This is to inform all of you that the Hon'ble Supreme Court of India in Special Leave Petition (C) No.811/2021 filed by the Employees State Insurance Corporation (Petitioner) against the respondent company i.e. M/s. Texmo Industries held that the conveyance allowance paid to the employee as defined under section 2(9) of the Employees State Insurance Act, 1948 irrespective of the fact that whether the same is fixed amount or not or regularly monthly paid or not, or either by virtue of contract of employment or otherwise will not fall under the definition of Wages as defined under Section 2(22) of the ESI Act.

Consequent to the said judgment now the employer need not have to deposit employees and employers contribution conveyance on allowance/travelling allowance paid to the employees, with ESI Authority and even for the purpose of computation of existing wage ceiling of Rs.21,000/-, the conveyance allowance should be excluded.

This will lower the wage on which contribution is to be calculated and also bring employees who were getting a gross over Rs 21000.00 including conveyance, into ESIC coverage if their gross minus conveyance is now up to or below Rs 21000.00
