በዚህ አጭር ጽሁፍ የወንጀል ቅጣት አላማ እና ግብ፣ በህጋችን የተካተቱ የቅጣት አይነቶች፣ ስለሞት ቅጣት፣ የቅጣት ማክበጃ እና ማቅለያ ምክንያቶች፣ ስለወንጀሎች መደራረብ እና ደጋጋሚነት እና ህጋዊ ውጤታቸው የሚዳሰሱ ሲሆን በተጨማሪም ቅጣት ስለሚጣልበት ወይም ስለሚወሰንበት ሁኔታ እና የቅጣት አወሳሰን ላይ የዐቃቤ ህግን ሃላፊነት እና ሚናን የሚመለከቱ ገለጻዎች ይቀርባሉ፡፡

መግቢያ
ወንጀልን እና ቅጣቱ አብሮ የሚነሳው የቅጣት አወሳሰኑ እንዲሁም የወንጀል ህጉ አላማ ነው፡፡  ቅጣት ሲጣል ወንጀለኛ ዳግም ወደ ወንጀል እንዳይመለስ እና ሌሎችም ከተቀጪው ተምረው ራሳቸውን ከወንጀል ድርጊት እንዲቆጥቡ በማስተማር እና ማስጠንቀቂያ እንዲሆን ማድረግ ነው፡፡ የወንጀል ህግ አላማ ወንጀል እንዳይፈጸም መከላከል ሲሆን ይህም ስለወንጀል ድርጊቶች እና ስለሚያስከትሉት ቅጣቶች አስቀድሞ በማሳወቅ ስለወንጀል ያለ ግንዛቤ መጨመር ነው፡፡ ወንጀል ተፈጽሞ ሲገኝ ለሌላው ትምህርት እንዲሆን አስተማሪ የሆነ ቅጣትን በመቅጣት አላማውን የሚያሰካ በመሆኑ የሚጣለውም ቅጣት ወጥነት፣ ትክክለኝነት፣ ተገማችነት፣ ምክንያታዊ እና ፍታዊ መሆን አለበት ይህንኑ ታሳቢ በማድረግ በ1996 የወጣው የወንጀል ህግ ፍርድ ቤቶች ቅጣትን ሲወስኑ በተመሳሳይ ጉዳዮች ተመሳሳይ ቅጣት በመወሰን የፍርድ ተገማችነትን ማምጣት አላማን ከግምት በማስገባት ነው፡፡ በዚህ አጭር ፅሁፍ የምናየው የቅጣት አወሳሰን ላይ የአቃቤ ህግ ሃላፊነት እና ሚና፣ የቅጣት አወሳሰን መነሻ እና መድረሻ ሃሳቦች፣ የሞት ቅጣት ቀሪ መሆን አለመሆን በአለም አቀፍ ደረጃ ያለውን ሀሳብ ነው፡፡

የቅጣት አላማ እና ግብ

በቀደምት ታሪክ የተጀመረው ከክርስቶስ ልደት በፊት በ18ኛው ክፍለ ዘመን ሲሆን እሱም በባቢሎን ንጉሥ ሃሙራቢ ኮድ (የሃሙራቢ ህግ/ኮድ)ውስጥ  አይንን ላጠፋ አይኑ ይጥፋ፣እጅ ለቆረጠ እጁ እንዲቆረጥ የሚል ህግ ነው፡፡ አሁን ከወንጀል አድራጊ የወንጀል ማድረግ መነሻ ሀሳብ ተነስተን ከግዜ ወደግዜ የወንጀል ህግ አላማ እና ግብ እያደገ መጥቷል፡፡ በ1996 አ.ም በወጣው የወንጀል ህግ አላማው ለጠቅላላው ጥቅም ሲባል የሀገሪቱን መንግስት የነዋሪዎችን፣ የህዝቦችን፣ የህብረተሰቡን ሰላም፣ ደህንነት፣ መብት እና ጥቅም ማስጠበቅ እና ማረጋገጥ ነው፡፡ ከዛም ይህንን አላማ ለማሳካት ወንጀል እንዳይፈፀም መከላከልን ግብ በዋነኛነት የያዘ ነው፡፡ ስለወንጀል ግንዛቤ በመፍጠር እና ማስጠንቀቂያ በመስጠት ከመከላከል ባለፈ ወንጀል ተፈፅሞ ሲገኝ ደግሞ ወንጀል ፈፃሚውን በመቅጣት ወንጀለኛውን ከሌላ ወንጀል ድርጊት መፈፀም እንዲቆጠብ በማድረግ እና ህብረተሰቡን ከወንጀለኛው እንዲማር ሌላ ተጨማሪ ወንጀል እንዳይፈፀም የማድረግ አላማ ነው፡፡ ወንጀል አድራጊዎች ተቀጥተው ከጥፋታቸው ተምረው እና ታርመው ጥሩ ዜጋ እንዲሆኑ ማድረግ ነው፡፡
