁለት አይነት መልኩ ሊደረግ ይችላል ይህም እጅ በእጅ በሚደረግ ማስተላለፍ ብቻ ወይም ለማይንቀሳቀስ ንብረት ስጦታ በሚደረገው ፎርም ሊሰጥ ይችላሉ።

👉 ስጦታ እንደማድረግ የማይቆጠርባቸው ሁኔታዎች ያሉ ሲሆን እነኚህም ሁኔታዎች።

1)ያለ ዋጋ የሚደረግ የአገልግሎት ሥራ ወይም የራሱን እቃ ያለ ዋጋ ዝግጁ ማድረግ ስጦታ አይባልም የፍ/ህግ አንቀጽ 2430።

2)መንፈሳዊ ተግባርን ለመፈጸም የሚደረገው የገንዘብ መክፈል ስራ ስጦታ አይባልም የፍ/ህ አንቀጽ 2432።

3) አንድ ሰው ለሰጪው ወይም ለቤተሰቡ አገልግሎት በልማድ መሠረት ያደረገው የሥራ ዋጋ መክፈል ስጦታ አይባልም የፍ/ህ አንቀጽ 2433።

4)ወራሽነትን አልፈልግም ብሎ መተው ወይም ኑዛዜ የተደረገለትን ስጦታ አልቀበልም ማለት ስጦታ ነው ተብሎ አይቆጠርም የፍ/ህግ 2431።

👉ስጦታ ፈራሽ የሚሆንባቸው ምክንያቶች*

በሚንቀሳቀስ ወይም በማይንቀሳቀስ ንብረቶች ለይ የተደረገው ስጦታ በህጉ በተጠቀሱት በተለያየ ምክንያቶ ፈራሽ ሊሆን የሚችሉባቸው ምክንያቶች ያሉ ሲሆን እነኚህም:-

1ኛ የሰጪው አዕምሮ ትክክል አለመሆን

ሰጪው ስጦታውን በሚያድርግበት ወቅት በአዕምሮ መታወክ(ህመም ምክንያት) በፍርድ የተከለከለ ሲሆን ያደረገው ስጦታ ፈራሽ ሊሆን ይችላል ።የፍ/ህ አንቀጽ 2437

2ኛ ግብረ ገብነት የሌለው ወይም ህገ ወጥ ምክንያት ያለበት ስጦታ ፈራሽ ነው። የፍ/ህ አንቀጽ 2438

3)በመንፈስ መጫን ምክንያት የተደረገውን ስጦታ ዳኞች ለመቀነስ ወይም ለመሻር ይችላሉ።የፍ/ህ አንቀጽ 2439

4ኛ በ ፍ/ህ አንቀጽ 2442 ሥር በሚፈቅደው መሠረት ስጦታው የተደረገው በስህተት ወይም በተንኮል የሆነ እንደሆነ ፈራሽ ይሆናል።

5 ስጦታ የተደረገው ክርክር ያለበት ሀብት ላይ ሲሆን ስጦታው ፈራሽ ይሆናል።የፍ/ህ አንቀጽ 2452
