Things to know:

Sussmann got the first trial discovery from Durham's SCO on Oct 7. He and his lawyers had 3 weeks to sift through it. He knows Durham is going to be able to easily prove not just the false statement charge, but the superseding criminal conspiracy charge that is coming. He's also found out that former FBI General Counsel James Baker is cooperating with Durham and if this goes to trial, will be testifying against Sussmann.
