በእርቅ የሚያለቁ የወንጀል ጉዳዮች እና አፈፃፀሙ

1. የእርቅ ትርጉም
እርቅ በአለም አቀፍ ደረጃ ተቀባይነት ካገኙ እና በብዛት በስራ ላይ ከሚውሉ የአማራጭ የሙግት መፍቻ ዘዴዎች ( alternative dispute resolution mechanisms) አንዱ ሲሆን የፍትሀ ብሄር እና የወንጀል ጉዳዮችን ከፍርድ ቤት ውጪ በሰላማዊ መንገድ ለመፍታት ይውላል፡፡ እርቅ( mediation) ገለልተኛ በሆነ ሶስተኛ ወገን ድጋፍ ግጭት ውስጥ የገቡ ሰዎች በፍቃዳቸው እንዲስማሙ ወይም ግጭታቸውን እንዲፈቱ የሚደረግበት ሂደት ነው፡፡በወንጀል ጉዳዮች እርቅ የሚከናወነው በዋናነት የወንጀል ድርጊቱን በፈፀመው ሰው/ተከሳሽ/ እና በተበዳይ መካከል ሲሆን ይህም በተበዳይና በደል አድራሽ መካከል የሚደረግ እርቅ( victim offender mediation) ተብሎ ይታወቃል፡፡

በወንጀል ጉዳዮች እርቅ የሚከናወነው በልዩ ሁኔታ ነው፡፡ምክንያቱም በመርህ ደረጃ ወንጀል የህዝብን እና የመንግስትን ጥቅም የሚጉዳ ተግባር ነው ተብሎ ስለሚታመን ነው፡፡ ክስም የሚቀርበው መንግስት በወከለው ዐቃቤ ህግ ሲሆን ሙሉ ወጪውም የሚሸፈናው በመንግስት ይሆናል፡፡ስለሆነም በወንጀል ህጎች ስር በእርቅ ማለቅ የሚችሉ ገዳዮች በግልፅ ተደንግገው ይገኛሉ፡፡

2. የእርቅ ጠቀሜታ/ለተበዳይ/ለተከሳሽ/ለጠቅላላው ማህበረሰብ/ለፍትህ ስርዓቱ
በህግ የተፈቀዱ ጉዳዮችን በእርቅ መጨረስ መጠነ ሰፊ ጠቀሜታዎች አሉት፡፡ጥቅሞቹን ለተበዳይ ፣ለተከሳሽ፣ለጠቅላላው ማህበረሰብ በሚል ከፋፍለን ማየት እንችላለን፡፡ በእርቅ ማለቅ የሚችሉ ጉዳዮች በባህሪያቸው ከህዝብ ጥቅም ይልቅ የግል ተበዳይን ጥቅም የሚመለከቱ በመሆናቸው ጉዳዩን በእርቅ መጨረስ በዋናነት ፋይዳ የሚኖረው ለተከሳሽ እና ለተበዳይ ነው፡፡ተበዳይ እርቅ ሲፈፀም ጉዳቱን ያደረሰው ሰው ይቅርታ የሚጠይቅበት እና ካሳ የሚክስበት ሁኔታ ስለሚኖር ለደረሰበት በደል እውቅና ያገኛል ማለት ነው፡፡በመሆኑም በውስጡ የተበዳይነት ስሜት እንዲጠፋ እና ወደ ፊት የበቀል መንፈስ በወስጡ እንዳያድር ያደርጋል፡፡ ጉዳት አድራሹም በበኩሉ ሊደርስበት ከሚችል የበቀል ጥቃት ስጋት ነጻ ይሆናል ፡፡እንዲሁም ጉዳዩ በእርቅ ስምምነት ካለቀ በተከሳሽ ላይ የተመሰረተው ክስ ቀሪ የሚሆንበት ወይም የሚቋረጥበት ሁኔታ ስለሚኖር ከወንጀል ቅጣት ይድናል ማለት ነው፡፡ በሌላ በኩል የወንጀል ጉዳት አድራሻ እና የተበዳይ መስማማት እና መታረቅ ለጠቅላላው ማህበረሰብ ሰላም ከፍተኛ ጠቀሜታ ይኖረዋል፡፡ ይህም የሚሆነው ከወንጀል ስጋት ነፃ የሆነ አከባቢን ለመፍጠር በማስቻል ነው፡፡በተጨማሪም በባህሪያቸው ግላዊና ቀለል ያሉ ወንጀሎች በፍርድ ቤት ክስ ተመስርቶ የጥፋተኝነት ውሳኔ ከሚሰጥ ይልቅ ጉዳዩ በእርቅ ማለቁ የተሻለ ውጤት የሚያስከትል ሲሆን ጉዳዮቹን በእርቅ መጨረስ የፍርድ ቤትን የስራ ጫና ይቀንሳል፡፡ይህም የፍትህ ስርዓቱ በተቀላጠፈ መንገድ እንዲከናወን አጋዥ ይሆናል ማለት ነው፡፡

3. በእርቅ የሚያልቁ የወንጀል አይነቶች
በአብዛኛው ወንጀሎች በመርህ ደረጃ የህዝብን መብትና ጥቅም የሚነኩ ሲሆን በልዩ ሁኔታ ከህዝብ ጥቅም ይልቅ የግል ተበዳይን ጥቅም የሚነኩ ሆነው የተደነገጉ የወንጀል አይነቶች በ1996 ዓ.ም በወጣው የኢ.ፌ.ድ.ሪ የወንጀል ህግ ተካተው ይገኛሉ፡፡ እነዚህ የህግ ድንጋጌዎች ክስ ማቅረብ የሚቻለው በግል አቤቱታ ብቻ እንደሆነ ያስቀምጣሉ፡፡ በህገ መንግስቱ አንቀፅ 34/5 ላይ እንደተደነገገው የግል እና የቤተሰብ ህግን በተመለከተ በተከራካሪዎች ፈቃድ በሀይማኖቶች ወይም በባህሎች ህጎች መሰረት መዳኘት እንደማይከለከል ያስቀምጣል፡፡ ይህ ማለት የግል የሆኑ እና በግል አቤቱታ ብቻ የሚያስቀጡ ወንጀሎችን በባህላዊ እና በሀይማኖታዊ ስርዓቶች መዳኘት እርቅን እንደሚያካትት መገንዘብ ይቻላል፡፡

በወንጀል ህጉ በግል አቤቱታ እንደሚያስቀጡ ከተደነገጉ አንቀፆች ጥቂቶቹን ለአብነት ለመጥቀስ ያክል ፡- ታስቦ የሚፈጸም ቀላል የአካል ጉዳት (አንቀጽ 556(1)፣ በቸልተኝነት የሚፈጸም ቀላል የአካል ጉዳት (አንቀጽ-559(3))፣ የእጅ እልፊት (አንቀጽ-560(1)) ፣የዛቻ ወንጀል (አንቀጽ-580) ፣አመንዝራነት (አንቀጽ-652) ፣የሥድብ እና ማዋረድ (አንቀጽ-615) ፣የስም ማጥፋት ወንጀል (አንቀጽ-618) ፣በቤተዘመድ ንብረት ላይ የተፈጸመ ንብረት ነክ ወንጀል (አንቀጽ-664) ጋብቻን በተንኮል ወይም በማታለል መፈፀም(አንቀጽ-646)፣ቀለብ የመስጠት ግዴታን ያለመወጣት(አንቀጽ-558)፣በሌላ ሰው ሀብት ያለአግባብ መጠቀም(አንቀጽ-678)፣አግኝቶ መደበቅ(አንቀጽ-679)፣በሰው ንብረት ላይ ሁከት ማድረግ(አንቀጽ-686)፣በሌላ ሰው ንብረት ላይ ጉዳት ማድረስ(አንቀጽ-689)…ወዘተ ይገኙበታል፡፡

በእነዚህ ወንጀሎች መፈጸም ህጉ ዋነኛ ተጎጂ የሚያደርገው ከጠቅላለው ህዝብና መንግስት ይልቅ የወንጀል ቀጥተኛ ተጎጂውን በመሆኑ እነዚህ ተጎጂዎች እራሳቸው ወይም ህጋዊ ወኪሎቻቸው አቤቱታቸውን ካላቀረቡ ምርመራም ሆነ ክስ መቅረብ አይችልም ማለት ነው፡፡ ለዚህም መሰረታዊ ምክንያቱ የግል ተበዳዮች በአደባባይ ጉዳያችን ቀርቦ ከሚታይ ይልቅ ግላዊ ጉዳይነቱ ተጠብቆ ቤተሰባዊና ማህበራዊ መስተጋብራችንን ጠብቀን በራሳችን እንፈታለን ብለው ከወሰኑ የወንጀል ህጉ መንግስት በጉዳዩ ጣልቃ ገብቶ ጉዳያቸውን ከማየት እንዲቆጠብ አድረጎ የግል ችግራቸውን በራሳቸው እንዲፈቱ በህግ በማስቻል ጥበቃ ያደረግላቸው መሆኑን ያሳያል፡፡

በወንጀል ጉዳዮች እርቅ የሚፈፀምበትን ሂደት ለመምራት ያስችል ዘንድ በጠቅላይ ዐቃቤ ህግ የወጣው መመሪያ ቁጥር 22/2010 ዝርዝር ጉዳዮችን አካቶ ይገኛል፡፡መመሪያው በዋናነት በውስጡ ካካተታቸው ጉዳዮች ፡- በእርቅ ሊያልቁ የሚችሉ ጉዳዮች፣እርቅ ለፈፀም ስለሚችልበት ጊዜ፣ እርቅ ስለሚከናወንበት ቦታ፣ እርቅ አስፈፃሚዎች ሊከተሏች ስለሚገቡ አሰራሮች፣ የእርቅ አፈፃፀም ስነ ምግባር መርሆች፣የእርቅ ስምምነት ስለሚፈርስበት ሁኔታና ግዜ እና ከእርቅ ጋር ተያይዞ ስለሚኖር ተጠያቂነት ናቸው፡፡

ከላይ እንደተመለከትነው በእርቅ ሊያልቁ የሚችሉ ጉዳዮች በወንጀል ህጉ፣በወንጀል ስነ ስርዓት ህግ ወይም በሌላ ህግ ውስጥ በግልፅ በእርቅ ለማለቅ እንደሚችል የተጠቀሰ ማንኛውም ወንጀል እና ቀለል ያሉ ከህብረተሰቡ ጥቅም ይልቅ የተበዳዩን ግለሰብ ጥቅም እና ደህንነት የሚመለከቱ በመሆነቸው በግል አቤቱታ ብቻ የሚያስቀጡ ወንጀልች በእርቅ ማለቅ ይችላሉ፡፡ እርቅ ሊፈፀም የሚችለዉ የይርጋ ጊዜዉን ጠብቆ በቀረበ አቤቱታ ላይ ብቻ ሲሆን አንድ እርቅ የፖሊስ መዝገብ ከተጠናቀቀበት ቀን አንስቶ ባለት 14 ተከታታይ ቀናት ውስጥ መፈፀም አለበት፡፡ ይሁንና እርቁን ለመጨረስ ያላስቻለ በቂ ምክንያት ያጋጠመ እንደሆነ እና በመዝገቡ ላይ ሌላ ዉሳኔ መስጠቱ የሚኖረው ጠቀሜታ ያነሰ ከሆነ ከላይ የተቀመጠዉ የግዜ ገደብ ሳይከበር እርቅ ሊከናወን ይችላል፡፡

እንዲሁም የዐ/ህግ ክስ በፍርድ ቤት መዝገብ ከተከፈተበት በኋላ ክስ በመሰማቱ ሂደት ውስጥ በቀጠሮ መካከል ባለጉዳዮች ታርቀዉ ወደ ዐ/ህግ መስሪያ ቤት ከመጡ የቀጠሮውን ቀን ሳይጠብቅ የክስ ሂደቱ የሚቋረጠዉ በሃላፊዎች ተፈርሞ በፍርድ ቤት በሚቀርብ ማመልከቻ ይሆናል፡፡ በተጨማሪ የዐ/ህግ ክስ መታየት ከተጀመረ በኋላ ባለጉዳዮች መታረቃቸውን በችሎት በፍርድ ቤቱ የሚያመለክቱ ከሆነ በችሎት ያለዉ ዐ/ህግ በጉዳዩ ላይ ስምምነቱን በመግለፅ መዝገቡ እንዲዘጋ ሊያደርግ ይችላል፡፡

4. የእርቅ ከማን ጋር ይፈፀማል/በባህላዊ እና በዘመናዊ
እርቅ በኢትዮጵያ በተለያዩ የማህበረሰብ አባላት በተለያየ ስያሜ ለምሳሌ በአማራ ሽምግልና፣ በኦሮሞ ጃርሱማ እና በመሳሰሉት የሚታወቅ ሲሆን የእርቀ ሂደቱ እንደየማህበረሰቡ ባህል ይከናወናል፡፡በባህላዊ መንገድ የሚከናወን እርቅ ከቀላል እስከ ከባድ ያሉ ወንጀሎችን በእርቅ ለመጨረስ እና ማህበረሰቡ ቀድሞ ወደ ነበረው ሰላማዊ ህይወቱ እንዲመለስ ጥረት ይገደረጋል፡፡ በዚህም ሂደት ወንጀል ጉዳት የሚያደርሰው በአጠቃላይ ማህበረሰቡ ላይ ነው ተብሎ ስለሚታመን ጉዳት አድራሹ ተበዳይን ብቻ ሳይሆን ህብረተሰቡን ይቅርታ የሚጠይቅበትን እና የሚክስበትን ሁኔታ የሚያመቻች ነው፡፡ በዘመናዊው የፍትህ ስርዓት በቀጥታ ወይም ግልጽ በሆነ ሁኔታ ወንጀለኛው ከማህበረሰቡ ጋር እርቅ የሚፈፅምበት ሁኔታ ባይኖርም ከተበዳይ ጋር የሚያደርገው የእርቅ ስምምነት የማህበረሰቡን ዘላቂ ሰላም ለማረጋገጥ ጉልህ ድርሻ እንዳለው እሙን ነው፡፡ይህም ለምሳሌ ምስክር የሚሆኑ ሰዎች ላይ የሚኖርን ቅሬታ ወይም ቂም ያስቀራል፡፡በመሆኑም በዘመናዊው የፍትህ ስርዓት በወንጀል ጉዳዮች እርቅ በዋናነት የሚደረገው በተበዳይ እና በጉዳት አድራሹ መካከል ይሆናል ማለት ነው፡፡

5. እርቅን ማን ያነሳሳል/mediation referral/
ወንጀል ከተፈፀመ በኃላ እርቅ በባለጉዳዮቹ ተነሳሽነት፣በመርማሪ ፖሊስ፣በአቃቤ ህግ ወይም በፍርድ ቤት አነሳሽነት ሊከናወን ይችላል፡፡ወንጀል ፈፃሚው እና ተበዳይ በሀገር ሽማግሌዎች፣በጎረቤት እና በዘመዶቻቸው አማካኝነት/የማስታረቅ ሂደት/ሊታረቁ ይችላሉ፡፡ይህም ሲሆን የወንጀል ምርመራ ተጀምሮ እንደሆነ ወይም ክስ ተመስርቶ እንደሆነ ምርመራው ወይም ክሱ እንዲቋረጥ እንደሁኔታው ለፖሊስ፣ለአቃቤ ህግ ወይም ለፍርድ ቤት የእርቅ ስምምነታተውን በማቅረብ ሊጠይቁ ይችላሉ፡፡በሌላ በኩል በእርቅ ማለቅ እንደሚችሉ በግልፅ በህግ በተደነገጉ ወንጀሎች ላይ ፖሊስ፣ ዐቃቤ ህግ ወይም ፍርድ ቤት ባለገዳዮቹ እንዲታረቁ ሊያግባቧቸው ይችላሉ፡፡

6. እርቅ መቼ ሊፈፀም ይችላል
በወንጀል ጉዳዮች እርቅ በወንጀል ምርመራ ሂደት፣ክስ ከተመሰረተ በኃላ እና በፍርድ ሂደት/ trial stage/ ሊፈፀም ይችላል፡፡ ይህም ፍርድ ከመሰጠቱ በፊት በማንኛውም ጊዜ በእርቅ ማለቅ እንደሚችሉ በህግ የተደነገጉ ጉዳዮችን በእርቅ መፈፀም እንደሚቻል ያስገነዝባል፡፡

7. እርቅ በማን የት ይፈፀማል
በወንጀል ድርጊት ጉዳት አድራሹን እና ተበዳይን የማስታረቁ ስራ ገለልተኛ በሆነ ሰው መከናወን ያለበት ተግባር እንደመሆኑ መርማሪ ፖሊስ እና ዐቃቤ ህግ ያስታራቂነት ሚናን የሚጫወቱበት ሁኔታ በህጋችን ተካቶ ይገኛል፡፡ በወንጀል ጉዳዮች የእርቅ አፈጻጸም መመሪያ ቁጥር 22/2010 ላይ እንደተቀመጠው እርቅ የሚከናወነዉ የምርመራ መዝገቡን የመወሰን እና የመመርመር ስልጣን በተሰጣቸዉ ዐ/ህጎች ወይም መርማሪ ፖሊሶች ሆኖ በጠቅላይ ዐ/ህግ ጽ/ቤት ቢሮ፣ የፖሊስ መምሪያ ወይም ጣቢያ በሚገኝ አመቺ ቢሮ ዉስጥ መሆን አለበት፡፡ እንዲሁም አስገዳጅ ሁኔታ ሲኖር ዐ/ህግ ወይም ፖሊስ ለቅርብ ኃላፊዉ በማሳወቅ ለእርቁ አመቺ በሆነ ሌላ ስፍራ እርቁን ሊያከናዉን ይችላል፡፡ በተጨማሪ ባለጉዳዮች በመረጡት ቦታ በግላቸዉ እርቅ ፈጽመዉ በመምጣት የዕርቅ ማመልከቻ በማስገባት ጉዳያቸውን በእርቅ ሊፈፅሙ ይችላሉ፡፡
8. የእርቅ አስፈፃሚዎች ሊከተሏቸዉ የሚገቡ አሰራሮች
በሁለቱም ወገን ያሉ ባለጉዳዮች ጉዳያቸዉን በእርቅ ለመጨረስ ፍቃደኛ መሆናቸዉን ማረጋገጥ፤ ስለ እርቁ አካሔድ እና የህግ ዉጤት ለባለጉዳዮች በአግባቡ ማሳወቅ፤ የእርቅ ሂደቱን ግልፅ ማድረግ፣ በገለልተኛነት መምራት፣ በሂደቱ ያለመግባባት የተደረሰባቸዉን ነጥቦች ለመፍታት እንዲቻል እንደነገሩ ሁኔታ ጣልቃ በመግባት የማስታረቅ ሂደቱን ማገዝ፤በባለሙያ ድጋፍ ባለጉዳዮች ስምምነት ላይ ከደረሱ ይህንን የሚገልፅ ሰነድ ጽፈዉ እና ተፈራርመዉ እንዲያስገቡ በማድረግ መዝገቡን በእርቅ መዝጋት፤ የእርቅ ስራዉ ከባለሙያ ድጋፍ ዉጭ በራሳቸዉ በባለጉዳዮች ተከናዉኖ የመጣ ከሆነ ዐ/ህግ እርቁ በአመልካቹ ሙሉ ፍቃድ መደረጉን በማረጋገጥ መዝገቡን በእርቅ መዝጋት ናቸው፡፡ በእርቅ የተዘጋ መዝገብ በባለጉዳዮች ላይ አስገዳጅነት ያለዉና የመጨረሻ ህጋዊ ውሳኔ ይሆናል፡፡

በእርቅ ሂደቱ ለባለጉዳዮች እኩል የመሰማት መብት መስጠትና በትህትና ማስተናገድ፣መፍትሄ ለመስጠት የተሸለ ጥቅም ከሌለው በቀር ባለጉዳዮችን ለየብቻ አለማነጋገር፣ለወንጀሉ መነሻ የሆነውን ጉዳይ ከስር መሰረቱ ሊፈታ በሚያስይችል መልኩ መግባባት እንዲፈጠር መጣር፣በእርቅ ሂደቱ የተገኙ ወይም የታወቁ ጉዳዮችን በሚስጥር ይዞ መጠበቅ እና ጉዳዩ በእርቅ ማለቅ ካልቻለ በመዝገቡ ላይ እንደ ማስረጃ ያለመጠቀም አስታራቂዎች ሊያከብሯቸው የሚገቡ የእርቅ አፈፃፀም ስነ-ምግባር መርሆች ናቸው፡፡

በመጨረሻም የእርቅ ስምምነት ስለሚፈርስበት ሁኔታ በመመሪያ የተካተተ ሲሆን ይህም እርቁ የተፈጸመዉ ከባለጉዳዮች በአንደኛዉ ወይም በሁለቱም ላይ በተደረገ ማናቸዉም ሙሉ ፍቃደኝነታቸዉን የሚሸረሽር/የሚያሳጣ ነገር መኖሩ በማስረጃ ሲረጋገጥ ወይም ዐ/ህጉ በነገሩ ካመነበት እና ስለዚሁ ነገር ቅሬታ ሲቀርብ እና በእርቅ ስምምነቱ ላይ የተገለፁ ወይም የተገቡ ቃሎች መፈፀም ሳይችሉ ሲቀሩ እና በዚህም የተነሳ ከተስማሚዎቹ አንዱ እርቅ እንዲፈርስለት የጠየቀ ሲሆን ነው፡፡በማንኛዉም ሁኔታ የእርቅ ስምምነቱን ለማፍረስ የሚያበቁ ምክንያቶች የተገኙ ሲሆን እርቁን ለማፍረስ የሚቻለዉ እርቁ በተፈፀመ በአንድ ወር ግዜ ዉስጥ ማመልከቻ ሲቀርብ ብቻ ነዉ፡፡

9. የእርቅ ስምምነት የህግ ውጤት
እርቅ በዋናነት ሁለት ውጤቶችን ያስከትላል ማለት ይቻላል፡፡ እነዚህም የክስ መቋረጥ፡- በመመሪያው ላይ እንደተገለፀው የግል አቤቱታ አቅራቢው ጉዳዩን መከታተል እንደማይፈልግ በፅሁፍ ከገለፀ ዐ/ህግ በወንጀል ህጉ አንቀፅ 212 መሰረት መዝገብን ሊዘጋው ይችላል፡፡ በወንጀል ህግ አንቀጽ 212 መሰረት ወንጀሉ በግል ተበዳይ አቤቱታ አቅራቢነት ብቻ የሚያስቀጣ መሆኑ በወንጀል ህጉ ልዩ ክፍል ወይም ሌሎች ማሟያ የወንጀል ማቋቋሚያ ህጎች ሲደነገግ የግል ተበዳይ ወይም ህጋዊ ወኪሉ አቤቱታ ካላቀረበ በስተቀር ክስ መመስረት አይቻልም በማለት ይደነግጋል፡፡ከተከሳሽ ጋር እርቅ በመፈፀሙ ተበዳይ ገዳዩን መከታተል እንደማይፈልግ እና ክሱን እንዳነሳ ከገለፀ ክሱ ይቋረጣል ማለት ነው፡፡

በሌላ በኩል ከወንጀሉ ክብደት የተነሳ ጉዳዩን በእርቅ መጨረስ የማይቻል ቢሆን እንኳን ተከሳሽ ጉዳት ላደረሰበት ሰው አስፈላጊውን እርዳታ ያደረገ፣ጥፋቱን አምኖ በመፀፀት ተበዳይን ይቅርታ የጠየቀ እና በተቻለ ወጠን በመካስ መፀፀቱን ያሳየ እንደሆነ እንደ ቅጣት ማቅለያ ይያዝለታል(የወንጀል ህግ አንቀፅ 82/1/ሠ)፡፡ ስለሆነም ሌላው የእርቅ ስምምነት ውጤት ቅጣት ማቅለል ይሆናል ማለት ነው፡፡

ለማጠቃለል ያክል እርቅ ከጥንት ጀምሮ በማህበረሰባችን ውስጥ የህብረተሰቡን ባህል መሰረት በማድረግ ከቀላል እስከ ከባድ ላሉ ወንጀሎች ሲፈፀም የኖረ ስርዓት እንደመሆኑ መጠን በዘመናዊው ህግ በተገደበ መልኩ(በግል አቤቱታ በሚያስቀጡ ወንጀሎች ብቻ) የተፈቀደ ቢሆንም የህብረተሰቡን ዘላቂ ሰላም ለማረጋገጥ የማይተካ ሚና እንዳለው መገንዘብ ይችላል፡፡ በመሆኑም የእርቅ አፈፃፀም ስነ ምግባር መርሆችን በተገቢው ሁኔታ በመከተል ባለጉዳዮች ወደ ተጨማሪ የበቀል እና የወንጀል ድርጊት እንዳይገቡ እና የህዝብ ሰላማዊ ህይወት እንዳይታወክ በህግ በተፈቀዱ ጉዳዮች እርቅ መፈፀም ለተበዳይ፣ለጉዳት አድረሹ፣ለህብረተሰብ እና በአጠቃላይ ፍትህ ስርዓቱ ከፍተኛ ጠቀሜታ ይኖረዋል፡፡
በህገ መንግስቱ አንቀፅ 34/5 ላይ እንደተደነገገው የግል እና የቤተሰብ ህግን በተመለከተ በተከራካሪዎች ፈቃድ በሀይማኖቶች ወይም በባህሎች ህጎች መሰረት መዳኘት እንደማይከለከል ያስቀምጣል

በአብዛኛው ፍ/ቤቶች የጽሑፍ ማስረጃዎች ከክስ ጋር ወይንም ከመከላካያ መልስ ጋር አብሮ ካልቀረበ መቅረብ አይችልም በሚል አልፎ አልፎ ሲከለክሉ ይታያል፡፡በሌላ በኩል ተከራካሪዎች በክሳቸው/በመልሳቸው ላይ መጀመሪያ ያልቀረቡትን የሰነድ ማስረጃን እንዴት ማቅረብ እንዳለባቸው ሲቸገሩ ይታያል። ነገር ግን የሰንድ ማስረጃ እንዴት እንደሚቀርብ በሥነ-ሥርዓት ህጋችን በግልፅ እንደተደነገገው ከክስ ማመልከቻ ወይም ከመከላካያ መልስ በኋለ ክስ ከመሰማቱ በፊት ከመዝገቡ ጋር ተያይዞ ያልቀረበ የጽሑፍ ማስጃዎች ካሉ መቅረብ እንደሚችሉ ከዚህ በታች ተመልክቷል ፡፡

# ሀ . በመጀመሪያ ደረጃ ከሳሹ ከክስ ማመልከቻው ጋር ተከሳሹ ደግሞ ከመከላከያ መልሱ ጋር ይጠቅመናል የሚሉትንና በእጃቸው የሚገኙትን ወይም ሊያቀርቡ የሚችሉትን የጽሑፍ ማስረጃ በሙሉ አያይዘው ማቅረብ አለባቸው (ቁ.223(1)) (ለ) እና 234 (1)፡፡

# ለ . በሁለተኛ ደረጃ ተከራካሪ ወገኖች ለማቅረብ የሚችሉትንና ይጠቅማናል የሚሉትን ወይም ፍርድ ቤቱ እንዲቀርብ የጠየቀውንና አስቀድመው ፍርድ ቤት ያላቀረቡትን የፅሑፍ ማስረጃ ሁሉ በመጀመሪያው ቀነ ቀጠሮ ማቅረብ አለባቸው
(ቁ. 137 (1)) ፡፡

# ሐ . ማንኛውም አቤት ባይ ሰነዶችን ከአቤቱታው ጋር በማያያዝ ወይም ከቀነ ቀጠሮው በፊት ወይም በመጀመሪያው ቀነ ቀጠሮ ካላቀረበ በቀር ማስረጃዬ ከፍርድ ቤቱ መዝገብ ጋር ይያያዝልኝ ወይም ለማቅረብ ይፈቀድልኝ በማለት ለማመልከት አይችልም (137(3)፡፡

# መ . መቅረብ የሚገባቸው ማስረጃዎች ከተከራካሪዎች ወገኖች ባንዳኛው
ጉድለት ወይም በቂ ባልሆነ ምክንያት ሳይቀርቡ የቀሩ እንደሆነ ፍርድ ቤቱ ወዲያው ፍርድ ይሰጣል (ቁ. 256(1))፡፡

# ሠ . ከላይ ከላይ የተጠቀሱት አጠቃላይ ድንጋጌዎች እንደተጠበቁ ሆኖ ከአቤቱታ ጋር ወይም በመጀመሪያ ቀነ ቀጠሮ ያልቀረበ የፅሁፍ
ማስረጃ በሌላ ጊዜ ሊቀርብ የሚችልበት ልዩ ሁኔታዎች (exceptions) አሉ፡፡

እነዚህም፡-
#1. ፍርድ ቤቱ በራሱ አስተያየት ወይም በተከራካሪዎች ወገኖች አመልካችነት
በሌላ ፍ/ቤት ዘንድ የሚገኝ መዝገብ ወይም የጽሑፍ ማስረጃ እንዲቀርብ ማዘዝ
ይችላል (ቁ.145፡፡

#2. ማስረጃዎቹ ሳይቀርቡ የቀሩት ከባድና በቂ በሆነ ምክንያት መሆኑን ፍርድ ቤቱ ከተረዳ ስለ ክርክሩ አወሳሰንና ማስረጃ ያለመቅረቡ ስላስከተለው ኪሳራ
ተገቢ መስሎ የታየውን ትፅዛዝ በመስጠት ነገሩ የሚሰማበትን ቀነ ቀጠሮ ይወስናል (ቁ. 256 (1)፡፡ (ማስረጃው እንዲቀርብ ማዘዝ ይችላል፡፡)

#3. አስፈላጊ መስሎ ከታየው ፍርድ ቤቱ የክርክሩን ጭብጥ ከመያዙ በፊት በተከራካሪዎች ያልቀረበን የፅሑፍ ማስረጃ በትዕዛዝ አስቀርቦ መመርመር
ይችላል (ቁ. 249 ፡፡

#4. ክርክሩ በሚሰማበት በማናቸውም ግዜ ፍርድ ቤቱ በተከራካሪዎቹ ያልቀረበ
ነገር ግን ለክርክሩ ጠቃሚ የሆነ የፅሑፍ ማስረጃ እንዲቀርብ ለማዘዝ ይችላል
(ቁ.264)፡፡

#5. ምስክሮችን መስቀለኛ ጥያቄ ለመጠየቅ ወይም ምስክሩ ነገሩን ለማስታወስ እንዲችል የሚቀርብ የጽሑፍ ማስረጃ በመጀመሪያ በይቀርብም ክርክሩ በሚስማበት ጊዜ መቅረብ ይችላል (137 (4)) ።
# በአጠቃላይ የፍ/ብ/ሥ/ሥ/ቁ.223(1) (ለ) , 234 (1),137,256,145,249,264,345 ድንጋጌዎችን በማየት መረዳት ይቻላል።
