OVERVIEW

Any defective product can returned for repair, replacement, or refund as long as you notify us within seven days of delivery. A product is deemed defective if it varies more than 10% from our specifications. We will be responsible for return shipping cost for defective products covered by our warranty. Cheers!

KABOOMRACKS LIMITED PRODUCT WARRANTY AND DISCLAIMER

(a)
WARRANTY AGAINST DEFECTS. KABOOMRACKS warrants that, under normal use, the Products (excluding those referred to in Section (b) below) shall, at the time of delivery to Buyer be substantially free from defects in material or workmanship and shall substantially conform to KABOOMRACKS’s specifications for such Product. Buyer will notify KABOOMRACKS in writing of any non-conforming Products within seven (7) days of delivery, otherwise KABOOMRACKS will have no further obligation or warranty for such Products. Such notice will describe in reasonable detail the non-conformance claimed by Buyer. Delivered Product will be deemed accepted and conforming unless Buyer provides such notice within the seven (7) day period.

(b) KABOOMRACKS’S SOLE AND EXCLUSIVE OBLIGATION, AND BUYER’S SOLE AND EXCLUSIVE RIGHT, WITH RESPECT TO CLAIMS UNDER ITS WARRANTIES SHALL BE LIMITED TO THE REPLACEMENT OR REPAIR OF A DEFECTIVE OR NONCONFORMING PRODUCT, OR IF KABOOMRACKS CANNOT REPAIR OR REPLACE SUCH PRODUCT AFTER USING COMMERCIALLY REASONABLE EFFORTS, OR AT THE OPTION OF KABOOMRACKS, THEN A REFUND TO BUYER FOR THE PURCHASE PRICE OF THE DEFECTIVE OR NONCONFORMING PRODUCT. KABOOMRACKS WILL HAVE A REASONABLE TIME TO REPAIR, REPLACE OR REFUND. THE NON-CONFORMING OR DEFECTIVE PRODUCTS SHALL BECOME KABOOMRACKS’S PROPERTY AS SOON AS THEY ARE RETURNED FOR REPLACEMENT OR REFUND.

(c)
At KABOOMRACKS’s request, Buyer will ship Products returned under warranty claims to KABOOMRACKS’s designated facility in conformance with KABOOMRACKS’s then current Return Material Authorization policy and are accompanied by a statement of the reason for the return on a Return Material Authorization form issued by KABOOMRACKS. Where warranty adjustment is made, KABOOMRACKS will pay for return shipping expenses. Buyer shall pay for returned Products that are not defective or nonconforming together with the freight, testing and handling costs associated therewith. Except as provided in warranty, KABOOMRACKS has no obligation to accept returns.

(d) Notwithstanding the foregoing, KABOOMRACKS shall have no obligations for breach of warranty if the alleged defect or non-conformance is found to have occurred as a result of environmental or stress testing, misuse, neglect, improper installation, accident or as a result of improper repair, operation at voltages other than as specified by the manufacturer, overclocking above the nominal clockrate, operation in an ambient temperature other than 5-27 degrees Celsius, use with non-certified equipment, alteration, modification, storage, transportation or improper handling. Further, a computing Product will be deemed to operate within its specifications if it varies within ten (10%) more or less than the performance stated in its specifications when operated at the nominal voltage specified by KABOOMRACKS.

(e) THE WARRANTY GRANTED ABOVE SHALL EXTEND DIRECTLY TO BUYER AND NOT TO BUYER’S CUSTOMERS, AGENTS OR REPRESENTATIVES. THE EXPRESS WARRANTY GRANTED ABOVE IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. ALL OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED ARE HEREBY SPECIFICALLY DISCLAIMED BY KABOOMRACKS.

Except as may be prohibited by law, the foregoing states the entire liability of KABOOMRACKS, and Buyer’s sole and exclusive remedies, in connection with defective or non-conforming Products.
OVERVIEW

We are implementing a new, more descriptive scale to rate the condition of the miners and Equipment sold here (see below).

In addition, each of our suppliers will now also be filling out a detailed questionnaire to help buyers understand the condition and history of our merchandise.

Regardless of the grade of a lot, it will come with our seven-day, not dead-on-arrival warranty (See: @kaboomrackswarranty) and full escrow unless explicitly stated otherwise.

Equipment is in unopened, Original Packaging

Grades for Used Equipment (below)

Used, Like New, A+
Equipment was unboxed from Original Packaging, but 1) has never been turned on, is 2) is still free of dust, debris, and residue, and 3) has been re-boxed back into Original Packaging with serials on boxes matching the Equipment.

Used in Excellent Condition with Original Packaging, A
Equipment was turned on, ("used"), but is free of rust, dust, debris, and residue. Equipment was either run in clean datacenter conditions, or has been disassembled, cleaned, and reassembled. In Original Packaging with serials on boxes matching the Equipment.

All the components have been inspected and any non-performance either repaired, replaced, or disclosed.

Used in Excellent Condition, A-
Same as A except not in Original Packaging.

Used in Good Condition with Original Packaging, B+
Equipment was turned on, ("used"), and has been dusted to remove clumps of dust and dirt. Free of rust. May still have thin layer of dust or residue to the touch.

All the components (fans, boards, chips, controllers, etc.) have been inspected and any non-performance either repaired, replaced, or disclosed. Verified to run stably. In Original Packaging, however serials may or may not match.

Used in Good Condition, B
Same as B+ except not in Original Packaging at all.

Used in Working Condition, B-
Equipment was turned on, ("used"), and all the components have been inspected and any non-performance either repaired, replaced, or disclosed. Verified to run stably.

Although components have been inspected, has not been cleaned. May still contain clumps of dirt and dust in the folds of the boards and heat sinks.

Used in Unverified but Warrantied Condition, C
Equipment was turned on, ("used"), and Equipment has neither been inspected or cleaned. Any non-working components still eligible for our warranty. Equipment may still contain clumps of dirt and dust in the folds of the boards and heat sinks.

Means by which Kaboomracks Accepts Payments

By Bank Wire (preferred) Your bank will charge you a fee to send a wire, usually between $30 to $45 USD per wire. Wire instructions can be found on your invoice, or by clicking here (http://kaboomracks.com/bankinginformation).

note: Your bank may require to to make an in-person appointment at your local branch during business hours to in order to send a wire. If you want to avoid making a trip to your local bank (assuming you don't have online wire capabilities} then try our ACH payment option which has $0 fees.

note: If you are making a wire from outside the United States, be sure to configure your wire so any third-party intermediate bank charges are covered by you the sender. If there is a shortfall on your invoice due to this reason, your order may be delayed until the balance is paid.

— ACH. An ACH payment can be sent either from your bank, or using a form we can send you from bill.com. ACH/bill.com uses your bank account and bank routing number to make a payment, and will take 3 business days to clear. It charges 0% fees, and is like a check that takes 3 business days to clear.

note: If you are outside the United States it is acceptable to pay us with a transfer service like TransferWise. Transferwise usually will pay us with an ACH payment.

Sending a check can be slower than any other means of payment we offer so we do not recommend paying with a check. If you decide to mail a check, please send it USPS Priority Mail Express for next day delivery.

— Zelle. (USA customers only) , which is a payment service your bank may offer. It's free and usually has a send limit of around $5000 USD per day.

— Bitcoin (BTC) (via opennode.com.)

note: if you pay in BTC, for any possible future refunds, the refund amount will be in USD, and based on the USD value of the invoice (and not the amount of BTC paid). This is because we immediately convert all BTC received into USD.

How to Pickup Locally from Kaboomracks

— please contact Nick @kaboomracksNick or Robert @kaboomracksCEO to schedule a date and time for pickup at least one business day in advance.

You will only be allowed to book a time for in-person pickup once the goods are confirmed ready to be dispatched.

We will require a photo of the ID of the person or driver who will be picking up in order to schedule a pickup time. That person will need to bring their ID with them when picking up.

Additionally, we will also provide you a pickup code, that the person picking will need to know to be allowed to pickup the goods.

We will send you a Google Calendar invitation for the date/time as confirmation of your upcoming visit. Our address is 23015 N 15th Ave, Suite 103, Phoenix, AZ 85027. Our available hours to meet clients are M-F, 11:00 am to 4:00 pm. Upon arrival, please call, Brian Thaxton: +1 (602) 344-9005.

— please give us a heads up when you are on the way

— local pickup is subject to Arizona State Sales Tax. The applicable tax rate is 8.6%

— the easiest way to pay on the spot would be USDC ERC20, USDT ERC20, or BTC. We will require confirmed payment before allowing pickup of the goods. Zelle also may be a workable option if value of your purchase is less than your Zelle sending limit. It would be best if you could make payment at least a business day before your visit (if making a wire); we can offer a live video tour showing your the Equipment you are purchasing.

— if you are hiring a carrier to pickup while you are here, then we will need a BOL at least 1 day in advance of your visit.

— you will be expected to sign a packing slip for the Products you are buying as confirmation that you have picked up the goods.

— once the goods are in your or your carrier's possession, any damage that may be caused to them by the carrier is your liability
